Allahabad High Court Orders FIR Against Farrukhabad Investigating Officer Over Suspected Tampering With Arrest Records

By Rajesh Panday
Setting aside the arrest of Mohd. Yaseen, the court directs his immediate release after finding discrepancies in documents relating to the grounds of his detention. The Superintendent of Police has been asked to submit a compliance report within seven days.

PRAYAGRAJ: Taking a serious view of alleged manipulation of official arrest records, the Allahabad High Court has ordered the registration of an FIR against a police investigating officer in Farrukhabad district.

The court reached this conclusion after discovering that information explaining why an accused was arrested appeared to have been added to a document after it had originally been prepared.

The court also ruled that the arrest of the petitioner, Mohd. Yaseen, was illegal and directed authorities to release him immediately.

It found that the police had failed to establish that he had been properly informed of the specific reasons and grounds for his arrest, as required under the law.

The directions were issued by a division bench comprising Justice Atul Sreedharan and Justice Achal Sachdev while hearing Yaseen’s habeas corpus petition.

The judges expressed the view that the investigating officer’s conduct appeared to attract provisions under Chapter XIV of the Bharatiya Nyaya Sanhita (BNS), which deals with offences involving false evidence and obstruction of public justice.

The case arose from the death of a woman’s daughter, who allegedly died by suicide following harassment attributed to Yaseen.

He was booked under Section 108 of the BNS, relating to abetment of suicide. His bail application had also been rejected by the competent court.

Dispute over the actual date of arrest

According to the police arrest memorandum, Yaseen was taken into custody on September 14, 2026. However, he disputed this account before the High Court, maintaining that the police had detained him a day earlier, on September 13.

He claimed that he had gone to the police station accompanied by his lawyer to participate in the investigation into the woman’s daughter’s death, but was taken into custody during that visit.

The petitioner also challenged the authenticity and completeness of the paperwork used to justify his arrest. The High Court examined the documents submitted by both sides to determine whether the statutory requirements had actually been followed.

During the proceedings, the state government maintained that a separate document explaining the grounds of arrest had been prepared and handed over to Yaseen on September 14.

It also asserted that the document carried his signature, indicating that he had received the information.

However, a comparison of the scanned records submitted by the government with the copies attached to Yaseen’s petition revealed a significant discrepancy.

The judges found that the arrest memorandum produced by the state matched the version already available to the accused. The document detailing the reasons for his arrest, however, was not the same as the copy supplied to him.

Court detects discrepancies in arrest documents.

A closer examination revealed that the version received by Yaseen contained only a reference to Section 108 of the BNS. It did not include the additional explanation appearing in the document subsequently presented by the state.

The latter version contained further particulars, including the registration of a criminal case and the allegation that the deceased had taken her own life because of harassment attributed to the petitioner.

The absence of these details from the document given to Yaseen became central to the court’s assessment.

The bench concluded that the available material strongly indicated that the petitioner had not actually been furnished with the complete grounds for his arrest.

It further observed that the investigating officer appeared to have subsequently introduced additional information into the relevant document to create the impression that the legal requirements had been fulfilled.

The judges took particular exception to what appeared to be an attempt to strengthen the police record retrospectively.

Such conduct, they indicated, could amount to an offence under the BNS provisions dealing with false evidence and offences against public justice.

The court expressed concern that the disputed documentation may have been prepared or altered to defend the legality of the arrest and prevent the accused from obtaining relief during remand and bail proceedings.

SP directed to initiate criminal proceedings.s

In view of these findings, the High Court directed the Superintendent of Police, Farrukhabad, to ensure registration of an FIR against the investigating officer.

The order places responsibility on the district police chief to take action on the suspected fabrication of official records.

The court also instructed the SP to submit a compliance report within seven days, demonstrating that its directions had been implemented.

The order was passed on November 4, with November 16 fixed as the next date of hearing.

The ruling carries significance beyond the individual case, as it underscores the obligation of police authorities to maintain accurate arrest records and communicate the grounds of detention to accused persons in accordance with legal requirements.

By declaring Yaseen’s arrest unlawful and ordering action against the investigating officer, the High Court has also emphasised that procedural safeguards cannot be bypassed through alterations to official documents.
