The Allahabad High Court on Wednesday stayed further proceedings in a 2014 criminal case against state government cabinet minister Nand Gopal Nandi.
An FIR was lodged against Nandi alleging that during the election campaign, he along with his supporters attacked a local police station, and 3 policemen were injured in the attack.
Justice Samit Gopal also directed the state government to file its reply in the petition filed by Nandi and one other.
Nandi’s application for discharge was rejected vide order dated July 25, 2024, passed by the trial court against which a revision was preferred which was also rejected vide order dated November 08, 2024 by the concerned revisional court.
Therefore, Nandi filed the present petition.
Advocate Imran Ullah appearing for Applicants submitted that the applicant was falsely implicated in the present case.
The alleged incident took place between two group members during election hours. “
The applicant was campaigning peacefully but was implicated in the matter only because of political vendetta and therefore Impugned proceedings were liable to be quashed.
On the other hand, state government counsel submitted that in the present matter, an application has been filed before the court concerned for permission to apply for withdrawal of the prosecution of the applicants in the present matter.
The court after hearing the parties concerned stayed the further proceedings in the case pending before Special Judicial Magistrate MP/M.
