BHU Vice Chancellor lands himself in a tight corner: High Court wants his explanation:

The Allahabad High Court has directed the vice-chancellor of Banaras Hindu University (BHU) to file his affidavit explaining the delay, which appears to be deliberate, for withholding to date, the implementation of the resolution dated June 4, 2021, passed by the executive council of BHU by which petitioner- Dr Sushil Kumar Dubey, an assistant professor, was denied promotional benefits.
Justice Rohit Ranjan Agarwal passed the above order in a petition filed by Dr. Sushil Kumar Dubey, an assistant professor in the department of Ayurved Institute of Medical Sciences, Banaras Hindu University (BHU), who was denied promotional benefits despite a resolution of the executive council three years back.
According to the petitioner, he was recommended for promotion from assistant professor stage two to stage three in the meeting of the executive council held on June 4, 2021, but despite the decision taken by the executive council promoting the petitioner, the resolution of the executive council has not been carried out by BHU authorities till date and more than three years have elapsed.
However, the counsel appearing for vice-chancellor, BHU argued that though the resolution of the executive council dated June 4, 2021, exists but matter needs to be reconsidered in the light of the letter of the University Grants Commission (UGC) dated February 23, 2021. According to him, the vice-chancellor wants to clarify whether the petitioner had rendered five years of continuous service at stage two or not.
On this, the court observed, “This court is surprised by the stand taken by the vice-chancellor after three years from the date of resolution of executive council dated June 4, 2021.”
The court in its order dated September 25, while directing the vice-chancellor to file his affidavit, within a week observed, “Prima facie, it appears to be a deliberate action of vice-chancellor withholding the implementation of the executive council which was taken way back in the year 2021.”
Making these observations, the court has fixed October 15, 2024, as the next date of hearing in the case.
