Kerala Congress Government Orders Fresh Probe Against CEC Gyanesh Kumar, Revives 2006 Bribery Allegations
THIRUVANANTHAPURAM: The Congress-led government in Kerala has ordered a preliminary vigilance inquiry into nearly 20-year-old bribery allegations against Chief Election Commissioner (CEC) Gyanesh Kumar, triggering questions over the political timing of the decision as the party continues its nationwide campaign demanding his resignation.
Congress has been at the forefront of protests against Kumar, accusing him of failing to ensure fairness and transparency in the Special Intensive Revision (SIR) of electoral rolls.
Demonstrations organised by the party, along with several other political and civil society groups, have so far failed to achieve their principal objective of forcing the CEC to step down.
Against this backdrop, the Kerala government’s decision to reopen allegations dating back to 2006 has acquired an unmistakable political dimension.
The timing has invited scrutiny, particularly because the accusations relate to events from Kumar’s tenure as a state government official, long before he assumed charge as Chief Election Commissioner.
On Tuesday, the state government referred a fresh complaint to the Vigilance and Anti-Corruption Bureau (VACB), directing it to undertake a preliminary examination of allegations that Kumar had sought illegal gratification to facilitate the release of contractors’ payments under the World Bank-funded Kerala State Transport Project (KSTP).
Kumar, a 1988-batch IAS officer of the Kerala cadre, was serving as the state’s Public Works Department secretary and project director of the KSTP when the alleged incident took place.
Old controversy resurfaces amid political confrontation.
The allegations first surfaced in November 2006 following the suicide of Malaysian engineer Lee See Been, who was associated with PATI-BEL, an Indo-Malaysian joint venture awarded road construction contracts under the project in 2002.
Lee reportedly left behind a suicide note, although its contents were never officially made public. Subsequently, allegations emerged that Kumar had demanded money for clearing pending project bills.
The then Communist Party of India (Marxist)-led government removed Kumar from the post of PWD secretary in December 2006 and initiated an investigation into complaints concerning the project.
However, the earlier vigilance examination did not establish the bribery allegations.
According to information subsequently placed before the Kerala Assembly by Home Minister Ramesh Chennithala, investigators had examined complaints that officials demanded Rs 2 crore from contractors for clearing payments against completed work.
The allegations could not be substantiated, and the department recommended that no further action was necessary.
The issue resurfaced after Congress leader M. Venugopal approached the state Home Minister, alleging that the original investigation had been compromised by external pressure.
He also referred to purported references to Kumar in the Malaysian engineer’s suicide note. No documentary evidence supporting this claim has so far been furnished by the complainant.
Fresh complaint adds to political controversy.
Another representation was submitted on October 23 by Sajan V.O., who claims to have supplied construction materials to PATI-BEL during the early 2000s.
Sajan alleged that delayed government payments had created financial difficulties for the company and affected payments to local suppliers.
He claimed that Lee had told him that Kumar was demanding Rs 2 crore to facilitate the clearance of outstanding bills.
The complainant further alleged that the company refused to pay the money and that Lee’s family had subsequently told its employees that the engineer’s suicide note mentioned Kumar.
However, Sajan admitted that he had never personally seen the note. He has offered to provide information to investigators and arrange access to Lee’s family members if a formal inquiry is undertaken.
The allegations have not been independently verified.
Former MP disputes allegations.
The controversy also involves a separate vigilance inquiry into 76 public works projects allegedly awarded without following the prescribed tender procedure between 2003 and 2006.
Kumar’s name had figured in one of the complaints, but the alleged irregularities could not be established. The vigilance bureau eventually discontinued the proceedings.
In 2012, eight cases were placed before a court as ‘mistakes of fact’. The court accepted the reports, which were not subsequently challenged.
Former Samajwadi Party MP and party national general secretary Veerpal Singh has also been mentioned in the political context surrounding the controversy, though he is not a party to the bribery allegations described in the fresh complaint.
The latest move by the Kerala government has therefore reopened a controversy that had remained dormant for years.
While the state maintains that the fresh complaint deserves examination, the circumstances surrounding its revival have raised questions about whether an old and previously unsubstantiated allegation is being brought back into the political arena at a particularly sensitive time.
The vigilance bureau’s preliminary findings will now determine whether there is sufficient material to justify a full-fledged investigation.
