Bareilly: DM Orders Probe into Former Army Soldier’s Land Dispute After 40 Years in Prison

An 84-year-old ex-serviceman claims his ancestral property was gradually taken over during his incarceration; former Samajwadi Party MP Veerpal Singh disputes the allegation, saying the land was sold by the soldier’s father.

BAREILLY: An alleged property dispute involving an elderly former Army soldier, who spent nearly four decades in prison, has prompted the Bareilly administration to order a formal investigation into the ownership and possession of his ancestral land.

District Magistrate Avinash Singh has appointed a six-member team comprising administrative and police officials to examine the complaint filed by 84-year-old Omkar Singh Yadav.

The panel has been directed to complete its investigation and submit its findings within 10 days.

Yadav recently approached the district authorities claiming that a substantial portion of his agricultural land and his ancestral property in Tirkunia village had been occupied by other people during his prolonged absence from home.

According to his account, he originally owned around 5.5 bighas of land, but only about one bigha remains in his possession.

He alleges that his family was unable to protect the property while he was behind bars. His parents, brother and daughter died during that period, leaving nobody to look after his interests.

The former soldier’s account also traces back to a family tragedy that he says changed the course of his life. He claimed that while serving in Roorkee, he received information that his wife had gone missing after allegedly being abducted.

On returning to Bareilly, he was reportedly told by villagers that she had been sexually assaulted and killed. He maintains that her body was never recovered.

Yadav claimed that repeated attempts to obtain justice through the authorities produced no result. He subsequently decided to confront those he suspected of being responsible for his wife’s death, an action that eventually led to his arrest and prosecution.

He said he was taken into custody in 1970 and subsequently convicted in two separate murder cases, one registered in Budaun and another in Bareilly.

According to him, the courts initially awarded him the death penalty in both matters, but the sentences were later reduced to life imprisonment.

The former soldier has also accused former Samajwadi Party MP Veerpal Singh, who belongs to the same village, of influencing the cases against him. He has alleged that the former parliamentarian played a role in his alleged wrongful implication.

Former MP offers a different account of land ownership

Veerpal Singh, who is currently a national general secretary of the Samajwadi Party, has rejected the allegations. He maintains that the land in question had been transferred to residents by Omkar Singh’s father to arrange money for his son’s legal expenses.

According to the former MP, the purchasers paid the agreed amount and took possession of the plots, where residential houses have since been constructed.

He claimed that the absence of formally executed sale deeds was the reason the revenue records continued to reflect Omkar Singh’s name.

Singh also suggested that his political association with the Samajwadi Party was one reason his name had been dragged into the complaint. He denied the allegations levelled against him.

Prison authorities clarify circumstances of release.

The former soldier’s prison record presents a separate timeline regarding his incarceration.

An official at Agra Central Jail, where Yadav was lodged before his release, said he had earlier been granted parole in 1991 but failed to return to custody. He was subsequently apprehended again in 2004.

The official said Yadav was finally released in 2024 following directions issued by a court.

Circle Officer Hemant Upadhyay, who is also a member of the six-person inquiry team, said there was no pending criminal case against Yadav.

He added that the investigation had not yet formally started and that the panel would examine the relevant land records and other documents before reaching any conclusion.

The administration’s inquiry is expected to establish how the disputed property changed hands, whether possession was transferred through a legally recognised transaction and whether the present revenue entries accurately reflect the ownership situation.
