A major legal battle over the inheritance of late businessman and Sona Comstar chairman Sunjay Kapur’s personal fortune — reportedly running into thousands of crores — is unfolding in the Delhi High Court.
The dispute is between Sunjay’s children from his second marriage with actress Karisma Kapoor — Samaira and Kiaan — and his third wife, Priya Kapur.
Sunjay died at the age of 53 in June while playing polo in London after a fatal allergic reaction to a bee sting.
Following his death, a will surfaced which reportedly allocates most of his personal estate to Priya and her children — Azarias, Sunjay and Priya’s son, and Safira, Priya’s daughter from her previous marriage.
However, Karisma’s children claim they have been completely left out of the will, which they believe is suspicious and possibly manipulated.
Even Sunjay’s mother, Rani Kapur, who also received no share, has backed Samaira and Kiaan’s claim and questioned the authenticity of the will.
Arguments by Karisma Kapoor’s children
Samaira and Kiaan have argued that Priya allegedly conspired with the executor and witnesses to unlawfully take control of the estate.e
They say the will is filled with serious errors, such as the misspelling of Azarias’ name and incorrect addresses, and argue that a meticulous businessman like Sunjay would never overlook such mistakes, making the document questionable.
They say the will is not registered, and the executor, Shradha Suri Marwah (Chairperson and MD of Subros Lt,d), should not have accepted a document with such irregularity. ies
They accuse Priya of hiding important as, including crypto holdings, insurance policies, jewellery, artworks and other valuables.
They claim Sunjay had no reason to suddenly write a will months before his death, and that if he had done so, he would have informed his children or family.
They also highlight that even his mother was excluded, which adds to the suspicion.
Arguments by Priya Kapur
Priya has argued that Samaira and Kiaan have already received ₹1,900 crore worth of assets from the family’s RK Trust, so Sunjay believed additional inheritance was unnecessary.
She argues that the children are questioning the will without formally challenging it in court, and the current matter is only at the probate stage.
She says Sunjay’s divorce from Karisma was bitter, and it is not unusual that he left out her children from the will while choosing to leave his estate to his present wife and family.
Priya states that the will was drafted using Sunjay’s mother’s will as a model, which explains similarities and mistakes.
She further says that the digital record and trail of the will is complete and legitimate, and the opposing side is selectively using details to create doubt
All sides have now presented their arguments, and the case will continue as the court examines the validity of the will and decides the rightful distribution of Sunjay Kapur’s vast estate
