Government Introduces Bill to Increase Supreme Court Judges’ Strength to 38 Including CJI
New Delhi: The Central government on Monday tabled the Supreme Court (Number of Judges) Amendment Bill, 2026, in the Lok Sabha, proposing an increase in the sanctioned strength of judges in the country’s highest court from 33 to 37, excluding the Chief Justice of India (CJI).
Once enacted, the total strength of the apex court, including the CJI, will rise to 38 judges.
Presenting the Bill on the opening day of Parliament’s Monsoon Session, Union Law Minister Arjun Ram Meghwal said the legislation seeks to replace the ordinance promulgated by the Centre in May.
He told the House that the proposed increase in judicial strength would enable the Supreme Court to function more effectively and facilitate quicker disposal of pending cases.
The minister said the move was prompted by the growing burden of litigation before the apex court.
Alongside the introduction of the Bill, the Lok Sabha also admitted a statutory resolution moved by Opposition members opposing the ordinance.
Such a resolution is a procedural right available to the Opposition whenever the government brings legislation to replace an ordinance issued earlier.
The proposal draws its authority from Article 124 of the Constitution, which empowers Parliament to determine the sanctioned strength of judges in the Supreme Court.
Unlike High Courts, where the President can revise the number of judges through an executive order, any increase or reduction in the strength of the Supreme Court requires parliamentary approval through legislation.
The Supreme Court (Number of Judges) Act, 1956, had originally fixed the strength of the apex court at 10 judges, excluding the Chief Justice of India.
Over the decades, Parliament has amended the law several times—in 1960, 1977, 1986, 2008, 2019 and now 2026—to meet the expanding judicial workload.
If the latest amendment is passed, the total sanctioned strength, including the CJI, will increase from the original 11 to 38 judges.
Appointments to the Supreme Court continue to be made through the Collegium system, under which the Chief Justice of India, in consultation with the senior-most judges, recommends names to the Union Law Ministry.
The recommendations are subsequently forwarded to the Prime Minister before being sent to the President for formal appointment.
However, several legal experts believe that increasing the number of judges alone may not substantially reduce the mounting pendency of cases.
They point to the 18th Law Commission’s 229th Report, which recommended the establishment of a permanent Constitution Bench in Delhi along with regional benches across the country instead of relying solely on expanding judicial strength.
The report also observed that delays in judicial appointments, rather than the sanctioned number of judges, have historically been a major reason behind vacancies and the accumulation of pending cases.

नई दिल्ली: केंद्र सरकार ने सोमवार को लोकसभा में सुप्रीम कोर्ट (न्यायाधीशों की संख्या) संशोधन विधेयक, 2026 पेश किया।
इस विधेयक के माध्यम से देश की सर्वोच्च अदालत में मुख्य न्यायाधीश (सीजेआई) को छोड़कर न्यायाधीशों की स्वीकृत संख्या 33 से बढ़ाकर 37 करने का प्रस्ताव रखा गया है। विधेयक के कानून बनने के बाद सीजेआई सहित सुप्रीम कोर्ट के न्यायाधीशों की कुल संख्या 38 हो जाएगी।
संसद के मानसून सत्र के पहले दिन केंद्रीय कानून मंत्री अर्जुन राम मेघवाल ने यह विधेयक सदन में प्रस्तुत करते हुए कहा कि इसका उद्देश्य मई में जारी किए गए अध्यादेश का स्थान लेना है।
उन्होंने कहा कि न्यायाधीशों की संख्या बढ़ने से सर्वोच्च न्यायालय की कार्यक्षमता में सुधार होगा और लंबित मामलों के निस्तारण में तेजी आएगी। उनके अनुसार, अदालत में लगातार बढ़ रहे मुकदमों के बोझ को देखते हुए यह कदम आवश्यक हो गया था।
विधेयक पेश किए जाने के साथ ही लोकसभा ने उस अध्यादेश के विरोध में विपक्ष द्वारा लाया गया वैधानिक प्रस्ताव भी स्वीकार कर लिया। संसदीय परंपरा के तहत जब भी कोई अध्यादेश विधेयक के रूप में सदन में लाया जाता है, तब विपक्ष को उसके विरोध में ऐसा प्रस्ताव प्रस्तुत करने का अधिकार होता है।
संविधान के अनुच्छेद 124 के अनुसार, सुप्रीम कोर्ट में न्यायाधीशों की स्वीकृत संख्या निर्धारित करने का अधिकार केवल संसद को प्राप्त है।
उच्च न्यायालयों के विपरीत, जहां राष्ट्रपति कार्यपालिका के आदेश से न्यायाधीशों की संख्या में बदलाव कर सकते हैं, वहीं सर्वोच्च न्यायालय की स्वीकृत संख्या में किसी भी प्रकार का परिवर्तन केवल संसद द्वारा कानून पारित किए जाने के बाद ही संभव है।
सुप्रीम कोर्ट (न्यायाधीशों की संख्या) अधिनियम, 1956 के तहत प्रारंभ में मुख्य न्यायाधीश को छोड़कर केवल 10 न्यायाधीशों का प्रावधान किया गया था। इसके बाद बढ़ते न्यायिक कार्यभार को देखते हुए इस कानून में 1960, 1977, 1986, 2008, 2019 और अब 2026 में संशोधन किए गए।
नया विधेयक पारित होने पर मुख्य न्यायाधीश सहित न्यायाधीशों की कुल स्वीकृत संख्या प्रारंभिक 11 से बढ़कर 38 हो जाएगी।
सुप्रीम कोर्ट के न्यायाधीशों की नियुक्ति वर्तमान में कॉलेजियम प्रणाली के माध्यम से की जाती है। इस व्यवस्था के तहत भारत के मुख्य न्यायाधीश वरिष्ठतम न्यायाधीशों से परामर्श कर नामों की अनुशंसा केंद्रीय कानून मंत्रालय को भेजते हैं।
इसके बाद प्रस्ताव प्रधानमंत्री के माध्यम से राष्ट्रपति के पास अंतिम नियुक्ति के लिए भेजा जाता है।
हालांकि, अनेक विधि विशेषज्ञों का मानना है कि केवल न्यायाधीशों की संख्या बढ़ा देने से लंबित मामलों की समस्या पूरी तरह समाप्त नहीं होगी।
उनका कहना है कि 18वें विधि आयोग की 229वीं रिपोर्ट में केवल संख्या बढ़ाने के बजाय दिल्ली में एक स्थायी संविधान पीठ स्थापित करने तथा देश के विभिन्न क्षेत्रों में क्षेत्रीय पीठों के गठन की सिफारिश की गई थी।
रिपोर्ट में यह भी कहा गया था कि न्यायाधीशों की नियुक्ति में होने वाली देरी, स्वीकृत पदों की संख्या से अधिक, रिक्तियों और लंबित मामलों की प्रमुख वजह रही है।
