Allahabad High Court Grants Bail in Marriage-Promise Case, Examines BNS Definition of ‘Woman’
PRAYAGRAJ: The scope of a criminal law provision dealing with sexual relations allegedly obtained through a false promise of marriage came under scrutiny at the Allahabad High Court, which granted bail to a man accused of deceiving a transgender woman with an assurance of marriage.
In its October 15 order, Justice Arun Kumar Singh Deshwal examined whether Section 69 of the Bharatiya Nyaya Sanhita (BNS) could be invoked in the circumstances described in the complaint.
The provision prescribes punishment for sexual intercourse with a woman through deceitful means or a promise of marriage made without any intention of honouring it, where the conduct does not amount to rape.
The court concluded that, on a preliminary assessment, the ingredients of an offence under this particular section were not established.
It emphasised that its interpretation concerned the statutory meaning of “woman” for Section 69 alone and should not be treated as a ruling on the applicability of other criminal provisions.
Dispute over relationship and alleged financial transactions
The complainant, a transgender woman, alleged that she had been in a relationship with Mohd Sakir for more than 18 months on the understanding that they would marry.
According to the first information report, Sakir later declined to marry her after allegedly receiving more than Rs 5 lakh.
She also accused him of entering into a physical relationship with her based on a promise of marriage that he did not intend to fulfil.
The case was registered at Izzatnagar police station in Bareilly district. Sakir sought bail, with his counsel challenging the applicability of Section 69 in light of the complainant’s transgender identity and the wording of the law.
Defence cites statements and medical assessment
The defence told the court that the complainant’s statements recorded under Sections 180 and 183 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) indicated that she had been assigned male at birth and had undergone vulval reconstruction surgery on April 11, 2023.
Counsel also submitted that she had disclosed her transgender identity to Sakir before their relationship began.
Relying on a medical panel report dated August 19, 2026, the defence argued that the complainant had undergone genital reconstruction but did not have a uterus.
On that basis, it contended that she did not fall within the statutory definition of “woman” applicable to Section 69.
The argument referred to Section 2(35) of the BNS, which defines a woman as a female human being. The defence maintained that the prosecution could not invoke Section 69 unless this statutory requirement was met.
The state opposed the bail plea, arguing that a transgender woman should not be excluded from the provision merely because she had been assigned male at birth and subsequently undergone surgery.
Court refers to transgender law and parliamentary report
In considering the issue, the High Court referred to the Transgender Persons (Protection of Rights) Act, 2019, which recognises transgender persons as a distinct category under the law.
Its order reasoned that a person who undergoes sex-reassignment surgery continues to fall within the statutory category of a transgender person rather than automatically being classified as a male or female human being for the provision under consideration.
The court also examined Report No. 246 of the Parliamentary Standing Committee on Home Affairs.
The committee had recommended that transgender women be brought within the scope of the BNS provisions relating to rape through a suitable legislative amendment.
According to the court’s order, that recommendation was not incorporated into the law, and the statutory definition of “woman” remained unchanged. The court relied on this legislative position while considering the limited question before it.
Bail order does not decide other offences
Based on its preliminary interpretation, the High Court held that an offence under Section 69 of the BNS was not made out prima facie in the case and granted Sakir bail subject to conditions.
The court expressly restricted its observation to the interpretation of the word “woman” under Section 69. It did not extend that conclusion to other offences, nor did the bail order amount to a final adjudication of the allegations made by the complainant.
The decision centres on the wording of a specific criminal provision and the question of whether its present statutory definition covers the circumstances raised in this case.
Any broader legal consequences would depend on the relevant provisions and further judicial or legislative developments.
