Supreme Court Signals Independent Probe Into Police Action During NEET Protests, Considers National Crowd-Control Protocol

The spotlight has shifted from the turmoil witnessed on the streets during the nationwide student protests over the alleged NEET paper leak to the manner in which law enforcement agencies handled the demonstrations, with the Supreme Court indicating that the allegations against the police deserve independent scrutiny.

Days after protests organised by the Cockroach Janta Party (CJP) brought parts of the national capital to a standstill and triggered demonstrations across several states, the country’s highest court has suggested that a transparent inquiry may be necessary to ascertain whether excessive force was employed against protesters.

Serious questions over the conduct of security personnel surfaced before a Bench headed by Chief Justice of India Surya Kant during the hearing of multiple petitions challenging the police response to student demonstrations against examination irregularities.

The petitions alleged that protesters were subjected to harsh crowd-control measures, including baton charges, tear gas shelling, pellet guns, electric shock devices and physical assaults by members of the police force.

Although the Bench refrained from expressing any final opinion on the veracity of these allegations, it observed that the material placed before it disclosed sufficient grounds to warrant an impartial investigation.

According to the court, the accusations, if established, raise issues that go beyond individual incidents and concern the larger question of how democratic protests should be policed in India.

To ensure credibility and public confidence, the Bench indicated that the inquiry could be entrusted either to a Special Investigation Team (SIT) or to a high-powered independent committee.

The judges emphasised that the exercise should not merely determine whether any officer exceeded the limits of lawful force, but should also recommend institutional reforms capable of preventing similar controversies in the future.

The court underlined that India now requires a clearly defined national framework regulating police conduct during public demonstrations.

In the absence of uniform standards, it observed, determining accountability often becomes difficult whenever confrontations between protesters and security forces escalate into violence.

Chief Justice Surya Kant remarked that once such a nationwide protocol is framed, responsibility for any excesses would become easier to establish irrespective of whether the violations were committed by members of the police force or by protesters.

The rule of law, the Bench observed, must apply equally to every individual involved in such situations.

Drawing attention to allegations that women, lawyers and journalists were also assaulted during the police action, the court questioned why an independent inquiry should not be constituted immediately.

It observed that the allegations, viewed prima facie, justified a fair, transparent and credible investigation by an agency independent of those whose conduct has been questioned.

The Bench also reiterated that peaceful protest remains one of the essential pillars of a democratic society.

Public demonstrations, it observed, cannot automatically be viewed only through the prism of law and order.

Instead, authorities must strike a careful balance between maintaining public peace and protecting citizens’ constitutional right to express dissent.

Recognising that policing challenges continue to evolve, the court said any national protocol governing crowd management must remain dynamic rather than rigid.

Future modifications, it observed, would be necessary to accommodate changing circumstances, technological advancements and emerging methods of public mobilisation.

At the same time, the judges clarified that the proposed investigation should not become a one-sided exercise.

Allegations relating to attacks on police personnel must receive equal attention, and investigators should determine whether such incidents involved genuine student protesters or anti-social elements who had infiltrated the demonstrations, as claimed by the Union government.

According to PTI, Chief Justice Surya Kant observed that the allegations before the court prima facie called for an independent probe while also recognising the concerns of families of more than 200 police personnel reported to have sustained injuries during the unrest.

The Bench stressed that a clearly articulated operating procedure would not only assist investigators in establishing responsibility for the recent incidents but would also provide law enforcement agencies with an objective framework governing future protest management across the country.

A series of interim directions accompanied the court’s observations.

Notices were issued to several state governments, including Maharashtra and Madhya Pradesh, directing them to file their responses regarding allegations of excessive police action during the demonstrations.

Relief was also granted to minors who had participated in the protests. The Supreme Court directed all states to release student protesters below eighteen years of age, provided they had no criminal antecedents.

The judges observed that young demonstrators with clean records should not remain in custody merely because they participated in public protests.

Interim protection was simultaneously extended to eligible students against coercive measures.

However, the Bench made it clear that this safeguard would not cover individuals having previous criminal records or those facing serious criminal allegations unrelated to the protests.

Proceedings arising from FIRs already registered in Delhi will continue in accordance with law.

Even so, the court directed that no coercive action should be taken against students protected by its interim order while those investigations remain pending.

Preservation of evidence also received considerable attention during the hearing.

The Supreme Court ordered authorities to secure all available CCTV recordings, drone footage, body-worn camera videos, wireless communication logs and PCR call records relating to the protests so that no material evidence is destroyed before the inquiry reaches its conclusions.

The Bench further directed investigating agencies to preserve all digital information collected from protesters while simultaneously restraining them from disclosing any personal details until further orders.

According to the court, the need to protect privacy must accompany every investigative exercise.

Ironically, the chain of events that culminated in the emergence of the Cockroach Janta Party, nationwide student mobilisation and the resignation of Union Education Minister Dharmendra Pradhan appears to have originated from remarks made by Chief Justice Surya Kant himself during proceedings before the Supreme Court earlier this year.

While hearing another matter on May 15, the Chief Justice compared certain unruly elements to “cockroaches”, cautioning that if such behaviour was not curbed in time it would multiply and create much larger problems.

The observation rapidly gained traction on social media and unexpectedly became the catalyst for a nationwide campaign.

Within a day, Boston University graduate Abhijeet Dipke launched an online platform under the banner of the Cockroach Janta Party (CJP).

What initially began as a symbolic digital campaign quickly evolved into an organised movement demanding accountability over alleged examination irregularities, particularly the NEET paper leak.

As support grew, student organisations, youth groups and civil society activists joined the campaign, transforming it into one of the largest student movements witnessed in recent years.

Demonstrations spread across multiple states, intensifying pressure on the Union government and keeping the issue at the centre of national political discourse.

The sustained agitation eventually culminated in the resignation of Union Education Minister Dharmendra Pradhan on July 25, marking a significant political fallout from a movement that had begun as an online campaign triggered by a courtroom remark.

With the Supreme Court now considering an independent inquiry alongside the possibility of formulating a nationwide protocol governing police response to public demonstrations, the controversy has entered an entirely new phase.

The outcome is expected to shape not only the investigation into the recent protests but also the legal standards governing crowd-control measures, police accountability and the constitutional right to peaceful protest for years to come.

नीट आंदोलन में पुलिस कार्रवाई पर सुप्रीम कोर्ट गंभीर, स्वतंत्र जांच के संकेत; देशभर के लिए एक समान पुलिस प्रोटोकॉल बनाने पर विचा

नीट पेपर लीक और परीक्षा प्रणाली में कथित गड़बड़ियों को लेकर देशभर में हुए छात्र आंदोलनों के दौरान पुलिस की भूमिका अब सर्वोच्च न्यायालय की निगरानी में आ गई है।

राजधानी दिल्ली समेत विभिन्न राज्यों में प्रदर्शनकारियों पर बल प्रयोग के आरोपों पर सुनवाई करते हुए सुप्रीम कोर्ट ने मंगलवार को संकेत दिया कि पूरे घटनाक्रम की निष्पक्ष और स्वतंत्र जांच कराए जाने की आवश्यकता हो सकती है।

अदालत ने यह भी कहा कि भविष्य में इस प्रकार की परिस्थितियों से निपटने के लिए देशभर में विरोध-प्रदर्शनों के दौरान पुलिस कार्रवाई का एक समान राष्ट्रीय प्रोटोकॉल तैयार किया जाना चाहिए।

20 जुलाई को ‘कॉकरोच जनता पार्टी’ (सीजेपी) के नेतृत्व में आयोजित प्रदर्शन के बाद राष्ट्रीय राजधानी के कई हिस्सों में सामान्य जनजीवन प्रभावित हुआ था और इसकी गूंज देश के अनेक राज्यों तक पहुंची।

अब अदालत के समक्ष मुख्य प्रश्न यह है कि आंदोलन के दौरान कानून-व्यवस्था बनाए रखने के नाम पर कहीं पुलिस ने अपनी वैधानिक सीमाओं का उल्लंघन तो नहीं किया।

मुख्य न्यायाधीश न्यायमूर्ति सूर्यकांत की अध्यक्षता वाली पीठ उन याचिकाओं पर सुनवाई कर रही थी जिनमें आरोप लगाया गया है कि नीट पेपर लीक और अन्य परीक्षा अनियमितताओं के विरोध में प्रदर्शन कर रहे छात्रों के खिलाफ जरूरत से ज्यादा बल का इस्तेमाल किया गया।

याचिकाओं में दावा किया गया कि कई स्थानों पर प्रदर्शनकारियों पर लाठीचार्ज किया गया, आंसू गैस के गोले छोड़े गए, पेलेट गन के इस्तेमाल के आरोप सामने आए, इलेक्ट्रिक शॉक उपकरणों का प्रयोग किया गया तथा पुलिसकर्मियों द्वारा मारपीट भी की गई।

हालांकि सर्वोच्च न्यायालय ने इन आरोपों की सत्यता पर कोई अंतिम टिप्पणी करने से इनकार किया, लेकिन उसने स्पष्ट किया कि प्रथम दृष्टया उपलब्ध सामग्री निष्पक्ष, पारदर्शी और स्वतंत्र जांच की मांग करती है।

अदालत का मानना था कि यदि आरोप सही पाए जाते हैं तो यह केवल कुछ घटनाओं तक सीमित मामला नहीं रहेगा, बल्कि लोकतांत्रिक विरोध-प्रदर्शनों से निपटने की पूरी व्यवस्था पर गंभीर प्रश्न खड़े करेगा।

पीठ ने संकेत दिया कि जांच किसी विशेष जांच दल (एसआईटी) अथवा उच्चस्तरीय स्वतंत्र समिति को सौंपी जा सकती है। न्यायालय ने कहा कि इस प्रक्रिया का उद्देश्य केवल दोष तय करना नहीं होना चाहिए, बल्कि ऐसी संस्थागत व्यवस्था विकसित करना भी आवश्यक है जिससे भविष्य में इसी प्रकार के विवादों की पुनरावृत्ति रोकी जा सके।

सुनवाई के दौरान मुख्य न्यायाधीश सूर्यकांत ने कहा कि अब समय आ गया है जब पूरे देश के लिए पुलिस कार्रवाई से संबंधित स्पष्ट दिशा-निर्देश तैयार किए जाएं।

यदि विरोध-प्रदर्शनों के दौरान पुलिस के अधिकारों और सीमाओं का एक समान ढांचा तैयार होगा तो भविष्य में किसी भी घटना में जिम्मेदारी तय करना कहीं अधिक सरल हो जाएगा।

अदालत ने यह भी स्पष्ट किया कि जवाबदेही किसी एक पक्ष तक सीमित नहीं हो सकती। यदि जांच में पुलिस द्वारा अत्यधिक बल प्रयोग सामने आता है तो संबंधित अधिकारियों के खिलाफ कार्रवाई होगी, वहीं यदि प्रदर्शनकारियों की ओर से हिंसा या कानून तोड़ने की पुष्टि होती है तो उनके विरुद्ध भी समान रूप से कानूनी कार्रवाई की जाएगी।

महिलाओं, अधिवक्ताओं और मीडिया प्रतिनिधियों के साथ कथित दुर्व्यवहार का उल्लेख करते हुए पीठ ने सवाल उठाया कि ऐसी परिस्थितियों में स्वतंत्र जांच का आदेश देने में संकोच क्यों होना चाहिए।

न्यायालय ने कहा कि जनता का विश्वास तभी कायम रहेगा जब पूरे घटनाक्रम की जांच किसी निष्पक्ष एजेंसी के माध्यम से कराई जाएगी।

लोकतांत्रिक व्यवस्था में विरोध-प्रदर्शन को नागरिक अधिकारों का अभिन्न हिस्सा बताते हुए सुप्रीम कोर्ट ने कहा कि प्रशासन का उद्देश्य केवल भीड़ को नियंत्रित करना नहीं होना चाहिए।

कानून-व्यवस्था बनाए रखने और नागरिकों के संवैधानिक अधिकारों की रक्षा के बीच संतुलन स्थापित करना भी उतना ही आवश्यक है।

पीठ ने यह भी माना कि समय के साथ पुलिस व्यवस्था के सामने नई चुनौतियां आती रहती हैं। इसलिए यदि राष्ट्रीय स्तर पर कोई प्रोटोकॉल तैयार किया जाता है तो उसमें परिस्थितियों के अनुरूप संशोधन की गुंजाइश भी बनी रहनी चाहिए ताकि बदलते समय के साथ उसकी उपयोगिता बनी रहे।

साथ ही अदालत ने यह भी स्पष्ट किया कि प्रस्तावित जांच केवल पुलिस पर लगे आरोपों तक सीमित नहीं होगी। आंदोलन के दौरान घायल हुए पुलिसकर्मियों की घटनाओं की भी समान गंभीरता से जांच की जाएगी।

यह भी पता लगाया जाएगा कि पुलिस पर हमला वास्तव में छात्र प्रदर्शनकारियों ने किया था या फिर ऐसे असामाजिक तत्वों ने जो आंदोलन की आड़ लेकर भीड़ में शामिल हो गए थे, जैसा कि केंद्र सरकार का दावा है।

पीटीआई के अनुसार मुख्य न्यायाधीश सूर्यकांत ने कहा कि प्रथम दृष्टया लगाए गए आरोप स्वतंत्र जांच की मांग करते हैं। उन्होंने यह भी कहा कि आंदोलन के दौरान घायल हुए 200 से अधिक पुलिसकर्मियों के परिवारों की चिंताओं को भी जांच प्रक्रिया में समान महत्व दिया जाना चाहिए।

सुनवाई के दौरान सर्वोच्च न्यायालय ने कई अंतरिम निर्देश भी जारी किए ताकि जांच प्रक्रिया निष्पक्ष बनी रहे और आंदोलन में शामिल छात्रों के अधिकारों का संरक्षण सुनिश्चित किया जा सके।

अदालत ने महाराष्ट्र, मध्य प्रदेश सहित कई राज्यों को नोटिस जारी करते हुए पुलिस कार्रवाई से जुड़े आरोपों पर विस्तृत जवाब मांगा।

न्यायालय ने नाबालिग प्रदर्शनकारियों को तत्काल राहत देते हुए सभी राज्य सरकारों को निर्देश दिया कि जिन छात्रों की आयु 18 वर्ष से कम है और जिनके विरुद्ध किसी प्रकार का आपराधिक इतिहास नहीं है, उन्हें शीघ्र रिहा किया जाए।

अदालत ने माना कि केवल विरोध-प्रदर्शन में भाग लेने के आधार पर ऐसे छात्रों को हिरासत में रखना न्यायसंगत नहीं कहा जा सकता।

इसके साथ ही पीठ ने स्पष्ट किया कि जिन छात्र प्रदर्शनकारियों का कोई आपराधिक रिकॉर्ड नहीं है, उनके विरुद्ध फिलहाल कोई दमनात्मक या जबरन कार्रवाई नहीं की जाएगी।

हालांकि अदालत ने यह भी साफ कर दिया कि यह अंतरिम राहत उन व्यक्तियों पर लागू नहीं होगी जिनके विरुद्ध पहले से आपराधिक मामले दर्ज हैं या जिनका आपराधिक इतिहास रहा है।

दिल्ली में आंदोलन के दौरान दर्ज एफआईआर के संबंध में सर्वोच्च न्यायालय ने संतुलित रुख अपनाया। अदालत ने दिल्ली सरकार को पहले से दर्ज मामलों की जांच जारी रखने की अनुमति दी, लेकिन साथ ही निर्देश दिया कि जिन प्रदर्शनकारियों को अदालत ने अंतरिम संरक्षण प्रदान किया है, उनके विरुद्ध जांच पूरी होने तक कोई कठोर या दंडात्मक कार्रवाई न की जाए।

महत्वपूर्ण साक्ष्यों को सुरक्षित रखने पर विशेष जोर देते हुए पीठ ने सभी संबंधित एजेंसियों को निर्देश दिया कि आंदोलन से जुड़ा कोई भी इलेक्ट्रॉनिक रिकॉर्ड नष्ट न किया जाए।

अदालत ने सीसीटीवी फुटेज, ड्रोन कैमरों की रिकॉर्डिंग, बॉडी-वॉर्न कैमरों के वीडियो, वायरलेस संचार रिकॉर्ड तथा पीसीआर कॉल लॉग को सुरक्षित रखने का आदेश दिया ताकि भविष्य में होने वाली किसी भी जांच के दौरान तथ्यात्मक सामग्री उपलब्ध रह सके।

प्रदर्शनकारियों से एकत्रित डिजिटल डाटा के संबंध में भी अदालत ने स्पष्ट निर्देश जारी किए। न्यायालय ने कहा कि जांच के उद्देश्य से इस डाटा को सुरक्षित रखा जाए, लेकिन अगली सुनवाई तक किसी भी प्रदर्शनकारी की व्यक्तिगत जानकारी सार्वजनिक नहीं की जाएगी।

अदालत ने कहा कि जांच की निष्पक्षता और नागरिकों की निजता—दोनों का समान रूप से संरक्षण किया जाना आवश्यक है।

पूरे घटनाक्रम का सबसे उल्लेखनीय पहलू यह है कि जिस आंदोलन ने आगे चलकर देशव्यापी स्वरूप ग्रहण किया और अंततः तत्कालीन केंद्रीय शिक्षा मंत्री धर्मेंद्र प्रधान के इस्तीफे तक का मार्ग प्रशस्त किया, उसकी शुरुआती कड़ी स्वयं सर्वोच्च न्यायालय में की गई एक टिप्पणी से जुड़ी मानी जा रही है।

15 मई को एक अन्य मामले की सुनवाई के दौरान मुख्य न्यायाधीश सूर्यकांत ने कुछ उपद्रवी तत्वों की तुलना “कॉकरोच” से करते हुए टिप्पणी की थी कि यदि ऐसे लोगों पर समय रहते अंकुश नहीं लगाया गया तो उनकी संख्या बढ़ेगी और वे भविष्य में बड़ी समस्या बन जाएंगे।

अदालत की यह टिप्पणी कुछ ही समय में सोशल मीडिया पर व्यापक रूप से वायरल हो गई और अप्रत्याशित रूप से एक नए जन अभियान का आधार बन गई।

अगले ही दिन बोस्टन यूनिवर्सिटी से शिक्षित अभिजीत डिपके ने ‘कॉकरोच जनता पार्टी’ (सीजेपी) नाम से एक ऑनलाइन मंच की शुरुआत की।

प्रारंभ में इसे केवल एक डिजिटल मुहिम के रूप में देखा गया, लेकिन देखते ही देखते यह अभियान परीक्षा प्रणाली में कथित भ्रष्टाचार और अनियमितताओं के खिलाफ राष्ट्रीय आंदोलन का रूप लेने लगा। विशेष रूप से नीट पेपर लीक का मुद्दा इस अभियान का सबसे बड़ा केंद्र बन गया।

समय के साथ छात्र संगठनों, युवाओं और विभिन्न सामाजिक समूहों का समर्थन इस आंदोलन को मिलता गया। विरोध-प्रदर्शन अनेक राज्यों तक फैल गए और परीक्षा प्रणाली में पारदर्शिता तथा जवाबदेही की मांग लगातार तेज होती चली गई।

बढ़ते जनदबाव और राजनीतिक विवाद के बीच केंद्र सरकार पर भी दबाव बढ़ा और अंततः 25 जुलाई को केंद्रीय शिक्षा मंत्री धर्मेंद्र प्रधान ने अपने पद से इस्तीफा दे दिया।

अब पूरे घटनाक्रम की दिशा काफी हद तक सर्वोच्च न्यायालय के अगले निर्णय पर निर्भर करेगी। यदि अदालत स्वतंत्र जांच के लिए विशेष जांच दल (एसआईटी) या उच्चस्तरीय समिति का गठन करती है, तो जांच केवल हालिया पुलिस कार्रवाई तक सीमित नहीं रहेगी।

इसके माध्यम से सार्वजनिक विरोध-प्रदर्शनों के दौरान पुलिस की भूमिका, बल प्रयोग की सीमाएं, जवाबदेही तय करने की प्रक्रिया तथा नागरिकों के संवैधानिक अधिकारों की सुरक्षा से जुड़े व्यापक मानदंड भी विकसित किए जा सकते हैं।

कानूनी विशेषज्ञों का मानना है कि यह मामला केवल नीट आंदोलन या कथित पुलिस ज्यादती तक सीमित नहीं रहेगा।

इससे भविष्य में देशभर में होने वाले आंदोलनों के दौरान पुलिस की कार्यप्रणाली, भीड़ नियंत्रण के तौर-तरीकों और लोकतांत्रिक विरोध के अधिकार की संवैधानिक सीमाओं को लेकर एक महत्वपूर्ण न्यायिक मिसाल स्थापित हो सकती है।

यदि सर्वोच्च न्यायालय राष्ट्रीय स्तर पर एक समान प्रोटोकॉल तैयार करने की दिशा में आगे बढ़ता है, तो उसका प्रभाव आने वाले वर्षों में देश के प्रत्येक बड़े सार्वजनिक आंदोलन और पुलिस कार्रवाई पर दिखाई दे सकता है।
