Tiger Shroff Firing Case: Accused Claims He Is 17, Court Orders Police to Verify Age

The accused, who faces allegations of involvement in the October 18 shooting near the actor’s car in Juhu, has submitted birth documents claiming he was a minor at the time of the incident. The court has given police 15 days to establish his actual age.

MUMBAI: A fresh legal complication has emerged in the investigation into the shooting near Bollywood actor Tiger Shroff’s car in Mumbai, with one of the arrested suspects claiming that he was below 18 when the incident occurred.

The claim, if established, could shift his case from the regular criminal justice system to the juvenile justice framework.

The accused appeared before a special court on Friday and maintained that he was only 17 on the day of the shooting. Mumbai Police, however, have recorded his age as 19.

Taking note of the conflicting claims, Special Judge S R Navander directed the investigating officer to conduct an inquiry and submit a report within 15 days.

The court has, for the time being, allowed the police to retain the accused in custody. He was remanded to police custody until November 11, along with four other suspects.

His request for transfer to an observation home was not accepted at this stage.

The incident occurred at approximately 7 pm on October 18 near Pushpa Narsee Park in Juhu. Shroff was returning after playing a football match when gunshots were fired at his vehicle.

The actor escaped without injury, but his driver and a passerby sustained bullet wounds.

The suspect was taken into custody on October 19 in Kota, Rajasthan, along with two other alleged participants, following an operation by Rajasthan Police.

They were identified as Hrithik Mahto, also known as Roshan, 22, who allegedly drove the motorcycle used in the attack, and Rehan Ansari, 19, who is accused of being the second shooter. The total number of arrests in the case has now reached 13.

Seeking recognition as a juvenile, the accused approached the court through his aunt.

His lawyers, Sidhanth Mor and Divyam Gaur, submitted a birth certificate and an Aadhaar card issued in Haryana as supporting documents. Both records mention November 30, 2008, as his date of birth.

If these documents are authenticated, he would have been 17 years and 10 months old when the shooting took place on October 18. He is due to turn 18 on November 30.

The defence argued that investigators should have checked the suspect’s age with the relevant authorities before classifying him as an adult and initiating regular police custody proceedings.

It further alleged that the police had failed to verify the Haryana-issued documents despite the material indicating that he might be a minor.

The special court said an age determination exercise was necessary in view of the claim made by the accused.

In its order, it instructed the investigating officer to establish whether he was below 18 on the date of the alleged offence and place the findings before the court within the stipulated period.

However, the judge was not persuaded to grant immediate relief. The court observed that the accused had been produced before judicial authorities on several occasions following his arrest on October 19 but had not raised the question of his age during those appearances.

It also expressed the possibility that the claim might have been raised to avoid further custodial questioning.

The court has decided to reconsider his request for transfer to an observation home after receiving the police inquiry report.

Under the Juvenile Justice framework, a person found to be below 18 on the date of an alleged offence is dealt with through a separate legal process.

Instead of being lodged in an ordinary jail or subjected to regular police custody, such a person is ordinarily brought before the Juvenile Justice Board and placed in an observation home, subject to the applicable legal provisions.

The outcome of the age verification exercise could therefore significantly alter the course of proceedings against the accused in the high-profile shooting case.
