Allahabad High Court Orders Magistrate Training After Illegal Remand, Directs Release of Cyber-Fraud Accused

Court says judicial workload cannot excuse failure to scrutinise custody requests; JTRI Lucknow asked to prepare training modules following serious lapses in arrest documentation
Rajesh Pandey

PRAYAGRAJ: The Allahabad High Court has called for stricter scrutiny of police requests for custody, directing the Judicial Training and Research Institute (JTRI) in Lucknow to develop training programmes for judicial magistrates after finding that remand proceedings were being handled mechanically in several cases.

A division bench comprising Justice Atul Sreedharan and Justice Achal Sachdev stressed that magistrates must independently examine the legality of an arrest and the grounds cited by police before authorising custody.

The court cautioned that an excessive workload cannot be used to justify overlooking procedural safeguards that protect an individual’s liberty.

The observations came while the bench allowed a habeas corpus petition filed by Arvind Pandey, a resident of Kushinagar, who had challenged his detention in a cyber-fraud investigation.

Finding serious shortcomings in the arrest memorandum, the court ordered his immediate release, provided he was not wanted in any other case.

Court Rejects Magistrate’s Workload Explanation

During the proceedings, the High Court had sought an explanation from the Kushinagar district judge regarding the remand granted to Pandey despite significant deficiencies in the arrest documentation.

In a response dated October 3, 2026, the magistrate acknowledged the mistake and sought the court’s forgiveness.

He explained that a heavy workload, particularly the large number of bail applications requiring attention, had affected the scrutiny of the police remand request.

The bench did not accept this justification. It observed that deciding whether a person should remain in custody is among a magistrate’s most consequential responsibilities because it directly affects constitutional protections relating to personal liberty.

The court underlined that Articles 21 and 22 of the Constitution safeguard life and personal liberty and provide protections concerning arrest and detention.

These guarantees, it said, require judicial officers to exercise care and independent judgment rather than approve custody requests as a routine administrative exercise.

The judges observed that the magistrate appeared to have treated the police application as a procedural formality. Proper scrutiny, the bench indicated, could have prevented the need for the subsequent habeas corpus proceedings.

JTRI Asked to Prepare Special Training Modules

The bench expressed concern that the lapse was not an isolated incident. It noted that magistrates are expected to act as vigilant safeguards against unlawful detention, yet recurring deficiencies in remand proceedings suggested that the responsibility was not always being discharged adequately.

To address the problem, the court directed the director of JTRI, Lucknow, to examine the issue immediately, prepare appropriate training modules for judicial magistrates and circulate them without unnecessary delay.

The court also warned that future instances of a magistrate failing to discharge this duty would be viewed seriously. Depending on the circumstances, the High Court could consider recommending administrative action against the officer concerned.

The directions are intended to reinforce the need for careful judicial review before an accused person is placed in police custody for interrogation or sent to jail under judicial remand.

Deficiencies in Arrest Memo Prove Crucial

Examining the facts of Pandey’s case, the bench found that his arrest memorandum lacked essential information.

The allegation against him was that his bank account had been used as a so-called mule account through which other accused persons transferred money allegedly obtained through cyber fraud.

However, the arrest documentation contained serious omissions. According to the court’s findings, key particulars concerning the grounds for arrest, material seized during the investigation, relevant electronic evidence and information about the accused’s next of kin had either been left blank or recorded inadequately.

The bench held that these shortcomings were inconsistent with safeguards laid down by the Supreme Court in Vihaan Kumar v. State of Haryana and Mihir Rajesh Shah v. State of Maharashtra.

The judges also expressed concern over the recurrence of incomplete arrest memoranda, emphasising that documentation relating to an arrest must meet the legal requirements intended to protect the rights of the person being detained.

Immediate Release Ordered

Concluding that the defects in the arrest record undermined the legality of the detention, the High Court allowed Pandey’s habeas corpus petition and directed that he be released forthwith, unless his custody was required in another case.

The ruling highlights the responsibility of magistrates to examine arrest and remand records carefully rather than rely solely on the police version.

It also sends a clear message that judicial oversight of detention is a constitutional duty, not a routine formality that can be set aside because of pressure of work.

By directing specialised training for magistrates, the court has sought to address what it described as a recurring problem while reinforcing procedural safeguards against unlawful deprivation of personal liberty.
