The Allahabad High Court has imposed a cost of ₹50,000 on a petitioner for filing successive habeas corpus petitions without disclosing the existence of the earlier proceedings, a development that has also led the court to express regret over the manner in which it had questioned a senior police officer during the hearing.

A Division Bench of Justices Atul Sreedharan and Achal Sachdev dismissed both petitions filed by Omendra Yadav, holding that his conduct amounted to withholding material information from the court.

The judges invoked the legal principles of suppressio veri (concealment of truth) and suggestio falsi (presentation of false information) while explaining why the petitioner was not entitled to judicial relief.

The Bench directed Yadav to pay ₹25,000 against each petition, taking the total penalty to ₹50,000.

The amount must be deposited directly with Bareilly Senior Superintendent of Police Anurag Arya within 30 days. The order provides that failure to comply will result in recovery of the sum as arrears of land revenue.

The dispute originated in Yadav’s allegation that Bareilly police had kept him in illegal custody from May 8 to May 13, 2026, before formally arresting him.

Seeking judicial intervention, he approached the High Court through a habeas corpus petition, a legal remedy used to challenge unlawful detention.

During the proceedings, the court sought CCTV recordings from the police station for the relevant period.

The state government’s counsel informed the Bench that heavy rain and a storm had allegedly caused an electrical short circuit, damaging the station’s digital video recorder (DVR) and destroying the footage.

The explanation prompted the High Court to seek accountability from the district police leadership.

On May 26, the Bench directed SSP Anurag Arya to file an affidavit personally explaining the absence of the recordings, keeping in view the Supreme Court’s directions on CCTV installations and preservation of footage in police stations in the case of Paramvir Singh Saini v. Baljit Singh.

The issue resurfaced during the October 27 hearing, when the judges examined the SSP’s affidavit. They questioned the explanation that a storm between May 13 and May 15 had destroyed recordings relating to an earlier period.

The Bench expressed prima facie concern that the explanation could be misleading and directed the senior police officer to appear before it.

However, proceedings on October 30 brought a significant development to light. The judges discovered that Yadav had submitted another habeas corpus petition on May 26, shortly after the state had responded to his original plea.

The subsequent petition did not disclose that an earlier case involving the same matter was already pending before the court.

According to the Bench, the second application appeared to have been structured to address deficiencies in the first petition, particularly concerning the precise date, location and sequence of events relating to the alleged detention.

By presenting it without revealing the earlier proceedings, the petitioner had failed to disclose information material to the court’s consideration.

The judges concluded that such conduct amounted to an abuse of the judicial process and that a litigant who withholds relevant facts cannot expect discretionary relief from a constitutional court.

They also pointed out that the office of the Additional Government Advocate should have identified and brought the existence of the duplicate petition to the Bench’s attention at the outset.

The discovery also prompted the judges to reconsider their earlier observations against the Bareilly SSP.

The Bench acknowledged that its remarks had placed the officer under unnecessary judicial scrutiny because the court had not been informed of the second petition when it was examining the circumstances surrounding the missing CCTV footage.

In its October 30 order, the court expressed regret for the harshness of its earlier comments, stating that the SSP had been subjected to verbal criticism that was not warranted in the circumstances.

The judges observed that the embarrassment could have been avoided had the duplicate filing been disclosed at the appropriate stage.

The ruling serves as a reminder that parties approaching constitutional courts must disclose all relevant proceedings and present facts accurately.

The court made clear that concealing an earlier case while pursuing another petition on the same controversy can undermine the credibility of a litigant and invite financial penalties.
