Allahabad HC Ruling: Illegal Detention Cannot Be Validated by Later Arrest
Court invokes ‘fruit of the poisonous tree’ doctrine, orders immediate release of Prayagraj man and Rs 30,000 compensation

PRAYAGRAJ: The Allahabad High Court has delivered a significant ruling on personal liberty, holding that a lawful-looking arrest and subsequent judicial remand cannot erase the illegality of an earlier period of police detention.
The court said the legality of an arrest has to be examined from the point at which a person’s custody actually begins. If that initial custody is unlawful, later formalities cannot retrospectively cure the constitutional violation.
A division bench of Justice Atul Sreedharan and Justice Achal Sachdev observed while deciding habeas corpus petitions concerning Prayagraj resident Ravi Chaurasiya. The bench ordered that Chaurasiya be released immediately, provided he was not required in another case, and awarded him Rs 30,000 as compensation.
The amount has been directed to be recovered from the officials found responsible for his illegal detention.
31 Hours in Custody Before Arrest Was Recorded
The court’s finding followed an examination of the events surrounding Chaurasiya’s detention in September 2026.
According to the case before the court, police took him from Ayodhya on September 14 and brought him to Soraon police station in Prayagraj. Despite being in police custody, no formal arrest was recorded at that point.
The following day, his mother went to the police station seeking information about her son. She subsequently moved the High Court with a habeas corpus petition, alleging that he was being held unlawfully.
The police recorded his arrest only at 10:45 am on September 16. The arrest was entered in the general diary, followed by a medical examination and production before a magistrate. He was then sent to judicial custody.
The sequence of events became crucial to the court’s assessment. The bench concluded that Chaurasiya had spent about 31 hours in police custody before his formal arrest and presentation for judicial remand.
Police Explanation Fails to Satisfy Court
The High Court had sought CCTV footage from the police station as part of its examination of the alleged detention.
The affidavits filed by the station house officer and investigating officer also acknowledged that Chaurasiya had been in police custody. The SHO explained the absence of a corresponding general diary entry as an inadvertent mistake.
The bench rejected that explanation.
The court observed that recording the arrival and custody of a person brought to a police station is a basic official duty. Given the experience of the SHO, the court found it difficult to accept that the person’s presence in the lock-up could simply go unrecorded.
The timing of the formal arrest also weighed heavily with the bench. The court noted that the arrest was recorded after the police became aware of the habeas corpus proceedings initiated by Chaurasiya’s mother.
US Legal Doctrine Used to Test Subsequent Proceedings
The judgment drew on the American legal concept known as the “fruit of the poisonous tree” doctrine. In applying the principle, the court treated the unlawful initial detention as the source from which later proceedings arose.
The bench held that when a subsequent arrest is founded on an earlier unconstitutional detention, the arrest itself becomes vulnerable to challenge, as do the remand proceedings that follow from it.
The reasoning was tied directly to constitutional safeguards. Article 21 protects life and personal liberty, while Article 22 lays down specific protections for people who are arrested or detained.
The court also referred to the Supreme Court’s judgment in Jaskaran Jeet Singh Deol v. State of Punjab. The High Court noted that the Supreme Court has recognised that an arrest violating Article 22(1) can affect the validity of subsequent remand orders.
BNSS Safeguard Extends to Pre-Arrest Interrogation
The bench identified another legal lapse in the handling of Chaurasiya’s custody. It found non-compliance with Section 38 of the Bharatiya Nagarik Suraksha Sanhita, which protects an accused person’s right to meet an advocate of choice during investigation.
The court made an important clarification about the timing of that safeguard. According to the judgment, the police obligation does not arise only after a formal arrest. It can also apply when a suspect is taken to a police station for questioning before the person is formally shown as an accused.
The ruling consequently goes beyond the individual case by underlining that police custody cannot operate outside constitutional and statutory safeguards merely because an arrest has not yet been formally recorded.
Commissioner Ordered to Fix Responsibility
The High Court directed the Prayagraj Police Commissioner to conduct an inquiry into the circumstances of the detention and identify the officials responsible.
The court further ordered appropriate action against those found accountable. Its September 28 judgment also recorded displeasure with the conduct of the Soraon SHO.
If the inquiry establishes negligence on the part of the SHO, the court directed that its displeasure be reflected in his service record.
At the same time, the bench clarified that the ruling does not grant Chaurasiya immunity from a lawful arrest. Police may take him into custody again if there are valid grounds, but any such action must comply with the law and the safeguards laid down by the Supreme Court.
For the present, however, the court ordered his immediate release if he was not wanted in any other case.

प्रयागराज: इलाहाबाद हाईकोर्ट ने व्यक्तिगत स्वतंत्रता से जुड़े एक महत्वपूर्ण फैसले में स्पष्ट किया है कि किसी व्यक्ति को पहले गैरकानूनी तरीके से हिरासत में रखने के बाद की गई औपचारिक गिरफ्तारी और न्यायिक रिमांड उस शुरुआती अवैध कार्रवाई को वैध नहीं बना सकते।
अदालत ने कहा कि किसी व्यक्ति की गिरफ्तारी की वैधता का आकलन उस समय से किया जाना चाहिए, जब उसकी वास्तविक हिरासत शुरू हुई। यदि शुरुआती हिरासत ही कानून के विरुद्ध थी, तो बाद में पूरी की गई कानूनी औपचारिकताएं उस संवैधानिक उल्लंघन को पीछे से ठीक नहीं कर सकतीं।
न्यायमूर्ति अतुल श्रीधरन और न्यायमूर्ति अचल सचदेव की खंडपीठ ने यह फैसला प्रयागराज निवासी रवि चौरसिया की ओर से दाखिल बंदी प्रत्यक्षीकरण याचिका पर सुनाया। अदालत ने उन्हें तत्काल रिहा करने का निर्देश दिया, बशर्ते किसी अन्य मामले में उनकी जरूरत न हो। साथ ही उन्हें 30 हजार रुपये मुआवजा देने का आदेश दिया गया।
अदालत ने कहा कि यह रकम उन अधिकारियों से वसूल की जाए, जो जांच में उनकी अवैध हिरासत के लिए जिम्मेदार पाए जाते हैं।
गिरफ्तारी दर्ज होने से पहले करीब 31 घंटे हिरासत
मामले में अदालत के सामने सितंबर 2026 में हुई घटनाओं का क्रम रखा गया। इसके मुताबिक, पुलिस रवि चौरसिया को 14 सितंबर को अयोध्या से लेकर प्रयागराज के सोरांव थाने पहुंची थी। उस समय उनकी औपचारिक गिरफ्तारी दर्ज नहीं की गई।
अगले दिन रवि की मां बेटे का हाल जानने के लिए थाने पहुंचीं। इसके बाद उन्होंने हाईकोर्ट में बंदी प्रत्यक्षीकरण याचिका दाखिल करते हुए आरोप लगाया कि उनके बेटे को पुलिस ने गैरकानूनी तरीके से रोक रखा है।
पुलिस ने 16 सितंबर को सुबह 10:45 बजे रवि की औपचारिक गिरफ्तारी दिखाई। जनरल डायरी में गिरफ्तारी दर्ज की गई, मेडिकल जांच कराई गई और उन्हें मजिस्ट्रेट के सामने पेश किया गया। इसके बाद उन्हें न्यायिक हिरासत में भेज दिया गया।
लेकिन अदालत के लिए महत्वपूर्ण सवाल यह था कि औपचारिक गिरफ्तारी से पहले रवि पुलिस के कब्जे में कितनी देर रहे। घटनाक्रम की समीक्षा के बाद हाईकोर्ट ने माना कि उन्हें करीब 31 घंटे तक पुलिस हिरासत में रखा गया था, जबकि इस अवधि में उन्हें रिमांड के लिए मजिस्ट्रेट के सामने पेश नहीं किया गया।
पुलिस की ‘अनजाने में हुई गलती’ वाली दलील खारिज
मामले की सुनवाई के दौरान हाईकोर्ट ने सोरांव थाने की सीसीटीवी फुटेज भी तलब की। थाना प्रभारी और जांच अधिकारी की ओर से दाखिल जवाबों को भी अदालत ने रिकॉर्ड पर लिया।
पुलिस की ओर से यह स्वीकार किया गया कि रवि पुलिस की हिरासत में थे। हालांकि, थाना प्रभारी ने उनकी हिरासत का विवरण जनरल डायरी में दर्ज न होने को अनजाने में हुई गलती बताया।
अदालत ने इस तर्क को स्वीकार नहीं किया। खंडपीठ ने कहा कि थाने में किसी व्यक्ति को लाकर हिरासत में रखना ऐसी घटना है, जिसे पुलिस रिकॉर्ड में दर्ज करना आवश्यक है। एक अनुभवी थाना प्रभारी से इस तरह की बुनियादी प्रविष्टि छूट जाने की दलील अदालत को संतोषजनक नहीं लगी।
अदालत ने यह भी गौर किया कि रवि की औपचारिक गिरफ्तारी उस समय दर्ज की गई, जब पुलिस को उनकी मां की ओर से दाखिल बंदी प्रत्यक्षीकरण याचिका की जानकारी हो चुकी थी।
अवैध हिरासत को ‘जहरीला पेड़’ माना
फैसले में हाईकोर्ट ने अमेरिकी कानूनी व्यवस्था से जुड़े ‘फ्रूट ऑफ द पॉइजनस ट्री’ सिद्धांत पर भी विस्तार से विचार किया। अदालत ने इस सिद्धांत को हिरासत और गिरफ्तारी के संदर्भ में लागू करते हुए शुरुआती गैरकानूनी हिरासत को उस ‘जहरीले पेड़’ के रूप में देखा, जिससे बाद की कार्रवाई रूपी ‘फल’ पैदा हुआ।
अदालत के अनुसार, यदि किसी व्यक्ति को पहले ही असंवैधानिक तरीके से हिरासत में रखा गया है, तो उसके बाद की गिरफ्तारी को केवल औपचारिक प्रक्रिया पूरी कर लेने के आधार पर स्वतः वैध नहीं माना जा सकता। उसी गिरफ्तारी के आधार पर हुई न्यायिक रिमांड की कार्रवाई भी इससे प्रभावित हो सकती है।
हाईकोर्ट ने इस निष्कर्ष को संविधान के अनुच्छेद 21 और 22 में दी गई सुरक्षा से जोड़ा। अनुच्छेद 21 व्यक्ति के जीवन और व्यक्तिगत स्वतंत्रता की रक्षा करता है, जबकि अनुच्छेद 22 गिरफ्तारी और हिरासत की स्थिति में कई महत्वपूर्ण सुरक्षा उपाय प्रदान करता है।
खंडपीठ ने सुप्रीम कोर्ट के Jaskaran Jeet Singh Deol v. State of Punjab मामले के फैसले का भी हवाला दिया। हाईकोर्ट ने कहा कि अनुच्छेद 22(1) के उल्लंघन से हुई असंवैधानिक गिरफ्तारी का असर उसके बाद दिए गए रिमांड आदेशों पर भी पड़ सकता है।
गिरफ्तारी से पहले पूछताछ पर भी लागू होगी BNSS की सुरक्षा
अदालत ने मामले में भारतीय नागरिक सुरक्षा संहिता यानी BNSS की धारा 38 के पालन में भी कमी पाई। यह प्रावधान जांच के दौरान आरोपी को अपनी पसंद के अधिवक्ता से मिलने का अधिकार देता है।
हाईकोर्ट ने इस प्रावधान की सीमा को लेकर भी महत्वपूर्ण बात कही। अदालत के अनुसार, पुलिस की जिम्मेदारी केवल उस समय शुरू नहीं होती जब किसी व्यक्ति को औपचारिक रूप से गिरफ्तार कर आरोपी घोषित कर दिया जाए। किसी संदिग्ध को पूछताछ के लिए थाने लाए जाने की स्थिति में भी संबंधित कानूनी सुरक्षा का ध्यान रखना जरूरी है।
इस तरह अदालत ने स्पष्ट किया कि औपचारिक गिरफ्तारी दर्ज नहीं होने मात्र से पुलिस हिरासत संवैधानिक और कानूनी नियंत्रण से बाहर नहीं हो जाती।
पुलिस आयुक्त को जांच के निर्देश
हाईकोर्ट ने प्रयागराज के पुलिस आयुक्त को पूरे मामले की जांच कराने और अवैध हिरासत के लिए जिम्मेदार अधिकारियों की पहचान करने का निर्देश दिया। दोषी पाए जाने वाले अधिकारियों के खिलाफ उचित कार्रवाई करने को भी कहा गया है।
28 सितंबर के फैसले में अदालत ने सोरांव थाना प्रभारी के आचरण पर नाराजगी भी दर्ज की। कोर्ट ने निर्देश दिया कि यदि जांच में थाना प्रभारी की लापरवाही साबित होती है, तो अदालत की नाराजगी को उनके सेवा रिकॉर्ड में दर्ज किया जाए।
हालांकि, हाईकोर्ट ने यह भी स्पष्ट किया कि उसके फैसले का अर्थ यह नहीं है कि रवि चौरसिया को भविष्य में वैध आधार पर गिरफ्तार नहीं किया जा सकता। यदि कानून के तहत गिरफ्तारी की जरूरत होती है, तो पुलिस उन्हें दोबारा गिरफ्तार कर सकती है, लेकिन इस बार संवैधानिक अधिकारों और सुप्रीम कोर्ट द्वारा तय सुरक्षा उपायों का पूरी तरह पालन करना होगा।
फिलहाल अदालत ने रवि चौरसिया की तत्काल रिहाई का आदेश दिया है। यदि वह किसी अन्य मामले में वांछित नहीं हैं, तो उन्हें बिना देरी के रिहा किया जाना है।
