Allahabad High Court Summons Farrukhabad SP Over Alleged Police Coercion in Habeas Corpus Case

The Allahabad High Court, while hearing a habeas corpus petition, took serious note of allegations that the Farrukhabad Police had coerced the petitioner into withdrawing her plea.
The court directed the Superintendent of Police (SP), Farrukhabad, to personally appear before it on October 15.
In compliance with the earlier directive, the SP appeared before the court on Tuesday.
The division bench of Justice J.J. Munir and Justice Sanjiv Kumar passed the order while hearing a habeas corpus writ petition filed by Preeti Yadav, who alleged that her husband had been illegally detained by police officials and that she was forced to sign certain papers under duress.
Earlier, on October 9, 2025, the court had issued a summons to Anurag Mishra, Station House Officer (SHO) of Kayamganj Police Station, the Circle Officer, Kayamganj, and the Superintendent of Police, Farrukhabad, directing them to appear in person on October 14, 2025, at 2 p.m.
The same order had also explicitly restrained these officers and others in the department from contacting, threatening, or harassing the petitioner in any manner.
In a supplementary affidavit, the petitioner claimed that she and two others were illegally detained by the respondent police authorities from September 8, 2025 (9 p.m.) to September 14, 2025 (11 p.m.).
During this period, she was allegedly forced to write and sign a letter under pressure.
During Tuesday’s hearing, the state government counsel sought time till Wednesday (October 15) to file a detailed affidavit responding to the petitioner’s allegations.
The court accepted the request and directed the SP, Farrukhabad, to respond to the petitioner’s affidavit by the next hearing.
The petitioner’s counsel also filed an additional affidavit, which the court took on record.
