KPCC Faces Supreme Court Action Over Remarks Against Chief Justice Surya Kant

The court is examining whether Kerala Congress functionaries attracted contempt proceedings over an online post; the Attorney General, R. Venkataramani, was asked to help determine the legal implications.

NEW DELHI: Political criticism of the judiciary has come under renewed legal scrutiny after the Supreme Court stepped into a controversy involving the Kerala Congress and Chief Justice of India Surya Kant.

On Friday, the court issued contempt notices to office-bearers of the Kerala Pradesh Congress Committee (KPCC) over a social media publication concerning the CJI.

The proceedings will examine whether the material circulated by the state Congress unit crossed the legal boundaries governing public criticism of the judiciary.

A bench of Justices Aravind Kumar and Vipul M. Pancholi made it clear that the authority of constitutional institutions could not be diminished through political interventions.

Emphasising the constitutional position of the judiciary, the judges observed that the Constitution remained the ultimate authority in the country.

They indicated that political parties and other organisations could not place themselves beyond the constitutional framework.

The bench also underlined that judicial independence was a fundamental constitutional commitment, not an issue to be viewed through the prism of political disagreements.

It warned that any deliberate attempt to discredit the authority of the courts would invite a firm judicial response.

The court has brought in a senior advocate as an amicus curiae to assist in examining the legal questions arising from the episode.

Attorney General R. Venkataramani has also been asked to provide assistance, particularly on whether the alleged conduct could constitute civil contempt, criminal contempt or both.

The dispute can be traced to a KPCC post concerning remarks made by CJI Surya Kant during proceedings on petitions seeking an inquiry into alleged misconduct by Delhi Police during demonstrations organised by the Cockroach Janta Party (CJP) in the national capital.

The political reaction to the post quickly extended beyond Kerala.

Two prominent bodies representing lawyers practising before the Supreme Court — the Supreme Court Bar Association and the Supreme Court Advocates-on-Record Association — objected to the campaign calling for the Chief Justice to step down.

The KPCC eventually withdrew the post after it attracted widespread criticism.

The party subsequently conveyed an apology and said disciplinary action had been taken against the person who had published the contentious material, including termination of their services.

The matter will now be considered in the context of the legal protection afforded to the judiciary and the limits of public expression concerning its highest constitutional office.

The Supreme Court’s proceedings are expected to clarify the legal position arising from the incident.
