Ghaziabad Cemetery Dispute: Allahabad High Court Explains Limits of Religious Freedom

Court dismisses Christian society’s plea for a designated burial site, saying the allocation of local-body land must be decided by authorities in view of local needs and public interest.

PRAYAGRAJ: A dispute over a proposed Christian burial ground in Ghaziabad has led the Allahabad High Court to clarify that religious freedom does not, by itself, give a community the right to secure a particular piece of land for a cemetery.

The ruling came in a petition filed by the Christian Community Welfare Society after the district administration declined to set aside a vacant plot in Modinagar for Christian burials.

A bench comprising Justice J.J. Munir and Justice Indrajeet Shukla dismissed the plea in a judgment dated October 12.

At the centre of the case was a 0.3420-hectare parcel in Visokhar village, within Modinagar tehsil of Ghaziabad district. The revenue records described the land as usar, or barren land.

The society argued that Christian families in the surrounding area were facing increasing difficulty in arranging burials because the cemetery at Begamabad Budana was running short of space.

The organisation sought to establish that the proposal had previously received local-level support.

It cited Resolution No. 11, adopted by the Modi Nagar Nagar Palika Parishad board on January 22, 2018, which proposed assigning the plot for a Christian cemetery.

Although the resolution was sent to the district authorities, the land was never formally designated for that purpose.

The society subsequently pursued the matter through representations to officials and applications under the Right to Information Act, 2005.

It had also filed a public interest litigation seeking permission for the Christian community to use the land as a burial ground.

After the High Court issued directions in those proceedings, the Additional District Magistrate (Administration), Ghaziabad, rejected the request in January under Section 77(2) of the Uttar Pradesh Revenue Code, 2006.

Challenging that decision, the society maintained that the absence of suitable burial space placed an unreasonable burden on its members’ ability to observe religious practices, including the performance of last rites.

The petitioner, registered under the Societies Registration Act, 1860, was represented through its president, Vinay Kumar Paul. Helping Christians conduct their final rites is among the organisation’s stated objectives.

The district administration, however, maintained that the plot was recorded as barren land and had not historically been used as a cemetery by any community.

According to a report by the Sub-Divisional Magistrate, some residents and other local groups had also raised concerns that allotting the land for a Christian burial ground might create communal tensions.

Officials further noted that a Christian cemetery was already functioning nearby.

In examining the dispute, the High Court drew a distinction between the freedom to practise religion and the right to demand that a specific parcel of land be converted for a particular purpose.

The bench said changing land under a Gaon Sabha or local body into a public-use site, such as a graveyard, involves an administrative decision that must take account of relevant circumstances and competing public needs.

The court held that there is no enforceable legal entitlement to compel the conversion of a particular plot that has not already been designated for public utility.

It added, however, that where a genuine shortage of burial space exists, authorities may consider a request after assessing the broader public interest and the different needs of people living in the area.

The judgment therefore leaves decisions on the proposed use of such land to the competent authorities, rather than treating a community’s religious needs as an automatic entitlement to a particular site.
