New Delhi: A defamation dispute involving BJP national spokesperson and senior advocate Gaurav Bhatia took a conciliatory turn in the Delhi High Court on Thursday after two leaders of the Cockroach Janta Party (CJP), Ashutosh Ranka and Saurav Das, agreed to remove the social media posts challenged by Bhatia within 24 hours.
The development came during the hearing of Bhatia’s Rs 2 crore defamation suit, in which he has sought monetary damages as well as the removal of what he has described as defamatory material.
Justice Tushar Rao Gedela orally suggested that the respondents voluntarily take down the disputed posts rather than have the court issue a formal direction.
The judge, however, also questioned why the matter had reached the court without an earlier attempt at resolving the disagreement directly.
Justice Gedela observed that the parties could have communicated with each other before initiating litigation.
Bhatia maintained that the matter involved what he termed “aggravated defamation”.
The court subsequently asked the counsel representing the two CJP members to ascertain whether they were prepared to remove the posts themselves.
During the hearing, Justice Gedela urged the young CJP leaders to exercise greater care while expressing political disagreement.
He said criticism and protest could take different forms, but allegations should not be made without proper verification.
The judge also emphasised that strong views could be communicated in a clearer and more measured manner.
The court’s observations went beyond the immediate takedown issue, with Justice Gedela telling the respondents that spending prolonged periods in litigation could distract them from their studies and other pursuits.
He indicated that political concerns and anxieties could be expressed, but the manner of communication should be carefully considered.
The bench also raised a question concerning the inclusion of CJP leader Abhijeet Dipke as a defendant.
Justice Gedela observed that the posts cited by Bhatia did not appear to contain material specifically directed against Dipke and questioned the basis for making him a party to the proceedings.
The judge also told Bhatia that he was not representing the entire political organisation merely by bringing the case.
Justice Gedela noted that the defendants had apparently not initially been provided a copy of the plaint.
Bhatia responded that he had shared copies of the suit on X because he was unable to independently confirm the residential addresses of the CJP leaders named as defendants.
One of the matters at the centre of the dispute concerns a video reposted by Dipke.
Bhatia objected to the circulation of the clip, which he said had been presented as showing the CEO of the Ram Mandir Trust holding or dancing with a glass containing liquid. Bhatia has asserted that the video was fake.
The dispute had also spilled onto social media before Thursday’s hearing.
On September 8, Bhatia posted a screenshot of a page from his suit on X showing the parties named in the proceedings, including the three CJP leaders and the organisation.
In a separate post featuring an image of the suit’s index, Bhatia wrote: “When allegations cross the line, the law draws the line.”
With Ranka and Das agreeing to remove the disputed material within 24 hours, the immediate focus of Thursday’s proceedings shifted towards voluntary resolution.
The court’s final handling of the defamation claims and Bhatia’s demand for damages remains to be seen.

नई दिल्ली: भाजपा के राष्ट्रीय प्रवक्ता और वरिष्ठ अधिवक्ता गौरव भाटिया की ओर से दायर मानहानि मामले में गुरुवार को दिल्ली हाईकोर्ट में अहम घटनाक्रम सामने आया।
Cockroach जनता पार्टी (CJP) के नेता आशुतोष रांका और सौरव दास ने अदालत के समक्ष संकेत दिया कि वे भाटिया द्वारा आपत्तिजनक बताए गए सोशल मीडिया पोस्ट को 24 घंटे के भीतर हटा देंगे।
मामले की सुनवाई न्यायमूर्ति तुषार राव गेडेला कर रहे थे। भाटिया ने कथित मानहानिकारक पोस्ट के खिलाफ 2 करोड़ रुपये की क्षतिपूर्ति और संबंधित सामग्री हटाने की मांग करते हुए मुकदमा दायर किया है।
सुनवाई के दौरान न्यायमूर्ति गेडेला ने सुझाव दिया कि यदि दोनों नेता स्वयं पोस्ट हटाने को तैयार हैं तो अदालत को अलग से हटाने का आदेश जारी करने की आवश्यकता नहीं होनी चाहिए।
अदालत ने हालांकि यह भी सवाल उठाया कि मुकदमा दायर करने से पहले दोनों पक्षों के बीच सीधे बातचीत क्यों नहीं की गई।
न्यायमूर्ति गेडेला ने भाटिया से कहा कि अदालत आने से पहले संबंधित लोगों से संपर्क कर मामले को दूसरे तरीके से सुलझाने की कोशिश की जा सकती थी।
भाटिया की ओर से मामले को “aggravated defamation” यानी गंभीर प्रकृति की मानहानि बताया गया।
इसके बाद अदालत ने CJP नेताओं के वकील से यह पता करने को कहा कि क्या उनके मुवक्किल विवादित पोस्ट अपनी ओर से हटाने के लिए तैयार हैं।
सुनवाई के दौरान न्यायमूर्ति गेडेला ने राजनीतिक विरोध और सार्वजनिक अभिव्यक्ति के तरीके पर भी टिप्पणी की। उन्होंने कहा कि विरोध करने के अलग-अलग तरीके हो सकते हैं, लेकिन किसी व्यक्ति या संस्था के बारे में बात करते समय तथ्यों की पुष्टि किए बिना आरोप लगाना उचित नहीं है।
उन्होंने युवा नेताओं को अपनी बात अधिक स्पष्ट, संयमित और प्रभावी तरीके से रखने की सलाह भी दी।
न्यायमूर्ति गेडेला ने यह भी कहा कि युवाओं के सामने आगे बढ़ने के लिए लंबा समय है और उन्हें लगातार अदालतों के चक्कर लगाने के बजाय अपने अध्ययन और अन्य प्राथमिकताओं पर ध्यान देना चाहिए।
अदालत की टिप्पणी का आशय यह था कि असहमति या चिंता व्यक्त करना लोकतांत्रिक प्रक्रिया का हिस्सा हो सकता है, लेकिन उसके लिए भाषा और अभिव्यक्ति का तरीका जिम्मेदार होना चाहिए।
सुनवाई में CJP नेता अभिजीत दिपके को मामले में पक्षकार बनाए जाने पर भी अदालत ने सवाल उठाया।
न्यायमूर्ति गेडेला ने कहा कि जिन पोस्ट को लेकर भाटिया ने आपत्ति जताई है, उनमें दिपके के खिलाफ ऐसा कुछ दिखाई नहीं देता, जिसके आधार पर उन्हें मुकदमे में पक्षकार बनाया गया हो।
अदालत ने भाटिया से यह भी कहा कि वह पूरे राजनीतिक दल की ओर से ध्वजवाहक के रूप में इस मामले को नहीं ला रहे हैं।
न्यायमूर्ति गेडेला ने यह टिप्पणी भी की कि संबंधित प्रतिवादियों को मुकदमे की प्रति उपलब्ध कराए जाने का मुद्दा स्पष्ट नहीं था।
इस पर भाटिया ने बताया कि उन्होंने मुकदमे की प्रतियां X पर साझा की थीं। उनका कहना था कि वह CJP नेताओं के आवासीय पते की स्वतंत्र रूप से पुष्टि नहीं कर सके थे और इसी कारण सोशल मीडिया के जरिए उन्हें दस्तावेज उपलब्ध कराए गए।
विवाद का एक हिस्सा उस वीडियो से भी जुड़ा है जिसे अभिजीत दिपके ने दोबारा पोस्ट किया था। भाटिया ने इस वीडियो पर आपत्ति जताई है।
उनके अनुसार, क्लिप में जिस व्यक्ति को राम मंदिर ट्रस्ट के सीईओ के रूप में दर्शाया गया था, वह वास्तव में वैसा नहीं था और वीडियो फर्जी था।
मामले को लेकर भाटिया ने अदालत की सुनवाई से पहले सोशल मीडिया पर भी अपनी स्थिति रखी थी।
8 सितंबर को उन्होंने X पर अपने मुकदमे के एक पृष्ठ का स्क्रीनशॉट साझा किया था, जिसमें तीन CJP नेताओं और संगठन समेत मामले में शामिल पक्षों की जानकारी थी।
एक अन्य पोस्ट में उन्होंने मुकदमे के इंडेक्स का स्क्रीनशॉट साझा करते हुए लिखा था— “When allegations cross the line, the law draws the line.” इसके जरिए उन्होंने संकेत दिया कि उनके अनुसार सार्वजनिक आरोप एक सीमा पार कर चुके हैं और अब मामला कानूनी दायरे में पहुंच गया है।
गुरुवार की सुनवाई में रांका और दास की 24 घंटे के भीतर पोस्ट हटाने की सहमति से फिलहाल विवाद को आपसी समाधान की दिशा में ले जाने की संभावना बनी है।
हालांकि, भाटिया की 2 करोड़ रुपये की क्षतिपूर्ति मांग और मानहानि के अन्य दावों पर अदालत की आगे की कार्यवाही अभी महत्वपूर्ण रहेगी।
