Adopted Son of Widow Can Inherit Deceased Husband’s Property, Allahabad High Court Holds

Court upholds inheritance claim in long-running Prayagraj property dispute, relying on legal precedents recognising the adopted child as heir of the deceased husband.
Prayagraj: A son adopted by a widow after her husband’s death can inherit the deceased man’s share in ancestral property, the Allahabad High Court has held, reaffirming a legal principle that treats such an adopted child as the son of the deceased husband for succession purposes.
Justice Chandra Kumar Rai delivered the ruling while dealing with a decades-old property dispute arising from consolidation proceedings in Prayagraj.
The court rejected a challenge filed by Ram Kripal, bringing fresh judicial attention to the inheritance rights attached to an adoption made by a widow.
The dispute centred on Ramji, who claimed that Moti Rani had legally adopted him through an adoption deed executed on August 2, 1960. Moti Rani was the widow of Murlidhar, who had died without children.
Following Murlidhar’s death, his interest in the ancestral property had passed to his widow. The subsequent adoption became the basis of Ramji’s claim to the property that had originally belonged to Murlidhar.
Dispute continued for decades
The litigation had its roots in consolidation proceedings and continued for several decades before reaching the High Court.
Ram Kripal challenged the revenue authorities’ decision recognising Ramji’s status as the adopted son of Moti Rani and Murlidhar and his entitlement to the deceased man’s share.
The High Court ultimately found no legal infirmity in the consolidation authorities’ conclusion that Ramji was entitled to succeed in that capacity.
The ruling is significant because the court did not treat the adoption merely as creating a relationship between Moti Rani and Ramji. It applied the established legal position that, for the relevant inheritance question, a child adopted by a widow is regarded as belonging to the family of her deceased husband as well.
Court relies on earlier legal precedents
In reaching its conclusion, the High Court referred to the Supreme Court’s decision in Sawan Ram v. Mst. Kalawanti and also considered the Allahabad High Court’s earlier ruling in Subhash Misir v. Thagai Misir.
The latter judgment had examined the legal position of a child adopted by a widow after the death of her husband. The court in that case held that the adopted son should be regarded as the son of the deceased husband and could consequently succeed to the property inherited by the widow from her husband.
Justice Rai relied on this line of judicial reasoning in determining the present dispute and concluded that there was no illegality in the consolidation authorities recognising Ramji’s inheritance rights.
Why the ruling matters
The judgment addresses an important question in Hindu succession and adoption law: what happens to property inherited by a widow from her deceased husband when she subsequently adopts a son?
The ruling reinforces the principle that adoption creates a legal relationship extending into the adoptive family and, in the circumstances considered by the court, enables the adopted son to claim succession rights connected with the deceased husband’s estate.
The case also illustrates how disputes over ancestral property can remain alive for decades, particularly when questions of adoption, revenue records and succession overlap.
For Ramji, the judgment settles the challenge to his claim before the High Court. For the wider legal landscape, it provides another judicial affirmation of the inheritance consequences flowing from an adoption by a widow after her husband’s death.

प्रयागराज: पति की मृत्यु के बाद किसी विधवा द्वारा गोद लिए गए बेटे को उत्तराधिकार के मामले में मृत पति का बेटा माना जाएगा और वह पति के हिस्से की संपत्ति पर दावा कर सकता है।
इलाहाबाद हाईकोर्ट ने एक पुराने संपत्ति विवाद का फैसला करते हुए इस कानूनी सिद्धांत को फिर स्पष्ट किया है।
न्यायमूर्ति चंद्र कुमार राय ने प्रयागराज से जुड़े एक लंबे समय से चले आ रहे संपत्ति विवाद में यह फैसला सुनाया।
अदालत ने राम कृपाल की ओर से दायर याचिका खारिज कर दी, जिसमें राजस्व एवं चकबंदी अधिकारियों के उस निर्णय को चुनौती दी गई थी जिसके तहत रामजी के उत्तराधिकार के दावे को स्वीकार किया गया था।
मामले की जड़ में रामजी का वह दावा था कि मोती रानी ने उन्हें 2 अगस्त 1960 को विधिवत गोद लिया था। मोती रानी, मुरलीधर की पत्नी थीं। मुरलीधर की मृत्यु बिना संतान के हुई थी।
उनकी मृत्यु के बाद संपत्ति में उनका हिस्सा उनकी पत्नी मोती रानी के पास चला गया। बाद में रामजी को गोद लिए जाने के आधार पर उस संपत्ति पर उनका उत्तराधिकार का दावा सामने आया।
दशकों तक चलता रहा संपत्ति विवाद
रामजी के गोद लिए जाने और संपत्ति में उनके अधिकार को लेकर विवाद कई वर्षों तक चलता रहा। चकबंदी कार्यवाही के दौरान राम कृपाल ने उनके दावे पर आपत्ति जताई और कहा कि रामजी को मुरलीधर की संपत्ति में उत्तराधिकार नहीं मिलना चाहिए।
मामला विभिन्न राजस्व और चकबंदी स्तरों से होता हुआ हाईकोर्ट पहुंचा। हाईकोर्ट ने अंततः चकबंदी अधिकारियों द्वारा रामजी को मुरलीधर और मोती रानी का गोद लिया बेटा मानने में कोई कानूनी त्रुटि नहीं पाई।
गोद लेने से बनता है उत्तराधिकार का रिश्ता
फैसले का महत्वपूर्ण पहलू यह है कि अदालत ने गोद लेने के रिश्ते को केवल विधवा और बच्चे के बीच सीमित नहीं माना। अदालत ने पूर्व के न्यायिक फैसलों में स्थापित सिद्धांत के आधार पर माना कि ऐसी स्थिति में गोद लिया बेटा उत्तराधिकार के लिए मृत पति के परिवार से भी जुड़ता है।
अदालत ने इस संबंध में सुप्रीम कोर्ट के Sawan Ram बनाम Mst. Kalawanti फैसले का उल्लेख किया। इसके साथ ही इलाहाबाद हाईकोर्ट के पुराने Subhash Misir बनाम Thagai Misir फैसले पर भी भरोसा किया गया। (
Subhash Misir मामले में भी अदालत ने माना था कि पति की मृत्यु के बाद विधवा द्वारा गोद लिया गया बेटा उत्तराधिकार के उद्देश्य से उसके मृत पति का बेटा माना जा सकता है और पति से विधवा को मिली संपत्ति पर उसके उत्तराधिकार का अधिकार बन सकता है।
फैसला हिंदू दत्तक और उत्तराधिकार कानून से जुड़े एक महत्वपूर्ण सवाल को सामने लाता है—यदि पति की मृत्यु के बाद विधवा किसी बच्चे को गोद लेती है, तो क्या उस बच्चे को पति की संपत्ति में उत्तराधिकारी माना जाएगा?
हाईकोर्ट ने मौजूदा मामले के संदर्भ में इसका उत्तर सकारात्मक रूप में दिया है। अदालत ने कहा कि चकबंदी अधिकारियों द्वारा रामजी को मोती रानी और मुरलीधर का गोद लिया बेटा मानते हुए उनके उत्तराधिकार के दावे को स्वीकार करने में कोई अवैधानिकता नहीं थी।
यह मामला इस बात का भी उदाहरण है कि दत्तक संबंध और पैतृक संपत्ति से जुड़े विवाद कितने लंबे समय तक न्यायिक प्रक्रिया में बने रह सकते हैं। जब गोद लेने के प्रमाण, राजस्व रिकॉर्ड और उत्तराधिकार के अधिकार एक साथ विवाद का हिस्सा बनते हैं, तो मुकदमे कई स्तरों से गुजर सकते हैं।
रामजी के लिए हाईकोर्ट का फैसला लंबे समय से चले आ रहे विवाद में महत्वपूर्ण राहत है।
व्यापक कानूनी संदर्भ में यह निर्णय उस न्यायिक दृष्टिकोण को फिर सामने लाता है जिसके तहत विधवा द्वारा पति की मृत्यु के बाद गोद लिए गए बेटे को संबंधित परिस्थितियों में मृत पति के उत्तराधिकारी के रूप में संपत्ति का अधिकार मिल सकता है।
