Allahabad High Court Sets Six-Month Deadline for Maintenance Recovery Cases Across UP
The Allahabad High Court has directed trial courts throughout Uttar Pradesh to complete proceedings on applications seeking enforcement of maintenance orders within six months.
The court has cautioned that failure to follow the prescribed timeline could invite contempt action for disobedience of directions issued by the Supreme Court as well as the High Court.
Justice Praveen Kumar Giri issued the statewide directive while rejecting a criminal revision petition filed by Data Ram, who had challenged a maintenance order passed by the Principal Judge of the Family Court in Kasganj in September 2024 under Section 125 of the Code of Criminal Procedure (CrPC).
The Family Court had ordered Data Ram to pay his wife a monthly maintenance allowance of Rs 3,000 and Rs 1,000 each to their two minor children until they attain adulthood.
The payments were made effective from April 18, 2022, the date on which the original maintenance application was filed.
In its October 13 order, the High Court declined to excuse a delay of approximately 645 days in filing the revision petition.
It found the explanation offered for the prolonged delay inadequate and dismissed the challenge to the Family Court’s decision.
The court also used the case to reinforce the requirement for timely enforcement of maintenance orders.
It instructed all trial courts in the state to follow the Supreme Court’s ruling in Periyammal (Dead) v. V. Rajamani (2025), along with a circular issued by the Allahabad High Court’s Registrar General on May 24, 2025.
Both require execution applications in maintenance matters to be decided within six months.
In the Periyammal judgment, the Supreme Court had asked High Courts to compile information on pending execution petitions and issue administrative instructions setting a six-month deadline for their disposal.
It further made clear that judicial officers responsible for such cases could be held accountable through administrative channels if the directions were not followed.
The Allahabad High Court’s latest order places renewed emphasis on ensuring that maintenance awards translate into timely financial support for eligible spouses and children.
By directing trial courts across Uttar Pradesh to adhere to the six-month limit, the court has underscored that delays in enforcing maintenance orders must not undermine the relief granted by the courts.
