Supreme Court Takes Up Row Over Election Commission’s SIR Orders, Seeks Clarity on Decision Process
New Delhi: The process through which the Election Commission of India approved its Special Intensive Revision (SIR) programme has become a central issue before the Supreme Court, which has indicated that it will examine the competing claims made by the poll panel and those challenging its actions.
The dispute is not confined to the decision to revise electoral rolls. It also concerns whether the Commission followed a unanimous decision-making process and whether changes connected with voter registration were accurately described.
A bench headed by Chief Justice of India Surya Kant, with Justices Joymalya Bagchi and V. Mohana, has listed the case for November 17.
The petitioners have been given time to respond to the Commission’s affidavit, in which it maintains that the relevant decisions were approved unanimously.
During the hearing, the Chief Justice indicated that the court would consider the issues raised before it rather than limit its examination to the Commission’s explanation.
Opposition leaders seek protection of crucial documents
Senior advocate A. M. Singhvi, representing Lok Sabha Leader of Opposition Rahul Gandhi and INDIA bloc leaders, asked the court to ensure that the Election Commission retains its internal file notings and communications relating to the SIR orders.
The request is significant because the documents could shed light on the discussions that preceded the decisions.
The petitioners want the record to establish whether all three members agreed to the orders and how the Commission reached its conclusions.
Singhvi argued that the legality of the decisions could not be assessed adequately without examining the process followed within the institution.
The request therefore places the Commission’s internal deliberations under scrutiny, although the allegations remain matters for judicial examination.
TMC MP’s counsel questions explanation on Form 6
A separate point of contention concerns Form 6, which eligible applicants use to seek inclusion in the electoral rolls.
Senior advocate Menaka Guruswamy, appearing for Trinamool Congress MP Dola Sen, challenged the Commission’s account of the changes associated with the form.
She alleged that the form had been tampered with and objected to a press release that she said gave the impression that the Supreme Court had endorsed the changes.
Representing the Election Commission, senior advocate Maninder Singh rejected the argument, describing it as rhetoric.
The Commission’s affidavit draws a distinction between the prescribed Form 6 and an additional declaration attached to it.
According to the poll panel, the claim that the form itself was amended through the SIR orders is misleading. It says the modification was confined to the additional declaration, where a mapping requirement was introduced.
The court will have to consider the rival submissions in the context of the applicable electoral registration rules and the orders under challenge.
Three election commissioners defend the orders
Chief Election Commissioner Gyanesh Kumar and Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi have jointly told the Supreme Court that the decisions to schedule SIR across states and Union Territories were taken with the agreement of all three members.
Their affidavit identifies three orders, issued on June 24, 2025, October 27, 2025, and May 14, 2026.
The Commission says the decisions were made under Article 324 of the Constitution and Section 18 of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023.
The affidavit also states that its filing was approved unanimously by the Chief Election Commissioner and the two Election Commissioners.
The submission was made in response to a petition filed by social activist Rakesh Kumar Singh.
Court to consider rival claims in next hearing
The next stage of the proceedings will allow the petitioners to address the Commission’s defence and clarify which aspects of the affidavit they dispute.
At issue are the Commission’s internal approval process, the preservation of documents relevant to that process and the nature of the changes made to the additional declaration accompanying Form 6.
The Election Commission has maintained that its orders were unanimous and that the prescribed voter registration form was not amended in the manner alleged.
The petitioners, meanwhile, are seeking scrutiny of the records and the decision-making process.
The Supreme Court is scheduled to take up the matter again on November 17. The allegations and counterarguments have yet to be finally determined by the court.
