Supreme Court on Student Protests: ‘Listening to Youth Is the Strongest Tool Against Violence’, Tags Plea on July 20 Sansad Chalo March
In a significant observation on the management of public demonstrations, the Supreme Court on Wednesday said meaningful dialogue and constructive engagement with young protesters remain the most effective means of preventing violence.
The Court cautioned that excessive use of State authority during protests could intensify tensions instead of restoring normalcy.
The observations came from a Bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V. Mohan while considering a petition seeking legal action against organisers of the July 20 “Sansad Chalo” march in New Delhi, during which violent incidents were reported.
The Bench directed that the matter be heard along with the batch of pending petitions relating to student demonstrations and allegations concerning police conduct during those events.
The petition was filed by former Indian Air Force officer Manish Solanki, who sought judicial directions for fixing responsibility on organisers and individuals allegedly involved in violence during the July 20 march.
The plea also requested that governments should not withdraw criminal cases arising from the protests merely based on political decisions.
Additionally, it sought identification of individuals accused of making derogatory remarks against police or security personnel and suggested community service as an appropriate corrective measure.
Appearing for the petitioner, Advocate Rizwan Ahmad argued that while public debate had focused largely on the accountability of governments and law enforcement agencies, organisers of the protest had escaped adequate scrutiny.
He submitted that despite the passage of two weeks after the violence, several organisers continued to make public statements that, according to him, further aggravated tensions.
The Bench observed that the issues raised in the petition formed part of a larger set of questions already pending before the Court.
It noted that all related matters would be examined together so that every perspective, including differing opinions, could receive careful judicial consideration.
When the petitioner’s counsel pressed for immediate issuance of notice, the Court underlined that handling young demonstrators requires patience and sensitivity rather than coercive measures.
The Bench observed that counselling, engagement and dialogue are more effective than aggressive enforcement in preventing escalation of public unrest.
Counsel for the petitioner, however, argued that individuals allegedly involved in acts such as stone-pelting and violence should remain accountable under the law and should not automatically benefit from any future withdrawal of criminal proceedings.
He submitted that indiscriminate withdrawal of cases could create an undesirable legal precedent and weaken public confidence in the rule of law.
The petitioner further contended that the July 20 march had allegedly been organised without the necessary permissions and that several conditions governing the event had been violated.
According to the submissions, organisers permitted participants to proceed towards Parliament despite alleged procedural lapses, raising concerns regarding public safety and security.
Responding to these arguments, the Supreme Court reiterated that democratic protests should always begin peacefully and remain within the constitutional framework.
At the same time, it observed that law enforcement agencies should exercise restraint while responding to isolated incidents so that situations do not deteriorate into wider confrontation.
The Bench remarked that listening to young people and understanding the reasons behind their grievances constitutes one of the most effective ways to prevent violence.
It observed that communication and counselling remain stronger instruments for maintaining public order than excessive use of force.
The Court also clarified that operational decisions relating to crowd management must primarily remain within the domain of law enforcement authorities, while judicial scrutiny would focus on the broader constitutional and legal issues arising from the protests.
It directed that the Union Government would also have an opportunity to place its response on record.
The matter has now been tagged with the pending petitions arising from nationwide protests linked to the NEET examination controversy.
The present proceedings form part of the Supreme Court’s continuing examination of issues arising out of the July 20 demonstrations.
Earlier this week, the same Bench clarified that its interim order dated July 28 did not prevent governments from withdrawing criminal cases against eligible student protesters wherever such action is permissible under law.
The Court had also indicated that relief would not extend to individuals facing allegations involving grave offences, while expressing its willingness to facilitate closure of cases against eligible students so that criminal proceedings do not continue indefinitely without justification.
During the earlier hearing, the Bench further disclosed that it was considering the constitution of a Special Investigation Team (SIT) to examine cases that remain unresolved, besides proposing a separate committee headed by a former judge to review issues arising from the protests.
It also indicated that comprehensive guidelines governing police use of pellet guns during crowd-control operations may be framed in future proceedings, while emphasising that allegations against both protesters and law enforcement authorities must receive impartial examination.

सार्वजनिक आंदोलनों के दौरान कानून-व्यवस्था बनाए रखने के तरीके पर महत्वपूर्ण टिप्पणी करते हुए सुप्रीम कोर्ट ने बुधवार को कहा कि युवाओं की बात सुनना, उनकी समस्याओं को समझना तथा संवाद के माध्यम से समाधान तलाशना हिंसा रोकने का सबसे प्रभावी उपाय है।
न्यायालय ने यह भी कहा कि राज्य की ओर से अनावश्यक कठोर कार्रवाई कई बार तनाव को कम करने के बजाय और बढ़ा सकती है।
यह टिप्पणी भारत के मुख्य न्यायाधीश सूर्यकांत, न्यायमूर्ति जॉयमाल्य बागची तथा न्यायमूर्ति वी. मोहन की पीठ ने उस याचिका पर सुनवाई के दौरान की, जिसमें 20 जुलाई को नई दिल्ली में आयोजित ‘संसद चलो’ मार्च के आयोजकों के विरुद्ध कार्रवाई की मांग की गई थी।
अदालत ने निर्देश दिया कि इस याचिका को छात्र आंदोलनों तथा प्रदर्शन के दौरान कथित पुलिस कार्रवाई से संबंधित पहले से लंबित मामलों के साथ जोड़ा जाए।
पूर्व भारतीय वायुसेना अधिकारी मनीष सोलंकी द्वारा दायर याचिका में 20 जुलाई के प्रदर्शन के आयोजकों तथा हिंसा में कथित रूप से शामिल व्यक्तियों की जवाबदेही तय करने का अनुरोध किया गया है।
याचिका में यह भी मांग की गई कि हालिया छात्र आंदोलनों से जुड़े आपराधिक मामलों को केवल राजनीतिक निर्णयों के आधार पर वापस न लिया जाए।
इसके अतिरिक्त पुलिस और सुरक्षा बलों के विरुद्ध कथित अपमानजनक टिप्पणियां करने वालों की पहचान कर उनसे सामुदायिक सेवा कराए जाने का सुझाव भी दिया गया।
याचिकाकर्ता की ओर से अधिवक्ता रिजवान अहमद ने दलील दी कि अब तक चर्चा मुख्य रूप से सरकारों और पुलिस की भूमिका तक सीमित रही है, जबकि आंदोलन के आयोजकों की जिम्मेदारी पर पर्याप्त ध्यान नहीं दिया गया।
उन्होंने कहा कि हिंसा की घटनाओं के बाद भी कुछ आयोजक लगातार सार्वजनिक मंचों से ऐसे बयान दे रहे हैं जो विवाद को और बढ़ा सकते हैं।
पीठ ने कहा कि याचिका में उठाए गए प्रश्न पहले से लंबित व्यापक मामलों से जुड़े हुए हैं और इन सभी विषयों पर एक साथ विचार किया जाएगा ताकि प्रत्येक पक्ष और सभी दृष्टिकोणों का समुचित परीक्षण किया जा सके।
जब याचिकाकर्ता ने तत्काल नोटिस जारी करने का आग्रह किया, तब न्यायालय ने कहा कि युवाओं से जुड़े आंदोलनों में संयम और संवाद की नीति अधिक प्रभावी होती है।
अदालत के अनुसार परामर्श और सकारात्मक बातचीत के माध्यम से ही परिस्थितियों को नियंत्रित किया जा सकता है, जबकि कठोर कार्रवाई कई बार स्थिति को और जटिल बना देती है।
हालांकि याचिकाकर्ता की ओर से यह भी तर्क दिया गया कि पत्थरबाजी अथवा हिंसा में कथित रूप से शामिल व्यक्तियों की जवाबदेही सुनिश्चित की जानी चाहिए और ऐसे मामलों को सामान्य रूप से वापस लेने की प्रवृत्ति भविष्य में गलत उदाहरण स्थापित कर सकती है।
याचिका में यह भी कहा गया कि 20 जुलाई का मार्च आवश्यक अनुमति के बिना आयोजित किया गया तथा आयोजन से संबंधित कई निर्धारित शर्तों का कथित रूप से पालन नहीं किया गया। साथ ही सुरक्षा व्यवस्था और सार्वजनिक व्यवस्था को लेकर भी गंभीर चिंताएं व्यक्त की गईं।
इन दलीलों पर प्रतिक्रिया देते हुए सर्वोच्च न्यायालय ने कहा कि लोकतांत्रिक विरोध प्रदर्शन हमेशा शांतिपूर्ण ढंग से प्रारंभ होने चाहिए और संवैधानिक मर्यादाओं के भीतर संचालित होने चाहिए।
अदालत ने यह भी कहा कि यदि किसी स्थान पर सीमित स्तर पर अप्रिय घटनाएं होती हैं, तब भी कानून-व्यवस्था बनाए रखने वाली एजेंसियों को अत्यधिक संयम का परिचय देना चाहिए ताकि स्थिति व्यापक हिंसा में न बदले।
पीठ ने स्पष्ट किया कि युवाओं की भावनाओं को समझना और उनकी समस्याओं को सुनना किसी भी तनावपूर्ण परिस्थिति को नियंत्रित करने का सबसे प्रभावी माध्यम है।
न्यायालय के अनुसार संवाद और परामर्श समाज में शांति बनाए रखने के लिए कहीं अधिक उपयोगी साधन हैं।
सुप्रीम कोर्ट ने यह भी कहा कि मौके पर कानून-व्यवस्था से जुड़े परिचालन संबंधी निर्णय संबंधित एजेंसियों के अधिकार क्षेत्र में आते हैं, जबकि न्यायालय संवैधानिक और विधिक प्रश्नों की समीक्षा करेगा। साथ ही केंद्र सरकार को भी अपना पक्ष रखने का अवसर दिया जाएगा।
इस याचिका को अब NEET परीक्षा विवाद से जुड़े देशव्यापी छात्र आंदोलनों पर लंबित अन्य मामलों के साथ सुनवाई के लिए सूचीबद्ध किया गया है।
यह कार्यवाही 20 जुलाई के छात्र प्रदर्शन से जुड़े मामलों की निरंतर न्यायिक समीक्षा का हिस्सा है।
इससे पहले इसी पीठ ने स्पष्ट किया था कि 28 जुलाई के अंतरिम आदेश का अर्थ यह नहीं है कि सरकारें कानून के अनुसार पात्र छात्रों के विरुद्ध दर्ज मामलों को वापस नहीं ले सकतीं।
न्यायालय ने यह भी स्पष्ट किया था कि गंभीर प्रकृति के अपराधों के आरोपित व्यक्तियों को इस राहत का लाभ नहीं मिलेगा।
साथ ही अदालत ने संकेत दिया था कि पात्र छात्रों के विरुद्ध लंबित मामलों के शीघ्र निस्तारण का प्रयास किया जाएगा ताकि बिना उचित कारण आपराधिक मुकदमे अनिश्चितकाल तक लंबित न रहें।
पूर्व सुनवाई के दौरान पीठ ने यह भी संकेत दिया था कि जिन मामलों में कार्रवाई लंबित है, उनकी समीक्षा के लिए विशेष जांच दल (SIT) गठित करने पर विचार किया जा रहा है।
इसके अतिरिक्त एक सेवानिवृत्त न्यायाधीश की अध्यक्षता में अलग समिति गठित करने तथा भीड़ नियंत्रण के दौरान पुलिस द्वारा पेललेट गन के उपयोग के संबंध में व्यापक दिशा-निर्देश तैयार करने की संभावना पर भी विचार किया जा रहा है।
न्यायालय ने दोहराया कि प्रदर्शनकारियों और कानून-व्यवस्था बनाए रखने वाली एजेंसियों, दोनों से जुड़े आरोपों की निष्पक्ष जांच आवश्यक है।
