BCI Rolls Back NALSAR Bar Enrolment Ban After Six-Hour Standoff, Internal Dissent Emerges

The Bar Council of India withdrew its directive barring NALSAR’s 2026 graduates from enrolling with state Bar councils after internal objections and the university raised constitutional concerns.

New Delhi: The Bar Council of India’s decision to prevent the 2026 graduating batch of NALSAR University of Law, Hyderabad, from enrolling with state Bar councils triggered a sharp internal backlash before the directive was withdrawn within hours.

The order, issued on Thursday evening by BCI chairman and Senior Advocate Manan Kumar Mishra, also called for an inquiry into a student campaign at NALSAR opposing the invitation of Chief Justice of India Surya Kant to the university’s convocation.

The directive was issued at around 6.30 pm and underwent two reversals before being completely withdrawn roughly six hours later, according to the account of events provided by BCI office bearers.

The episode exposed significant disagreement within the BCI leadership. At least four of its 19 office bearers raised objections soon after the directive was circulated.

Three opposed the move outright, while another sought modifications to the order.

Among those who objected were BCI Executive Committee Vice-Chairman Manoj Kumar N, BCI Co-Chairman and Senior Advocate Y R Sadasiva Reddy, and BCI member A Rami Reddy. Co-Chairman Ved Prakash Sharma did not reject the directive outright but called for changes to it.

Several BCI office bearers told the media that Mishra had decided without first consulting the council’s other office bearers.

According to them, the directive was issued on BCI letterhead and subsequently placed in the council’s WhatsApp group for approval.

Kumar said he was taken aback by the manner in which the decision was circulated, maintaining that it had been taken by Mishra independently before being presented to the other members.

Two office bearers said 10 of the BCI’s 19 office bearers subsequently approved the directive in the WhatsApp group.

However, the opposition from senior members highlighted the lack of unanimity within the council over the action against the NALSAR graduates.

The university itself did not immediately accept the directive. NALSAR Vice-Chancellor declined to implement it straight away, reportedly questioning whether such an action could withstand constitutional scrutiny.

The dispute stemmed from a campaign by some NALSAR students earlier in the week concerning the proposed invitation of Chief Justice Surya Kant to the institution’s convocation.

Mishra’s original directive not only sought to block enrolment of the 2026 batch with state Bar councils but also asked the Vice-Chancellor to investigate who had initiated the student campaign.

The rapid withdrawal of the directive brought the confrontation to an end within the same evening, but the episode has raised questions about the decision-making process within the BCI and the authority exercised by its office bearers in matters affecting law graduates.

For the NALSAR students set to graduate in 2026, the withdrawal removed the immediate threat to their enrolment with state Bar councils, while the wider dispute over the student campaign and the proposed convocation invitation remained at the centre of the controversy.

नई दिल्ली: बार काउंसिल ऑफ इंडिया (BCI) ने NALSAR यूनिवर्सिटी ऑफ लॉ, हैदराबाद के 2026 में स्नातक होने वाले छात्रों को राज्य बार काउंसिलों में नामांकन से रोकने का अपना निर्देश कुछ ही घंटों में वापस ले लिया।

इस फैसले को लेकर BCI के भीतर भी तीखी असहमति सामने आई, जबकि विश्वविद्यालय ने आदेश को तत्काल लागू करने से इनकार करते हुए उसकी संवैधानिक वैधता पर सवाल उठाया।

BCI के चेयरमैन और वरिष्ठ अधिवक्ता मनन कुमार मिश्रा ने गुरुवार शाम करीब 6.30 बजे यह निर्देश जारी किया था।

इसमें NALSAR के 2026 बैच के छात्रों को राज्य बार काउंसिलों में नामांकन से रोकने के अलावा विश्वविद्यालय के कुलपति को एक जांच कराने के लिए भी कहा गया था।

यह जांच उस छात्र अभियान को लेकर थी, जो इसी सप्ताह NALSAR के कुछ छात्रों की ओर से भारत के मुख्य न्यायाधीश सूर्यकांत को विश्वविद्यालय के दीक्षांत समारोह में आमंत्रित किए जाने के विरोध में चलाया गया था।

निर्देश में यह पता लगाने को कहा गया था कि इस अभियान की शुरुआत किसने की थी।

हालांकि, आदेश जारी होने के तुरंत बाद BCI के भीतर इसका विरोध शुरू हो गया। परिषद के 19 पदाधिकारियों में से कम से कम चार ने इस पर आपत्ति जताई।

इनमें तीन ने आदेश का स्पष्ट रूप से विरोध किया, जबकि चौथे पदाधिकारी ने इसमें संशोधन की मांग की।

आपत्ति जताने वालों में BCI की कार्यकारी समिति के उपाध्यक्ष मनोज कुमार एन, सह-अध्यक्ष और वरिष्ठ अधिवक्ता वाई. आर. सदाशिव रेड्डी तथा BCI सदस्य ए. रामी रेड्डी शामिल थे।

सह-अध्यक्ष वेद प्रकाश शर्मा ने आदेश को सीधे खारिज नहीं किया, लेकिन उसमें बदलाव की आवश्यकता बताई।

BCI के कई पदाधिकारियों ने द इंडियन एक्सप्रेस को बताया कि यह फैसला अन्य पदाधिकारियों से पूर्व परामर्श किए बिना लिया गया था।

उनके अनुसार, आदेश पहले BCI के आधिकारिक लेटरहेड पर जारी किया गया और उसके बाद परिषद के व्हाट्सऐप समूह में सदस्यों की मंजूरी के लिए डाला गया।

BCI के कार्यकारी समिति के उपाध्यक्ष मनोज कुमार एन ने इस प्रक्रिया पर हैरानी जताई। उनके मुताबिक, आदेश जारी किए जाने के बाद उसे व्हाट्सऐप समूह में अनुमोदन के लिए रखा गया।

दो पदाधिकारियों के अनुसार, BCI के 19 में से 10 पदाधिकारियों ने बाद में व्हाट्सऐप समूह में आदेश को मंजूरी दी।

हालांकि, वरिष्ठ पदाधिकारियों के विरोध से यह स्पष्ट हो गया कि NALSAR के खिलाफ कार्रवाई को लेकर परिषद के भीतर पूर्ण सहमति नहीं थी।

दूसरी ओर, NALSAR के कुलपति ने निर्देश को तत्काल लागू करने से इनकार कर दिया। उन्होंने कथित तौर पर इस कदम को संभावित रूप से “असंवैधानिक” बताते हुए उसकी वैधता पर सवाल उठाया।

करीब छह घंटे के भीतर घटनाक्रम तेजी से बदला और आदेश को पूरी तरह वापस ले लिया गया। इस तरह NALSAR के 2026 बैच के छात्रों के सामने राज्य बार काउंसिलों में नामांकन को लेकर पैदा हुआ तत्काल संकट टल गया।

हालांकि, इस पूरे घटनाक्रम ने BCI में फैसले लेने की प्रक्रिया, उसके पदाधिकारियों के बीच समन्वय और कानून के छात्रों के पेशेवर नामांकन से जुड़े मामलों में परिषद की कार्यप्रणाली को लेकर बहस छेड़ दी है।

NALSAR में छात्र अभियान और मुख्य न्यायाधीश को दीक्षांत समारोह में आमंत्रित किए जाने का मुद्दा भी इस विवाद की पृष्ठभूमि में बना हुआ है।
