Anmol Bishnoi Interrogation: Mumbai Police Seeks Way Around Tihar Jail Restrictions
MUMBAI: A government-imposed restriction on moving Anmol Bishnoi out of Tihar Jail has become a major hurdle for Mumbai Police in the investigation into Baba Siddique’s murder.
With the case against the arrested accused approaching trial, investigators have now sought the Maharashtra government’s help in obtaining central approval to question the jailed gangster, sources familiar with the matter said.
The request seeks temporary relaxation of a Union government directive issued on December 5, 2025.
The order prevents Anmol from being transferred out of the Delhi prison, limiting the options available to investigators seeking his examination in the murder case.
The issue has drawn repeated scrutiny from the special court, which has questioned why police have not interrogated a person they themselves describe as a wanted accused and the alleged architect of the killing.
Mumbai Police has arrested 27 people in the case and maintains that they acted on Anmol’s instructions, but has told the court that he has not yet been questioned.
Investigators are now seeking a way to proceed without violating the restriction governing his detention.
Legal restriction limits investigators’ options.
Anmol was brought back from the United States and arrested by the National Investigation Agency on November 19, 2025.
The Union government subsequently invoked Section 303 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) to prevent his removal from Tihar Jail.
The provision allows the government to restrict the transfer of prisoners when considerations such as the nature of the alleged offence, possible public-order consequences,s or the broader public interest warrant such a measure.
The restriction has significant consequences for criminal proceedings. While it remains effective, a court cannot order the prisoner’s physical production before it. Investigators must instead seek judicial permission to question the accused inside the prison.
Law enforcement agencies have argued that this arrangement can complicate investigations, particularly when officers need extended questioning or want to confront one accused with another.
A Delhi court has already refused to issue a production warrant for Anmol because the government’s order remains in force.
A similar restriction applies to his elder brother, Lawrence Bishnoi, who is being held at Sabarmati Jail in Gujarat. The order concerning Lawrence dates back to August 2023 and has been renewed annually.
Court seeks explanation for failure to question alleged conspirator
The question of Anmol’s interrogation has been raised in court for several months. In July, Baba Siddique’s wife, Shehzeen, sought judicial intervention through lawyers Pradeep Gharat and Trivenkumar Karnani.
Her application asked the police to secure Anmol’s custody and question him about the motive behind the killing.
Special Judge S R Navander questioned the investigating team about its failure to take steps to examine a wanted accused who was already in custody.
The court issued a show-cause notice to the investigating officer in August.
Police responded that the Union government’s directive created a legal impediment to obtaining Anmol’s physical custody and had hampered the investigation.
The agency cited this restriction as the reason he had not been interrogated.
The court returned to the issue on October 21, directing investigators to explain what steps had been taken to secure his presence.
A confidential report was submitted on Wednesday, after which the matter was listed for consideration the following week.
The fresh request to Maharashtra authorities appears aimed at addressing the impasse between the requirements of the investigation and the restrictions imposed by the government.
Siddique killing remains central to the investigation
Baba Siddique, a former Maharashtra minister and NCP leader, was shot dead outside the Bandra East office of his son, former MLA Zeeshan Siddique, on October 12, 2024.
Mumbai Police has alleged that members of the Bishnoi gang carried out the killing.
Anmol has been identified by investigators as a wanted accused and alleged mastermind, while 27 other accused have been arrested. These allegations remain subject to the judicial process.
As proceedings against the arrested accused move towards trial, investigators face pressure to clarify the alleged chain of command and establish the wider circumstances surrounding the murder.
In a separate case involving actor Salman Khan, Anmol has filed a plea seeking to surrender and participate in judicial proceedings. The plea remains undecided.
Separate firing case renews debate over gang-related violence
The police request also comes against the backdrop of another high-profile shooting incident in Mumbai.
On October 18, a firing incident involving actor Tiger Shroff in Juhu prompted renewed public and political discussion about security and alleged criminal networks.
Anil Pandit has been named as the main accused in that case. Neither Anmol nor Lawrence Bishnoi has been named as an accused in connection with the incident.
Shiv Sena (UBT) leader Uddhav Thackeray subsequently criticised the Maharashtra government over its handling of such incidents and challenged it to bring Lawrence Bishnoi to the state.
The Tiger Shroff case, however, remains separate from the investigation into Siddique’s murder.
The Bishnoi brothers have also been linked in public reporting to the 2024 shooting outside Salman Khan’s Bandra residence, another case that brought attention to the activities attributed to the gang.
Previous legal precedent offers an alternative.
The dispute over transferring prisoners and securing their appearance before courts is not without precedent.
In 2013, the Maharashtra government imposed a comparable restriction on Zabiuddin Ansari, also known as Abu Jundal, who was accused in the 2008 Mumbai terror attacks case.
The Bombay High Court declined to cancel the government’s order but allowed Ansari to attend court proceedings through a video link from prison.
That case demonstrated one way judicial proceedings can continue despite restrictions on physically moving an accused.
Whether a comparable arrangement or another lawful mechanism can be used in Anmol’s case will depend on the applicable order and decisions by the relevant authorities.
For Mumbai Police, the immediate task is to find a legally permissible way to question Anmol while continuing the prosecution of those already arrested.
The Maharashtra government’s response to the request could prove important in determining how the investigation proceeds.
