Allahabad High Court Grants Bail to Former SP MLA Irfan Solanki in Gangsters Act Case

Prayagraj,– In a significant development, the Allahabad High Court on Thursday granted bail to Irfan Solanki, former MLA of the Samajwadi Party, in a case registered against him under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act.
The order was pronounced by Justice Sameer Jain, who had reserved his judgment on September 2, 2025, after hearing arguments from both the prosecution and defense counsels.
According to Solanki’s legal representative, Imran Ullah, the bail order means that Irfan Solanki will walk out of jail immediately, as this was reportedly the last criminal case pending against him.
Background of the Case
The case against Solanki was registered at Jajmau Police Station under the Gangsters Act in December 2022, following an alleged offence that took place in November 2022. It was claimed that Solanki had set a hut on fire as part of a purported attempt to grab the property, leading to the invocation of stringent provisions under the Gangsters Act.
During the bail hearing, Solanki’s counsel argued that the former MLA had been incarcerated for over two years and seven months, while the minimum punishment prescribed under the Gangsters Act is two years.
Moreover, the defense highlighted that Solanki had already been granted bail in all other criminal cases pending against him, including the original arson case that led to the imposition of the Gangsters Act.
Based on these arguments, the court held that the applicant is entitled to bail in the present case.
Opposition by State Counsel
The state government’s counsel opposed the bail application on multiple grounds, emphasizing the serious nature of the allegations and the provisions under the Gangsters Act. Despite these objections, the High Court determined that Solanki’s long pre-trial incarceration and prior bail history warranted the granting of bail.
Implications
With this order, Irfan Solanki is set to regain his freedom, marking the conclusion of the legal proceedings against him in this particular matter.
Legal experts suggest that the decision reinforces the principle that prolonged pre-trial detention, particularly when other related cases have been resolved, can be a strong ground for bail under Indian law.
