Allahabad High Court: Woman Deceived Into Void Marriage Entitled to Maintenance, Husband Cannot Benefit From Concealing First Marriage

In a significant ruling aimed at protecting women from matrimonial fraud, the Allahabad High Court has held that a woman who unknowingly marries a man already having a legally subsisting marriage cannot be denied maintenance merely because the marriage is void in law.

The Court observed that a husband who conceals his first marriage cannot later rely on that illegality to escape his financial responsibility under Section 125 of the Code of Criminal Procedure (CrPC).

Delivering the judgment, Justice Garima Prashad ruled that the law cannot permit a person to take advantage of his own wrongdoing.

The Court said that where a woman enters into a marriage without knowledge of her husband’s existing marriage, she remains entitled to claim maintenance despite the marriage being legally invalid.

With these observations, the High Court dismissed a criminal revision petition filed by husband Manoj Kumar alias Bablu challenging the Family Court’s order granting maintenance to his wife.

At the same time, the Court partly allowed the revision petition filed by the wife, Monika alias Satyawati, seeking enhancement of the maintenance awarded in her favour.

Monika had approached the High Court contending that the monthly maintenance of ₹6,000 fixed by the Family Court, Mathura, was grossly inadequate.

She argued that her husband was employed in government service and was earning nearly ₹50,000 every month, making the amount insufficient for her sustenance.

The husband, however, questioned the very maintainability of the proceedings under Section 125 CrPC.

He maintained that since the marriage itself was void under law, the woman could not claim maintenance.

According to him, his first marriage had not been legally dissolved when the second marriage allegedly took place.

The case revealed that the parties underwent marriage ceremonies on December 12, 2016, whereas the husband’s earlier marriage, solemnised on February 29, 2008, came to an end only after a decree of divorce by mutual consent was granted on November 15, 2017.

Thus, on the date of the second marriage, his first marriage was admittedly still in existence.

After examining oral testimony and documentary evidence, the Family Court concluded that the marriage between the parties had indeed been performed according to Hindu customs and rituals.

It rejected the husband’s claim that the marriage had been performed forcibly at gunpoint.

The court further held that he had deliberately concealed his existing marriage from the woman, who had entered the matrimonial relationship believing him to be legally eligible to marry.

Although the Family Court acknowledged that the marriage could not be treated as legally valid because of the subsistence of the husband’s first marriage, it nevertheless granted maintenance by relying on settled legal principles laid down by the Supreme Court to protect women deceived into such marriages.

Affirming those findings, Justice Prashad rejected the husband’s argument that a void marriage automatically disentitles a woman from claiming maintenance.

Referring to the Supreme Court judgments in Badshah v. Sou Urmila Badshah Godse (2013) and Kamala and Others v. M.R. Mohan Kumar (2018), the High Court reiterated that a man who fraudulently suppresses the fact of his earlier marriage cannot later avoid his legal obligation towards a woman whom he induced into marriage through deception.

The Court further observed in its July 16 judgment that Section 125 CrPC must receive a liberal and purposive interpretation to fulfil its objective of preventing exploitation, destitution and social injustice.

It held that the evidence clearly established that the husband had concealed his subsisting marriage and that the woman had entered the relationship without any knowledge of that fact.

Finding no legal infirmity in the Family Court’s conclusions, the High Court upheld the wife’s entitlement to maintenance while directing enhancement of the amount, thereby reaffirming that the protective purpose of Section 125 CrPC cannot be defeated by a husband’s own fraudulent conduct.

वैवाहिक धोखाधड़ी से पीड़ित महिलाओं के अधिकारों की रक्षा करते हुए इलाहाबाद हाईकोर्ट ने महत्वपूर्ण फैसला सुनाया है कि यदि किसी महिला को पति की पहली शादी की जानकारी छिपाकर विवाह के लिए राजी किया गया हो, तो केवल इस आधार पर उसे भरण-पोषण से वंचित नहीं किया जा सकता कि वह विवाह कानून की दृष्टि में शून्य (वॉइड) है।

अदालत ने स्पष्ट किया कि अपनी ही धोखाधड़ी का लाभ उठाकर कोई पति कानूनी जिम्मेदारी से बच नहीं सकता।

न्यायमूर्ति गरिमा प्रसाद ने कहा कि जिस महिला ने पति की पूर्ववर्ती वैध शादी की जानकारी के बिना वैवाहिक संबंध स्वीकार किया हो, उसे दंड प्रक्रिया संहिता (सीआरपीसी) की धारा 125 के तहत भरण-पोषण पाने का अधिकार है।

अदालत ने कहा कि कानून ऐसे व्यक्ति को संरक्षण नहीं दे सकता जिसने स्वयं तथ्य छिपाकर दूसरे पक्ष को गुमराह किया हो।

इन्हीं टिप्पणियों के साथ हाईकोर्ट ने पति मनोज कुमार उर्फ बबलू द्वारा दायर आपराधिक पुनरीक्षण याचिका खारिज कर दी, जिसमें उसने परिवार न्यायालय द्वारा दिए गए भरण-पोषण के आदेश को चुनौती दी थी।

वहीं पत्नी श्रीमती मोनिका उर्फ सत्यवती की ओर से भरण-पोषण राशि बढ़ाने की मांग वाली पुनरीक्षण याचिका को आंशिक रूप से स्वीकार कर लिया गया।

पत्नी का कहना था कि मथुरा परिवार न्यायालय द्वारा निर्धारित ₹6,000 प्रतिमाह की राशि उसके जीवन-निर्वाह के लिए पर्याप्त नहीं है।

उसने अदालत को बताया कि उसका पति सरकारी कर्मचारी है और लगभग ₹50,000 मासिक वेतन प्राप्त करता है, इसलिए उसे अधिक भरण-पोषण मिलना चाहिए।

दूसरी ओर, पति ने दलील दी कि धारा 125 सीआरपीसी के तहत दायर आवेदन ही सुनवाई योग्य नहीं है क्योंकि दोनों के बीच हुआ विवाह कानूनन वैध नहीं था।

उसका तर्क था कि कथित दूसरे विवाह के समय उसकी पहली शादी अभी समाप्त नहीं हुई थी।

रिकॉर्ड के अनुसार, दोनों का विवाह 12 दिसंबर 2016 को हुआ था, जबकि पति की पहली शादी, जो 29 फरवरी 2008 को संपन्न हुई थी, आपसी सहमति से तलाक की डिक्री मिलने के बाद 15 नवंबर 2017 को समाप्त हुई।

अर्थात दूसरे विवाह की तिथि पर पहली शादी पूरी तरह प्रभावी थी।

मौखिक और दस्तावेजी साक्ष्यों का परीक्षण करने के बाद परिवार न्यायालय ने पाया कि दोनों के बीच हिंदू रीति-रिवाजों के अनुसार विधिवत विवाह संस्कार सम्पन्न हुए थे।

अदालत ने पति के उस दावे को भी खारिज कर दिया कि बंदूक की नोक पर जबरन विवाह कराया गया था।

न्यायालय ने यह भी माना कि पति ने अपनी पहली शादी की जानकारी जानबूझकर छिपाई थी और महिला इस तथ्य से पूरी तरह अनभिज्ञ थी।

परिवार न्यायालय ने यह स्वीकार किया कि पहली शादी के अस्तित्व के कारण दूसरा विवाह विधिक रूप से वैध नहीं माना जा सकता।

इसके बावजूद सर्वोच्च न्यायालय द्वारा स्थापित सिद्धांतों का अनुसरण करते हुए उसने महिला को भरण-पोषण का अधिकार प्रदान किया।

हाईकोर्ट ने भी इस निष्कर्ष को सही ठहराते हुए कहा कि केवल विवाह के शून्य होने से महिला का भरण-पोषण पाने का अधिकार समाप्त नहीं हो जाता। न्यायालय ने बादशाह बनाम सौ. उर्मिला बादशाह गोडसे (2013) तथा कमला एवं अन्य बनाम एम.आर. मोहन कुमार (2018) के निर्णयों का उल्लेख करते हुए कहा कि यदि कोई पुरुष अपनी पहली शादी छिपाकर किसी महिला को विवाह के लिए प्रेरित करता है, तो वह बाद में उसी तथ्य का सहारा लेकर अपनी जिम्मेदारी से मुक्ति नहीं पा सकता।

16 जुलाई के अपने निर्णय में न्यायमूर्ति गरिमा प्रसाद ने कहा कि धारा 125 सीआरपीसी की व्याख्या उसके सामाजिक उद्देश्य को ध्यान में रखकर की जानी चाहिए ताकि महिलाओं को शोषण, परित्याग और आर्थिक असुरक्षा से बचाया जा सके।

अदालत ने माना कि उपलब्ध साक्ष्य स्पष्ट रूप से दर्शाते हैं कि पति ने अपनी पहली शादी का तथ्य धोखे से छिपाया था और पत्नी को इसकी कोई जानकारी नहीं थी।

इन परिस्थितियों में हाईकोर्ट ने परिवार न्यायालय के निष्कर्षों को पूरी तरह सही माना। अदालत ने महिला के भरण-पोषण के अधिकार को बरकरार रखते हुए राशि बढ़ाने का निर्देश दिया और दोहराया कि कोई भी व्यक्ति अपनी ही कपटपूर्ण हरकत का लाभ उठाकर कानून के संरक्षण का दावा नहीं कर सकता।
