CPI (M) MP John Brittas Seeks Presidential Intervention Over Alleged Police Assault During Delhi Protest Crackdown

The CPI(M) Rajya Sabha MP has written to the President, Vice President and Chief Justice of India, demanding an independent inquiry, accountability for police officials and scrutiny of possible breaches of parliamentary privilege.

NEW DELHI: A demand for an independent investigation into alleged police misconduct has escalated into a wider debate over the treatment of elected representatives and the right to peaceful protest, with CPI(M) Rajya Sabha MP John Brittas seeking intervention from the country’s highest constitutional authorities.

In separate representations to President Droupadi Murmu, Vice President and Chief Justice of India, Brittas called for urgent action over what he described as an assault by police personnel during the recent protest-related detentions in Delhi.

He also raised the question of parliamentary privilege and sought accountability for officials involved in the operation.

The MP alleged that police personnel manhandled him, dragged him and assaulted him inside a police vehicle. He claimed that the treatment continued even after he identified himself as a member of Parliament.

According to Brittas, the episode took a further turn when a senior police official, identified in his account as the concerned Deputy Commissioner of Police, ordered his release after finding the detention unlawful.

He alleged that he was subsequently left by the roadside. He has demanded an independent inquiry into the entire incident, including the conduct of senior officers.

In his appeal to the President, Brittas argued that the incident raised serious concerns about the rule of law, the protection of democratic dissent and the responsibility of police officials exercising public authority.

He urged the President to obtain a detailed report from both the Union and Delhi governments and ensure that the allegations are investigated impartially.

MP links allegations to protection of peaceful protest

Brittas also drew attention to the timing of the alleged assault, saying it occurred within hours of Supreme Court directions concerning the protection of peaceful protesters and constitutional rights.

He referred to directions that, according to his account, addressed concerns including unlawful detention, uninterrupted internet access and the normal functioning of railway and metro services.

He argued that the alleged police action was particularly troubling in that context.

In a public statement on X, the MP said the issue went beyond his personal treatment and touched on democratic freedoms and the rule of law.

He maintained that governments should respond to dissent through debate rather than coercion and warned against using police force to discourage citizens from exercising their constitutional rights.

The letters also refer to a broader sequence of events over the preceding two days, including the alleged detention of several political leaders. Brittas has asked the President to intervene and ensure that the actions of the authorities are examined comprehensively.

The allegations made by the MP have not, on the information available here, been independently established.

An impartial investigation would be needed to determine the circumstances of his detention, the conduct of the personnel involved and whether any legal or parliamentary protections were violated.

The matter places renewed focus on the balance between policing public demonstrations and upholding the constitutional right to peaceful dissent.

Brittas has called for institutional scrutiny, arguing that the credibility of law enforcement depends on accountability when allegations of excessive force are raised.
