High Court questions why house of petioner was demolished without following procedure of law in Azamgarh district

The Allahabad High Court has directed the officers of revenue department of Uttar Pradesh to file reply stating therein that under what circumstances without following the procedure of law, the house of the petitioner was demolished immediately after the order dated July 22, 2024 passed by the additional collector (land revenue), Azamgarh.
Hearing a writ petition filed by one Sunil Kumar of Azamgarh district, Justice Prakash Padia in his order dated September 6 directed to put up this case on September 18, 2024 for  next hearing and directed  the parties to maintain status quo on the spot till  the  next date of listing.
According to the petitioner, immediately after the order dated July 22, 2024 was passed by the additional collector (land and revenue) under section 67(5) of UP Revenue Code, 2006, the house of petitioner was demolished.
The counsel for the petitioner contended that the provision of section 67 (5) of UP Land Revenue code is being used by the revenue officers arbitrarily by demolishing the cottages (Jhopri) of poor villagers, as a result  they are thrown on the streets.
As per section 67 (5) of UP Land Revenue Code, 2006, if a person is wrongfully occupying the land and has done cultivation therein, the revenue officers may take steps as prescribed under the law.
