Allahabad High Court Upholds Murder Convictions of Husband, Parents Despite Hostile Witnesses

Court says a dying declaration cannot be rejected outright merely because family members withdrew support for the prosecution; two co-accused acquitted over failure to establish their identities.

The Allahabad High Court has upheld the life imprisonment sentences awarded to a husband and his parents for the murder of a woman who died from burn injuries, ruling that her dying declaration could not be discarded simply because witnesses cited by the prosecution later refused to support its case.

At the same time, the court set aside the convictions of two other men, Vipin and Madan, holding that the prosecution had not sufficiently established their identities.

Their names appeared in the deceased woman’s statement, but the evidence did not establish that the witnesses could identify them reliably.

The verdict was delivered by a division bench comprising Justice Siddhartha Varma and Justice Jai Krishna Upadhyay while deciding three appeals against a Budaun Sessions Court judgment delivered in November 2018.

The trial court had convicted all five accused under Sections 302 and 149 of the Indian Penal Code, relating to murder and unlawful assembly with a common object, and sentenced them to life imprisonment.

Woman died a day after suffering burns.

According to the prosecution, the woman had been married to Anuj Kumar for approximately three years when the incident occurred on January 4, 2017, at her matrimonial home in Budaun.

The allegation was that kerosene was poured over her before she was set on fire.

Her father reached the house after receiving information that she had sustained burn injuries.

She was subsequently taken to the district hospital, where her dying declaration was recorded at around 4.48 pm that day. She died in the early hours of January 5.

The post-mortem examination attributed her death to shock resulting from extensive burns sustained before death.

The prosecution’s case, however, encountered difficulties during the trial. The deceased’s mother, sister, maternal aunt and brother did not corroborate the allegations and were declared hostile.

Some denied that the alleged assault had taken place, while others maintained that the burns resulted from an accident.

Despite the family members’ testimony, the Sessions Court convicted all five accused, prompting them to challenge the decision before the High Court.

Defence questions reliability of statement

During the appeals, the defence argued that the woman had not been medically fit to give a statement and challenged the reliability of her dying declaration.

The lawyers also drew attention to the absence of any mention of a kerosene smell in the post-mortem report and alleged that certain pages were missing from the hospital’s bed-head ticket.

The state opposed the appeals, relying on the dying declaration and the evidence of the doctor and the tehsildar involved in recording it.

After reviewing the evidence, the High Court, in its October 16 judgment, held that the dying declaration could not be rejected in its entirety merely because the witnesses had turned hostile.

The bench observed that prosecution witnesses may sometimes change their position because of emotional pressure or material inducements.

The court’s reasoning underscored that the withdrawal of support by witnesses does not, by itself, make a dying declaration unworthy of consideration. Its evidentiary value must be assessed in light of the material available before the court.

Two accused get relief over identification doubt.s

The bench treated the cases of Vipin and Madan differently from those of the husband and his parents.

Although the deceased had named the two men in her dying declaration, the prosecution witnesses were not previously acquainted with them.

No test identification parade had been held, and the witnesses were unable to identify them in court.

Finding that their identities had not been established through reliable evidence, the High Court allowed their appeals and quashed their convictions.

The court ordered that Vipin and Madan be released immediately, provided they were not required in connection with any other case. The convictions of Anuj Kumar and his parents were upheld.
