Ajay Devgn, Shah Rukh Khan and Tiger Shroff Get Maharashtra FDA Notices Over Vimal Elaichi Ad
Maharashtra’s food regulator questions whether the campaign indirectly promotes Vimal Pan Masala, banned in the state; actors asked to explain their role as brand endorsers.
Bollywood stars Ajay Devgn, Shah Rukh Khan and Tiger Shroff have come under the Maharashtra Food and Drug Administration’s scrutiny over their association with a Vimal Elaichi advertisement.
The regulator has issued show-cause notices questioning whether the campaign indirectly promotes Vimal Pan Masala, whose sale and distribution are prohibited in Maharashtra.
The notices, issued this week, require the three actors to explain their participation in the advertisement and their association with the Vimal brand.
The FDA’s concern centres on the possibility that the presentation of the campaign could create a connection between the elaichi product being advertised and the Vimal Pan Masala brand.
The notices were sent to Devgn at his Juhu residence, Khan at Mannat in Bandra and Shroff through Tiger Shroff Productions LLP.
According to the regulator, the advertisement’s branding, dialogue and overall presentation need to be examined in the context of the Vimal name’s association with pan masala.
The FDA has therefore raised the question of whether the campaign amounts to indirect or surrogate advertising for a product that is prohibited in the state.
The action comes shortly after Maharashtra renewed its ban on the manufacture, storage, transportation, distribution and sale of gutkha and pan masala containing tobacco or nicotine.
The latest prohibition took effect on July 13, 2026, under Section 30(2)(a) of the Food Safety and Standards Act, 2006.
The FDA has relied on provisions of the FSS Act dealing with misleading food advertisements.
Section 24 places restrictions on misleading or deceptive advertising, while Section 53 provides for a penalty that can extend to Rs 10 lakh for a person found to be party to the publication of a misleading food advertisement.
The regulator has also referred to the Food Safety and Standards (Advertising and Claims) Regulations, 2018, while seeking explanations from the three actors.
Their responses will form part of the regulatory examination.
The notices are part of a broader enforcement drive by the Maharashtra FDA against banned tobacco-related products.
The department has simultaneously been pursuing cases involving food adulteration, unsafe food practices and the sale of junk food around educational institutions.
The scale of the crackdown has increased in recent months. Between May 25 and July 31, FDA teams raided 658 establishments where prohibited products were detected.
Officials seized banned stock valued at Rs 15.11 crore, registered 519 FIRs and made 701 arrests.
Authorities also seized 78 vehicles allegedly being used to transport banned goods, with the seized material valued at Rs 6.6 crore.
The department is also taking a tougher approach towards organised distribution networks.
On June 12, FDA Commissioner Tukaram Mundhe instructed officials to coordinate with police on the possible application of the Maharashtra Control of Organised Crime Act, 1999, in cases involving eligible organised networks dealing in gutkha, tobacco and nicotine-containing pan masala.
The Vimal Elaichi advertising campaign has faced regulatory questions before.
In 2018, the Directorate General of Health Services issued notices to Vishnu Pouch Packaging Pvt Ltd under the Cigarettes and Other Tobacco Products Act, alleging that the promotion of Vimal Elaichi amounted to indirect advertising of tobacco products and used a Bollywood celebrity to appeal to younger audiences.
The company challenged the action, maintaining that it did not manufacture tobacco products under the Vimal brand for the domestic market.
In January 2024, the Delhi High Court dismissed appeals filed by the DGHS against trial court orders that had stayed the notices.
The earlier litigation included the company’s contention that it was entitled to advertise tobacco-free pan masala products, while the question of surrogate promotion remained disputed.
The latest Maharashtra FDA notices do not by themselves establish a violation.
The actors have been allowed to respond, after which the regulator will determine what further action, if any, is warranted.

खाद्य नियामक ने पूछा- क्या विज्ञापन के जरिए प्रतिबंधित विमल पान मसाला का अप्रत्यक्ष प्रचार किया जा रहा है? तीनों अभिनेताओं से जवाब मांगा गया।
मुंबई: महाराष्ट्र में प्रतिबंधित तंबाकू और निकोटीनयुक्त पान मसाला के खिलाफ कार्रवाई तेज होने के बीच बॉलीवुड अभिनेता अजय देवगन, शाहरुख खान और टाइगर श्रॉफ भी खाद्य नियामक की जांच के दायरे में आ गए हैं।
महाराष्ट्र फूड एंड ड्रग एडमिनिस्ट्रेशन (FDA) ने तीनों अभिनेताओं को विमल इलायची के विज्ञापन में उनकी भूमिका को लेकर कारण बताओ नोटिस जारी किए हैं।
FDA यह जांच कर रहा है कि विज्ञापन भले ही इलायची उत्पाद का प्रचार करता दिखाई देता हो, लेकिन क्या उसकी ब्रांडिंग और प्रस्तुति के जरिए विमल पान मसाला का अप्रत्यक्ष या सरोगेट प्रचार तो नहीं किया जा रहा।
महाराष्ट्र में तंबाकू या निकोटीन वाले पान मसाला की बिक्री और वितरण पर प्रतिबंध है।
इस सप्ताह जारी किए गए नोटिस में तीनों अभिनेताओं से विज्ञापन में उनकी भागीदारी और विमल ब्रांड के साथ उनके प्रचारात्मक जुड़ाव के बारे में स्पष्टीकरण मांगा गया है।
अजय देवगन को उनके जुहू स्थित आवास, शाहरुख खान को बांद्रा स्थित मन्नत और टाइगर श्रॉफ को उनकी प्रोडक्शन कंपनी Tiger Shroff Productions LLP के माध्यम से नोटिस भेजा गया है।
नियामक की आपत्ति केवल उत्पाद के नाम तक सीमित नहीं है। FDA ने विज्ञापन के संवाद, प्रस्तुति और बाजार में विमल ब्रांड की पहचान को भी जांच का आधार बनाया है।
विभाग का कहना है कि इन सभी पहलुओं को देखते हुए यह सवाल उठता है कि क्या विज्ञापन किसी ऐसे उत्पाद के अप्रत्यक्ष प्रचार का माध्यम बन रहा है, जिसकी महाराष्ट्र में बिक्री प्रतिबंधित है।
महाराष्ट्र में तंबाकू और निकोटीन वाले गुटखा तथा पान मसाला पर प्रतिबंध कोई नया प्रावधान नहीं है। राज्य में यह रोक 2012 से लागू है और इसे समय-समय पर नवीनीकृत किया जाता रहा है।
मौजूदा प्रतिबंध 13 जुलाई 2026 से प्रभावी हुआ है और खाद्य सुरक्षा एवं मानक अधिनियम, 2006 की धारा 30(2)(a) के तहत लागू किया गया है।
FDA ने तीनों अभिनेताओं को जारी नोटिस में खाद्य विज्ञापनों से संबंधित कानूनी प्रावधानों का भी उल्लेख किया है।
FSS Act की धारा 24 भ्रामक या धोखाधड़ीपूर्ण खाद्य विज्ञापनों पर रोक लगाती है, जबकि धारा 53 के तहत भ्रामक खाद्य विज्ञापन के प्रकाशन में सहभागी पाए जाने वाले व्यक्ति पर 10 लाख रुपये तक का जुर्माना लगाया जा सकता है।
इसके अलावा, नियामक ने Food Safety and Standards (Advertising and Claims) Regulations, 2018 का भी हवाला दिया है।
अब तीनों अभिनेताओं के जवाब मिलने के बाद मामले में आगे की कार्रवाई पर फैसला किया जाएगा।
यह कार्रवाई महाराष्ट्र FDA की व्यापक प्रवर्तन मुहिम के बीच हुई है।
विभाग इन दिनों मिलावट, असुरक्षित खाद्य पदार्थों, रेस्तरां में परोसे जाने वाले भोजन और स्कूलों के आसपास जंक फूड की बिक्री के साथ-साथ प्रतिबंधित गुटखा तथा तंबाकूयुक्त पान मसाला के खिलाफ भी अभियान चला रहा है।
25 मई से 31 जुलाई के बीच विभाग ने 658 ऐसे प्रतिष्ठानों पर छापेमारी की, जहां प्रतिबंधित उत्पाद पाए गए। इस दौरान 15.11 करोड़ रुपये मूल्य का माल जब्त किया गया, 519 FIR दर्ज हुईं और 701 लोगों को गिरफ्तार किया गया।
अधिकारियों ने प्रतिबंधित सामान की ढुलाई में इस्तेमाल किए जा रहे 78 वाहन भी जब्त किए, जिनमें ले जाए जा रहे माल की कीमत 6.6 करोड़ रुपये बताई गई।
प्रतिबंधित उत्पादों के पीछे सक्रिय संगठित नेटवर्क पर भी FDA की नजर है। 12 जून को FDA आयुक्त तुकाराम मुंडे ने अधिकारियों को पुलिस के साथ समन्वय कर पात्र मामलों में महाराष्ट्र कंट्रोल ऑफ ऑर्गनाइज्ड क्राइम एक्ट (MCOCA), 1999 के इस्तेमाल की संभावना तलाशने का निर्देश दिया था।
विमल इलायची के प्रचार को लेकर नियामकीय विवाद पहले भी सामने आ चुका है। 2018 में Directorate General of Health Services ने Vishnu Pouch Packaging Pvt Ltd को COTPA, 2003 के तहत नोटिस जारी किया था।
उस समय आरोप था कि विमल इलायची के विज्ञापन के जरिए तंबाकू उत्पाद का अप्रत्यक्ष प्रचार किया जा रहा है और बॉलीवुड अभिनेता के इस्तेमाल से युवाओं को आकर्षित किया जा रहा है।
कंपनी ने इन आरोपों को चुनौती देते हुए कहा था कि घरेलू बाजार में वह विमल ब्रांड के नाम से कोई तंबाकू उत्पाद नहीं बनाती।
जनवरी 2024 में दिल्ली हाई कोर्ट ने ट्रायल कोर्ट के उन आदेशों के खिलाफ DGHS की अपीलें खारिज कर दी थीं, जिनमें नोटिस पर रोक लगाई गई थी।
उस मामले में तंबाकू रहित पान मसाला के विज्ञापन के अधिकार और सरोगेट विज्ञापन के सवाल पर विवाद बना रहा।
महाराष्ट्र FDA की ताजा कार्रवाई में फिलहाल तीनों अभिनेताओं को केवल अपना पक्ष रखने का अवसर दिया गया है।
नोटिस जारी होना अपने आप में किसी कानूनी उल्लंघन को साबित नहीं करता। आगे की कार्रवाई उनके जवाब और नियामक की जांच के निष्कर्ष पर निर्भर करेगी।
