Gunfire and Stone-Pelting Erupt Over Property Dispute in Naini, Retired Commandant Arrested

Tension gripped the Chaka-Dhanuha area of Naini police station limits on Monday morning after a heated property dispute escalated into gunfire and stone-pelting.
The incident involved a retired CRPF Commandant who allegedly fired shots from a licensed rifle to threaten locals during a confrontation over a plot of land where a house was being constructed.

According to police reports, the altercation began over a boundary dispute at the site. The situation turned violent when the retired officer brandished his rifle, prompting chaos in the locality. A video of the confrontation showing the accused threatening locals with a rifle from his house balcony quickly went viral on social media.


Victim’s Complaint Leads to FIR

Saroj Tiwari, the complainant in the case, alleged that the retired commandant, Suryakant Mishra, and his two sons were carrying out construction on land belonging to her. Misra, who was carrying out the construction, also opened fire and pelted stones at workers.

Based on her complaint, an FIR has been registered against Suryakant Mishra and his sons, Ajit and Anuj Mishra.

However, sources said Saroj Tewari, who is a lawyer and former Pradha, allegedly reached the site with several lawyers, including dozens of other persons, and started demolishing the construction work being carried out by Surya Kant Misra, who reportedly claims that the land belongs to him.

This demolition irked Misra, who took out his rifle and fired two shots to scare away those who were demolishing the construction that he was getting carried out.

In a way, police investigation is now supposed to be based on land papers and who the actual owner is. As far as gunshots are concerned, it is the responsibility of the police to determine the motive, whether the shots were fired to scare away or to kill or injure any person.

Legally, a person has the right to protect himself and his property, and in case of intrusion or trespassing, the person has the right to defend himself. The law also enumerates the same.

Besides, in case the story that the lawyer reached the place with a JCB and started getting demolition done, in this case, this action is also a criminal offence and punishable, as no person has the right to demolish any person’s property, as this rests purely in the hands of the judiciary or the competent authority.

If allegations that Saroj Tewari reached the place with a JCB and got the construction demolished are true, then in this case police are duty-bound to lodge a complaint against her also and do justice. However, in our system, this does not happen because of police inaction and improper steps that pave the way for future crime.

ACP  Arun Tripathi confirmed: An FIR has been lodged based on Saroj Tiwari’s written complaint. Suryakant Mishra and his son Ajit have been taken into custody along with their licensed rifle.”


Land Dispute Behind the Violence

Police investigations revealed that the dispute stemmed from a 2004 land purchase made by Suryakant Mishra, for which he possesses documents. The land is located in Chaka, and the Mishra family resides in the adjacent building, a prominent two-story house. On Monday, as construction work began at the disputed site, tempers flared, resulting in stone-pelting and multiple gunshots being fired to intimidate the opposing side.

Eyewitnesses stated that 30-40 locals gathered at the site amid the confrontation, further escalating tensions in the area. Fortunately, no casualties were reported, but panic spread throughout the locality.


Swift Police Action

Police personnel rushed to the scene and swiftly took Suryakant Mishra and his son Ajit Mishra into custody. The authorities seized the licensed rifle used in the firing incident. The police have also started preparing a detailed report of the property ownership records to settle the dispute and avoid further violence.

Residents have urged authorities to intervene and resolve the property matter promptly, fearing renewed clashes.
