Allahabad High Court Rejects Plea for FIR Against Rahul Gandhi Over Remarks on Sikhs in US

Court says questioning the security and rights of a minority community by an elected representative does not automatically constitute a criminal offence; invokes constitutional protection of free speech.

PRAYAGRAJ: The Allahabad High Court has declined to reopen the legal battle seeking criminal proceedings against Congress leader and Leader of the Opposition in the Lok Sabha, Rahul Gandhi, over his comments about the Sikh community during a visit to the United States in September 2024.

In a significant observation on freedom of expression, Justice Vikram D. Chauhan held that an elected representative is entitled to draw attention to concerns affecting sections of society.

Raising questions about the rights and security of minorities, the court said, cannot by itself be treated as a criminal act.

The judge ruled that Gandhi’s remarks fell within the protection guaranteed under Article 19 of the Constitution, which safeguards freedom of speech and expression.

The court also made it clear that even if some people considered the decision to raise such issues on foreign soil inappropriate or contrary to established parliamentary conventions, that disagreement alone could not provide grounds for criminal prosecution.

The bench further observed that the accuracy of statements made by public representatives should be tested through democratic debate and public scrutiny.

If a statement concerning an individual or a community is found to be incorrect or unsupported, the appropriate response is to challenge it through open discussion rather than automatically resorting to criminal proceedings.

The ruling came on Thursday while disposing of a petition filed by Nageshwar Mishra and another applicant under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which preserves the High Court’s inherent powers.

How the legal dispute began

The controversy originated with an application submitted before the Varanasi MP/MLA court seeking registration of an FIR against Gandhi under Section 173(4) of the BNSS.

The applicants had objected to comments Gandhi made during his September 2024 US visit, when he questioned whether Sikhs in India felt secure wearing turbans or visiting gurdwaras.

They alleged that the remarks could encourage separatist elements and provide material for anti-India propaganda.

In October 2025, the Additional Chief Judicial Magistrate at the Varanasi MP/MLA court rejected the request for an FIR.

The magistrate found that the applicants had expressed fears about the possibility of Khalistani groups exploiting Gandhi’s remarks but had not presented concrete evidence of any resulting incident or criminal activity.

The applicants subsequently challenged that decision before the Varanasi revisional court. The latter directed the magistrate to reconsider the complaint in the light of relevant Supreme Court directions and pass a fresh order.

It also held that prior permission from the Central Government was not necessary for investigating the speech in question, which had been delivered outside India.

Gandhi separately approached the Allahabad High Court against the direction for reconsideration, but his challenge was rejected. The Varanasi magistrate thereafter examined the matter again and once more declined to order registration of an FIR.

The complainants then returned to the High Court, seeking to overturn the magistrate’s fresh decision. Their latest challenge has now been dismissed.

Petitioners alleged support for Khalistan propaganda

In their latest plea, Mishra and his co-applicant argued that Gandhi’s comments had acquired greater significance after Khalistani separatist Gurpatwant Singh Pannun reportedly endorsed them.

They claimed that such an endorsement could strengthen separatist propaganda and potentially encourage violence in India.

The petitioners also alleged that Gandhi’s statements were intended to mobilise people for his political objectives and could damage India’s image internationally.

They compared the alleged consequences of the remarks with the political tensions surrounding speeches delivered at the Bharat Bachao Rally at Delhi’s Ramlila Maidan in December 2019.

The applicants claimed that those speeches contributed to the Shaheen Bagh protests and subsequent communal violence, in which more than 100 people allegedly lost their lives.

They also referred to remarks attributed to Congress leader Salman Khurshid about the possibility of a situation similar to Bangladesh emerging in India, arguing that these statements pointed towards an alleged design to create internal conflict.

The High Court, however, was not persuaded that the allegations and apprehensions presented by the applicants provided a legal basis for ordering criminal proceedings against Gandhi.

The decision reinforces the distinction between political disagreement over a public representative’s statements and conduct that satisfies the legal requirements of a criminal offence.
