Saharanpur Court Sentences Two Police Personnel to 20 Years for Gang-Raping Woman in 2015

The 45-year-old survivor secured a conviction after an 11-and-a-half-year legal battle. The court also imposed a fine of Rs 1.20 lakh on each convict in a case involving allegations of sexual assault and intimidation inside a police station.

SAHARANPUR: In a significant verdict delivered after more than 11 years of legal proceedings, a court in Saharanpur has sentenced two police personnel to 20 years’ imprisonment each for gang-raping a woman who had approached the police seeking assistance following her husband’s arrest in 2015.

The convicts, retired Circle Officer Brijmohan Yadav and Inspector Vedpal Singh, were found guilty on Thursday of gang rape and criminal intimidation.

Both were subsequently taken into custody after the court pronounced them guilty. On Friday, the court announced their sentences, bringing a long and arduous legal battle closer to a conclusion for the survivor.

The 45-year-old woman expressed relief after the punishment was announced, saying she had waited 11 and a half years for justice.

She attended the proceedings with her husband and said they wanted to observe the reactions of the convicted officers, but both had concealed their faces.

Recalling her ordeal, the survivor said the accused had behaved as though their official positions placed them beyond accountability.

She expressed hope that their punishment would demonstrate that nobody could escape the consequences of wrongdoing.

The survivor’s husband, who operates a building-materials business, said he had himself faced a criminal case in 2015 after being accused of attempting murder.

He maintained that the allegation was false and pointed out that a court had subsequently acquitted him.

District Government Counsel Sonveer Singh said the court awarded 20 years of imprisonment to each convict and imposed a financial penalty of Rs 1.20 lakh on both.

The prosecution originally named four individuals in the complaint. According to the survivor’s lawyer, Rajeev Tomar, proceedings against Pankaj Dhama, another accused, were separated after he submitted medical documents claiming mental instability.

His case remains pending. The fourth alleged participant, described as an unidentified constable, could not be traced or identified.

Defence lawyer Radhey Shyam said the convicted men would challenge the judgment before a higher court. He also stated that Inspector Vedpal Singh is currently posted in Mathura.

How the case began

According to the prosecution’s account presented through the survivor’s counsel, the events leading to the crime began on the evening of July 29, 2015, when police personnel arrived at the woman’s residence while her family was having dinner.

Her husband was taken away for questioning and was subsequently shown as arrested in a criminal case before being sent to jail.

With her husband in custody and the family’s financial responsibilities resting on him, the woman visited a local police outpost two or three days later.

She was accompanied by her 10-year-old son and appealed to the officer in charge, explaining that her husband was the family’s sole breadwinner and that she needed assistance.

The outpost officer reportedly assured her that he would contact the Station House Officer (SHO) and communicate a response later that day.

According to the lawyer, a constable subsequently arrived at her residence and conveyed that the outpost officer wanted to meet her. She went there accompanied by her mother-in-law and sister-in-law.

However, upon seeing the two women accompanying her, the officer allegedly questioned why she had not come alone. He then informed her that the SHO wanted to speak to her at the main police station.

At approximately 6 pm, the three women reached the police station. The mother-in-law was asked to wait in one area, while the survivor and her sister-in-law were taken elsewhere.

The sister-in-law was made to sit on the verandah, while the woman was escorted into a room where the SHO and three other policemen were allegedly present.

The prosecution alleged that the SHO threatened the woman and demanded sexual favours. When she resisted and attempted to get away, the four men allegedly restrained her and sexually assaulted her inside the room.

Her sister-in-law, alerted by her cries, reportedly rushed to her rescue. However, the prosecution alleged that she too was assaulted and threatened with a revolver.

The accused allegedly warned that she could be killed and her body disposed of if she raised an alarm or disclosed the incident.

Before allowing the two women to leave, the accused allegedly issued further threats.

The survivor was warned that speaking about the assault could result in her husband being implicated in additional criminal cases, potentially keeping him imprisoned for another eight to 10 years.

She was also allegedly threatened with false criminal charges against herself.

A prolonged battle to register an FIR

The survivor initially approached the local police station and subsequently submitted a complaint to the Senior Superintendent of Police (SSP), Saharanpur.

However, according to her lawyer, neither approach resulted in the registration of a criminal case.

She then sought judicial intervention, requesting directions for an FIR to be registered. Her initial application was rejected by the court. A subsequent revision petition before the Sessions Court also failed to provide relief.

The survivor eventually approached the Allahabad High Court.

According to advocate Tomar, the High Court directed the lower court to examine the matter, following which an order was issued for Saharanpur Police to register a case and investigate the allegations.

An FIR naming the four accused was finally registered on November 11, 2017.

The investigation was later handed over to the Crime Branch-Criminal Investigation Department (CB-CID) of the Uttar Pradesh Police. However, the agency submitted a closure report, effectively giving the accused a clean chit.

The survivor refused to accept the findings and challenged the closure report through a protest petition. Her counsel argued that the available material justified summoning the accused and proceeding with a trial.

On October 6, 2018, the court accepted the request to treat the protest petition as a complaint case, allowing the judicial proceedings to move forward.

After years of legal proceedings, the conviction and sentencing of the two police personnel have finally brought a measure of relief to the survivor, whose pursuit of justice began with a visit to a police outpost seeking help for her arrested husband.
