Bikru Massacre Case: Allahabad High Court Grants Bail to Vikas Dubey’s Former Driver
The Allahabad High Court has granted bail to Ram Singh, who worked as a driver for gangster Vikas Dubey, in connection with the 2020 Bikru massacre in Kanpur district.
The court took into account that other accused facing similar circumstances had already secured bail.
Justice Krishan passed the order on October 13, holding that the applicant had adequately explained his criminal record, apart from one case under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act.
The court noted that he had obtained bail in his other cases and that co-accused convicted under the Gangsters Act had also been released on bail.
In its observations, the court said criminal antecedents alone should not be the sole reason for keeping an accused behind bars when the circumstances otherwise justify bail.
After considering the submissions made by both sides and the material available on record, the judge found that Ram Singh had established a prima facie case for release.
The court clarified that its observations were limited to the bail decision and would not influence the trial.
The case stems from the deadly ambush in Bikru village on the night of July 2, 2020.
A police team had gone to the village to arrest Vikas Dubey when it came under attack.
Eight police personnel, including Deputy Superintendent of Police Devendra Mishra, were killed in the incident.
Dubey was later killed on July 10, 2020, after the police vehicle transporting him from Ujjain to Kanpur met with an accident and he allegedly attempted to escape from custody, according to the police account.
A case against Ram Singh was registered at Chaubepur police station in Kanpur Nagar under provisions relating to murder and attempted murder, among other applicable charges.
The High Court has attached conditions to the bail. Ram Singh must not interfere with evidence or threaten witnesses and is required to appear before the trial court whenever directed.
The order also makes clear that any violation of these conditions could lead to cancellation of bail.
The ruling does not determine the accused’s guilt or innocence. The case will continue before the trial court, where the evidence and charges will be examined on their merits.

कानपुर के चर्चित बिकरू कांड में गैंगस्टर विकास दुबे के पूर्व चालक राम सिंह को इलाहाबाद हाईकोर्ट से राहत मिली है। अदालत ने उसे जमानत देते हुए इस तथ्य पर गौर किया कि समान परिस्थितियों में मुकदमे का सामना कर रहे अन्य सह-आरोपियों को पहले ही जमानत मिल चुकी है।
न्यायमूर्ति कृष्ण ने 13 अक्टूबर को पारित आदेश में कहा कि याचिकाकर्ता ने अपने आपराधिक इतिहास से जुड़े मामलों में पर्याप्त स्पष्टीकरण दिया है। हालांकि, उत्तर प्रदेश गैंगस्टर्स एवं असामाजिक क्रियाकलाप (निवारण) अधिनियम के तहत एक मामले का उल्लेख किया गया।
अदालत ने ध्यान दिलाया कि राम सिंह को अन्य मामलों में जमानत मिल चुकी है और गैंगस्टर्स एक्ट के तहत दोषसिद्धि का सामना कर चुके कुछ सह-आरोपियों को भी जमानत दी जा चुकी है।
हाईकोर्ट ने अपने आदेश में स्पष्ट किया कि यदि किसी आरोपी का मामला जमानत दिए जाने के लिए अन्यथा उपयुक्त है, तो उसे केवल आपराधिक इतिहास के आधार पर हिरासत में बनाए रखना उचित नहीं होगा।
दोनों पक्षों की दलीलों और रिकॉर्ड पर उपलब्ध सामग्री पर विचार करने के बाद अदालत ने प्रथम दृष्टया माना कि राम सिंह ने जमानत पाने का आधार प्रस्तुत किया है। साथ ही, अदालत ने साफ किया कि उसकी टिप्पणियों का मुकदमे के अंतिम निर्णय पर कोई असर नहीं पड़ेगा।
यह मामला 2 जुलाई 2020 की रात बिकरू गांव में हुई उस घटना से जुड़ा है, जिसमें पुलिस टीम पर घात लगाकर हमला किया गया था। पुलिसकर्मी गैंगस्टर विकास दुबे को गिरफ्तार करने के लिए गांव पहुंचे थे। हमले में तत्कालीन पुलिस उपाधीक्षक देवेंद्र मिश्रा समेत आठ पुलिसकर्मियों की मौत हो गई थी।
इसके बाद 10 जुलाई 2020 को विकास दुबे की मौत हो गई थी। पुलिस के अनुसार, उज्जैन से कानपुर लाए जाने के दौरान पुलिस वाहन दुर्घटनाग्रस्त हो गया था और इसी दौरान उसने कथित तौर पर हिरासत से भागने की कोशिश की थी।
राम सिंह के खिलाफ कानपुर नगर के चौबेपुर थाने में हत्या और हत्या के प्रयास सहित संबंधित धाराओं के तहत मुकदमा दर्ज किया गया था।
जमानत देते हुए हाईकोर्ट ने कई शर्तें भी लगाई हैं। राम सिंह को साक्ष्यों से छेड़छाड़ नहीं करनी होगी और न ही गवाहों को डराने या प्रभावित करने की कोशिश करनी होगी।
उसे ट्रायल कोर्ट के निर्देश पर पेश होना भी अनिवार्य होगा। अदालत ने चेतावनी दी है कि किसी भी शर्त का उल्लंघन होने पर जमानत रद्द की जा सकती है।
यह आदेश आरोपी को दोषमुक्त घोषित नहीं करता। मुकदमे की सुनवाई जारी रहेगी और आरोपों का फैसला ट्रायल कोर्ट साक्ष्यों के आधार पर करेगा।
