Allahabad High Court Upholds Removal of Hospital from Ayushman Bharat Panel Over ₹9,000 Blood Charge
PRAYAGRAJ: The Allahabad High Court has upheld the decision to remove a private hospital from the list of healthcare facilities authorised to provide treatment under the Ayushman Bharat–Pradhan Mantri Jan Arogya Yojana (AB-PMJAY), citing prima facie deficiencies in the hospital’s compliance with the scheme’s requirements.
The case arose from allegations that the hospital charged ₹9,000 for two units of blood supplied to a two-month-old infant suffering from blood cancer, although the treatment was covered under the government-funded health programme and the blood was allegedly required to be provided free of charge.
A division bench comprising Justice J.J. Munir and Justice Indrajeet Shukla dismissed the hospital’s writ petition challenging the State Empanelment Committee’s order of August 19, 2026.
The committee had withdrawn the hospital’s empanelment under the State Agency for Comprehensive and Integrated Services (SACHIS), which oversees the scheme’s implementation in Uttar Pradesh.
Court says empanelment is a privilege, not an enforceable right
In its judgment dated September 28, the High Court observed that inclusion in the Ayushman Bharat network does not constitute an enforceable legal right for a hospital. Instead, empanelment is a privilege granted by the state, although the government must exercise its authority fairly and without discrimination.
The bench held that the material placed before it indicated serious shortcomings in the hospital’s implementation of the scheme and its adherence to prescribed treatment protocols. On that basis, the judges found no sufficient reason to interfere with the committee’s decision.
The court also clarified that hospitals cannot claim an automatic entitlement to remain on the government’s approved list merely because they have previously been empanelled. Their continued participation depends on compliance with the applicable conditions and standards.
Missing blood transfusion details raised concerns
The hospital had received a show-cause notice on June 18, 2026, before the state committee passed its decision two months later.
According to the order challenged before the High Court, the doctor treating the infant had not entered details of the blood transfusion units in the patient’s Bed Head Ticket (BHT). Such documentation was mandatory for a patient admitted to an intensive care unit, the committee noted.
The High Court acknowledged that the committee’s order did not explain its conclusions in extensive detail. However, it said the limited reasoning in the order did not undermine the substance of the facts emerging from the available record.
The bench also took note of the fact that the doctor who represented the hospital before the state committee had admitted to lapses. The court considered this admission alongside the other material before it while assessing whether the hospital’s removal from the scheme was justified.
Bench flags shortcomings in treatment under the scheme
The judges expressed concern over the alleged conduct of the hospital’s doctors and management in connection with treatment provided under the public health programme.
The court found prima facie material indicating that the hospital had fallen short of the requirements governing the scheme and had failed to observe necessary treatment protocols. It consequently declined to set aside the state committee’s order.
The observations are significant because the Ayushman Bharat scheme is intended to provide eligible beneficiaries with access to specified hospital services without the financial burden that the programme is designed to cover.
Proper documentation and compliance with treatment procedures are essential for monitoring the quality and legitimacy of services delivered under the scheme.
The case also highlights the importance of ensuring that patients and their families are not charged for covered services in violation of the scheme’s applicable rules.
Hospital remains free to practise outside Ayushman Bharat
The High Court made it clear that removal from the SACHIS or Ayushman Bharat panel does not deprive the hospital or its doctors of their right to practise medicine.
The ruling does not prohibit the hospital from continuing its medical operations or treating patients who independently choose to seek its services. It only affects the hospital’s participation in the government’s empanelled healthcare network.
To explain the distinction, the bench drew an analogy with a patient deciding not to consult a particular doctor after losing confidence in that professional. In the same way, the state can decide whether a hospital should continue receiving the benefits and responsibilities associated with participation in its healthcare scheme, subject to lawful and non-discriminatory decision-making.
The judgment therefore draws a distinction between a hospital’s general right to provide medical care and its eligibility to deliver treatment under a publicly funded programme.
Accountability remains central to public healthcare
The ruling reinforces the importance of compliance with the conditions attached to government health schemes. Hospitals participating in Ayushman Bharat are expected to follow prescribed procedures, maintain accurate patient records and provide covered services in accordance with the programme’s requirements.
For patients, particularly families facing the cost and uncertainty of serious illnesses, such safeguards are important to ensure that access to treatment does not depend on their ability to make additional payments for covered services.
The High Court’s decision leaves the state committee’s removal order in place. The central legal finding is that the hospital had no automatic right to continued empanelment and that the material before the court disclosed prima facie deficiencies sufficient to deny the requested judicial intervention.

प्रयागराज: इलाहाबाद हाईकोर्ट ने आयुष्मान भारत–प्रधानमंत्री जन आरोग्य योजना (एबी-पीएमजेएवाई) के तहत सूचीबद्ध एक निजी अस्पताल को सरकारी पैनल से हटाने के फैसले में हस्तक्षेप करने से इनकार कर दिया है।
अदालत ने प्रथमदृष्टया माना कि अस्पताल की ओर से योजना के प्रावधानों का पालन करने और उपचार संबंधी अनिवार्य प्रक्रियाओं को पूरा करने में गंभीर कमियां सामने आई हैं।
यह मामला दो माह के उस बच्चे के इलाज से जुड़ा है, जो ब्लड कैंसर से पीड़ित था। आरोप है कि अस्पताल ने बच्चे को रक्त की दो यूनिट उपलब्ध कराने के लिए ₹9,000 वसूले, जबकि संबंधित उपचार सरकारी स्वास्थ्य योजना के दायरे में था और आरोप के अनुसार रक्त निःशुल्क उपलब्ध कराया जाना चाहिए था।
न्यायमूर्ति जे.जे. मुनीर और न्यायमूर्ति इंद्रजीत शुक्ला की खंडपीठ ने अस्पताल की ओर से दाखिल रिट याचिका खारिज कर दी। याचिका में राज्य एंपैनलमेंट कमेटी के 19 अगस्त, 2026 के आदेश को चुनौती दी गई थी। इस आदेश के जरिए अस्पताल का नाम स्टेट एजेंसी फॉर कॉम्प्रिहेंसिव एंड इंटीग्रेटेड सर्विसेज (साचिस) के पैनल से हटा दिया गया था। उत्तर प्रदेश में यह एजेंसी योजना के क्रियान्वयन से जुड़ी है।
पैनल में शामिल होना अस्पताल का कानूनी अधिकार नहीं
28 सितंबर को दिए गए फैसले में हाईकोर्ट ने स्पष्ट किया कि आयुष्मान भारत योजना के तहत सूचीबद्ध होना किसी अस्पताल का ऐसा कानूनी अधिकार नहीं है, जिसे वह हर परिस्थिति में लागू कराने का दावा कर सके। अदालत के अनुसार, सरकारी पैनल में शामिल किया जाना राज्य की ओर से प्रदान की जाने वाली सुविधा है। हालांकि, इस संबंध में सरकार को निष्पक्षता बरतनी होगी और भेदभावपूर्ण रवैया नहीं अपनाना चाहिए।
पीठ ने कहा कि उपलब्ध अभिलेखों से प्रथमदृष्टया यह संकेत मिलता है कि अस्पताल ने योजना के क्रियान्वयन और निर्धारित उपचार प्रक्रियाओं के पालन में गंभीर कमियां बरतीं। इन परिस्थितियों में अदालत को राज्य एंपैनलमेंट कमेटी के निर्णय में हस्तक्षेप करने का पर्याप्त आधार नहीं मिला।
अदालत की टिप्पणी का आशय यह भी है कि एक बार सरकारी योजना के पैनल में शामिल हो जाने से किसी अस्पताल को उसमें बने रहने का स्थायी अधिकार नहीं मिल जाता। पैनल में बने रहने के लिए संबंधित नियमों, शर्तों और चिकित्सा प्रक्रियाओं का पालन करना आवश्यक है।
रक्त चढ़ाने का विवरण दर्ज नहीं होने पर उठे सवाल
अस्पताल को इस मामले में 18 जून, 2026 को कारण बताओ नोटिस जारी किया गया था। इसके बाद राज्य की एंपैनलमेंट कमेटी ने 19 अगस्त को अस्पताल के खिलाफ कार्रवाई का आदेश दिया।
हाईकोर्ट के समक्ष रखे गए आदेश के अनुसार, बच्चे का इलाज कर रहे डॉक्टर ने मरीज के बेड हेड टिकट (बीएचटी) में रक्त चढ़ाने के लिए इस्तेमाल की गई यूनिटों का विवरण दर्ज नहीं किया था। कमेटी ने कहा था कि गहन चिकित्सा कक्ष (आईसीयू) में भर्ती मरीज के मामले में इस प्रकार का रिकॉर्ड रखना अनिवार्य था।
हाईकोर्ट ने माना कि कमेटी के आदेश में उसके निष्कर्षों को विस्तार से नहीं समझाया गया था। हालांकि, पीठ के अनुसार, आदेश में विस्तृत व्याख्या का अभाव होने से उपलब्ध रिकॉर्ड में सामने आए तथ्यों का महत्व समाप्त नहीं हो जाता।
अदालत ने यह भी ध्यान दिया कि राज्य एंपैनलमेंट कमेटी के समक्ष अस्पताल का पक्ष रखने वाले डॉक्टर ने कुछ कमियों को स्वीकार किया था। पीठ ने इस स्वीकारोक्ति और मामले में उपलब्ध अन्य सामग्री पर विचार करने के बाद अस्पताल की याचिका पर फैसला सुनाया।
इलाज के दौरान निर्धारित प्रक्रियाओं में खामियों पर अदालत की चिंता
पीठ ने योजना के तहत मरीज का उपचार करने के दौरान अस्पताल के डॉक्टरों और प्रबंधन के कथित आचरण पर चिंता जताई।
अदालत के मुताबिक, प्रथमदृष्टया उपलब्ध सामग्री से संकेत मिलता है कि अस्पताल ने योजना के नियमों और आवश्यक उपचार प्रक्रियाओं का पूरी तरह पालन नहीं किया। इसी आधार पर हाईकोर्ट ने अस्पताल को पैनल से हटाने के राज्य समिति के फैसले को निरस्त करने से इनकार कर दिया।
यह मामला इसलिए भी महत्वपूर्ण है क्योंकि आयुष्मान भारत योजना का उद्देश्य पात्र लाभार्थियों को निर्धारित अस्पताल सेवाएं उपलब्ध कराना है, ताकि योजना के दायरे में आने वाले इलाज के लिए उन्हें अनावश्यक आर्थिक बोझ न उठाना पड़े। इसके लिए अस्पतालों को उपचार का सही रिकॉर्ड रखना और निर्धारित प्रक्रियाओं का पालन करना जरूरी है।
मामला इस बात की भी याद दिलाता है कि सरकारी योजना के तहत कवर की गई सेवाओं के लिए मरीजों या उनके परिजनों से नियमों के विरुद्ध अतिरिक्त रकम नहीं ली जानी चाहिए।
पैनल से हटने के बावजूद अस्पताल इलाज जारी रख सकता है
हाईकोर्ट ने यह भी स्पष्ट किया कि साचिस या आयुष्मान भारत योजना के पैनल से हटाए जाने का अर्थ यह नहीं है कि अस्पताल या वहां कार्यरत डॉक्टर चिकित्सा सेवा देने के अपने अधिकार से वंचित हो जाते हैं।
अदालत के आदेश से अस्पताल का सामान्य चिकित्सा कार्य बंद नहीं होता। वह उन मरीजों का इलाज जारी रख सकता है, जो अपनी इच्छा से उसकी सेवाएं लेना चाहते हैं। फैसले का प्रभाव सरकारी स्वास्थ्य योजना के तहत सूचीबद्ध अस्पताल के रूप में उसकी स्थिति पर पड़ता है।
अपनी बात समझाने के लिए पीठ ने मरीज और डॉक्टर के संबंध का उदाहरण दिया। अदालत के अनुसार, यदि कोई मरीज किसी डॉक्टर पर भरोसा खोने के बाद उसकी सेवाएं लेना बंद कर देता है, तो उसी तरह राज्य भी लागू नियमों और निष्पक्ष प्रक्रिया के अधीन यह तय कर सकता है कि कोई अस्पताल सरकारी स्वास्थ्य योजना के पैनल में बना रहने के योग्य है या नहीं।
इस तरह फैसले में अस्पताल के सामान्य रूप से चिकित्सा सेवा देने के अधिकार और सरकारी योजना के तहत उपचार उपलब्ध कराने की पात्रता के बीच अंतर स्पष्ट किया गया है।
सरकारी स्वास्थ्य योजनाओं में जवाबदेही जरूरी
हाईकोर्ट के इस फैसले से यह संदेश मिलता है कि सरकारी स्वास्थ्य योजनाओं से जुड़े अस्पतालों को निर्धारित शर्तों का सख्ती से पालन करना चाहिए। मरीजों का सही रिकॉर्ड रखना, उपचार संबंधी प्रक्रियाएं पूरी करना और योजना के नियमों के अनुरूप सेवाएं उपलब्ध कराना उनकी जिम्मेदारी है।
गंभीर बीमारियों से जूझ रहे मरीजों और उनके परिवारों के लिए ऐसी व्यवस्था विशेष रूप से महत्वपूर्ण है। इलाज के दौरान आर्थिक कठिनाइयों से गुजर रहे परिवारों को योजना के तहत उपलब्ध सुविधाओं के लिए नियमों के विपरीत अतिरिक्त भुगतान करने की स्थिति में नहीं आना चाहिए।
हाईकोर्ट के फैसले के बाद राज्य एंपैनलमेंट कमेटी का अस्पताल को पैनल से हटाने का आदेश बरकरार रहेगा। अदालत का प्रमुख निष्कर्ष यह है कि सरकारी पैनल में बने रहना अस्पताल का स्वतः प्राप्त अधिकार नहीं है और उपलब्ध सामग्री में प्रथमदृष्टया ऐसी कमियां दिखाई दीं, जिनके आधार पर न्यायिक हस्तक्षेप उचित नहीं था।
