Supreme Court Rejects Centre’s Two-Year Demand on OBC Creamy Layer, Extends Compliance Deadline by Eight Weeks

Court says parental salary alone cannot determine OBC creamy layer status; its interpretation of reservation rules will apply to service allocation for Civil Services Examination 2025 candidates.

NEW DELHI: The Centre has failed to secure additional time to implement the Supreme Court’s ruling on the identification of the creamy layer among Other Backward Classes (OBCs), with the court refusing to grant the government a two-year extension.

The government has instead been given a final window of eight weeks to comply with the judgment.

The latest order, delivered on Friday by a bench of Justices P.S. Narasimha and R. Mahadevan, also rules out the Centre’s proposal to restrict the earlier judgment’s application to future cases.

The judges found no adequate legal or reasonable basis for postponing its implementation.

The decision has an immediate bearing on the allocation of services to candidates selected through the Civil Services Examination 2025.

Although the examination results were announced on March 6, 2026, the process of assigning successful candidates to different services had not been completed.

The bench directed that the court’s interpretation of the creamy layer rules must therefore be followed while finalising the allocation of OBC candidates.

The court had originally allowed the government six months from its March 11, 2026, judgment to put the prescribed changes into effect.

As that period had elapsed, the bench granted a further eight weeks, while making it clear that the government could not defer compliance indefinitely.

At the same time, the judges drew a distinction between pending cases and appointments that had already been completed.

The ruling will not automatically disturb the seniority of other employees, invalidate concluded selections or provide an independent basis for reopening appointments made before the March 11 decision.

The bench further stated that people who believe their circumstances are comparable to those addressed in the judgment can pursue their claims before the appropriate courts, tribunals or other authorised bodies. Such matters will have to be examined individually.

The Supreme Court clarified that it was not expressing any opinion on the merits of those separate claims, although the legal interpretation laid down in its judgment could be considered by the authorities deciding them.

The dispute over income-based exclusion

At the heart of the litigation is the government’s September 8, 1993, Office Memorandum, which established the framework for identifying the creamy layer among OBCs.

A subsequent communication issued on October 14, 2004, became the subject of legal challenge because of the manner in which it dealt with the earnings of employees in different sectors.

Under the 1993 framework, salary and agricultural earnings were excluded from the income and wealth test used to determine creamy layer status.

However, the 2004 clarification required salary earnings of parents employed in public sector undertakings and private companies to be taken into account.

The resulting difference in treatment between children of government employees and those of PSU and private-sector workers was questioned before the Supreme Court.

In its March 11 ruling, the court found that relying exclusively on salary income could produce unequal treatment among otherwise comparable OBC candidates.

It held that the nature and category of a parent’s employment, including the status of the post held, must also be considered when determining whether a candidate belongs to the creamy or non-creamy layer.

The bench consequently rejected the idea that a candidate’s eligibility for OBC reservation could be settled merely by comparing parental earnings against prescribed income limits.

It said the criteria and classifications contained in the 1993 memorandum must form part of the assessment.

Friday’s order also settles how the ruling is to be applied during the transition period.

Selections, appointments and service allocations made after March 11, wherever they involve reservation benefits and the exclusion of creamy-layer candidates, will have to conform to the 1993 memorandum as interpreted by the Supreme Court.

The court, however, left the door open for the government to frame or revise its reservation policy and creamy-layer criteria.

Any such policy must remain consistent with constitutional requirements and the legal principles established by the judiciary.
