Allahabad HC Scraps Vigilance Case Against IAS Officer Abhishek Prakash
Court overturns 2025 suspension and departmental action, saying the proceedings rested on a complaint later disowned by its author and were initiated without following prescribed safeguards
LUCKNOW: The Allahabad High Court has cancelled the Vigilance investigation and departmental proceedings against IAS officer Abhishek Prakash, bringing to a close a case that had originated in allegations surrounding the clearance of a proposed solar-sector project.
The Lucknow bench, in its Thursday order, also struck down the Uttar Pradesh government’s 2025 orders placing Prakash under suspension and initiating disciplinary proceedings against him.
Justice Rajeev Singh’s ruling was based on two significant aspects of the case: the subsequent statement of the person who had lodged the original complaint and the manner in which the state authorities proceeded against the IAS officer.
Prakash, a 2006-batch IAS officer, had challenged the proceedings through a writ petition.
He was serving as Industry and Infrastructure Development Secretary and Chief Executive Officer of Invest UP when the controversy arose.
His suspension was withdrawn in March 2026, and he is now Secretary in the General Administration Department.
How a project dispute turned into a Vigilance case
At the centre of the controversy was a proposal by SAEL Solar P6 Private Limited to establish a manufacturing facility for components associated with solar cells and solar energy.
Company representative Biswajit Datta approached the Uttar Pradesh Chief Secretary on March 20, 2025.
The complaint alleged that an intermediary, Nikant Jain, had sought five per cent of the project’s value in return for facilitating its approval.
The allegation was that Jain had been introduced to the company through an Invest UP official and was portrayed as someone whose intervention would be necessary before the proposal could obtain approval from the Empowered Committee and Cabinet.
The company allegedly declined the demand. The complaint subsequently became the basis for action not only against Jain but also for administrative proceedings involving Prakash.
An earlier court ruling weakened the foundation of the case
Jain was arrested after an FIR was registered against him at Gomti Nagar police station in Lucknow.
His legal battle, however, produced a development that later became central to Prakash’s case.
In February 2026, the High Court quashed the criminal proceedings and chargesheet against Jain after the original complainant submitted an affidavit saying that he had lodged the complaint because of a misunderstanding.
While deciding Prakash’s petition, Justice Singh referred to that admission.
The court held that the subsequent position taken by the complainant had a direct bearing on proceedings that originated from his complaint.
It applied the principle expressed in the Latin maxim Sublato Fundamento Cadit Opus—when the foundation disappears, the structure resting upon it cannot continue.
On that reasoning, the bench concluded that the proceedings based upon the complaint could not survive.
Government’s procedure also came under judicial scrutiny
The High Court separately examined whether the authorities had followed the safeguards governing complaints against government officers and the initiation of Vigilance inquiries.
The bench noted that the complaint was received on March 20, 2025, and that action against Prakash followed immediately. His suspension, departmental proceedings and Vigilance inquiry were initiated without the interval ordinarily expected for preliminary scrutiny.
Another issue was the absence of an affidavit supporting the original complaint.
The court referred to government instructions issued between 1991 and 2018, explaining that the affidavit requirement was intended as a safeguard against officials being subjected to proceedings based on false or fabricated allegations.
The bench also found that the Vigilance matter had not been placed before the State Vigilance Committee for the requisite approval before the investigation was taken forward.
According to the judgment, the authorities also moved ahead with the Vigilance process while departmental proceedings were already pending against Prakash.
Project records contradicted the suggestion of an unexplained delay
The court went beyond the complaint and examined the original records maintained by Invest UP concerning the solar company’s proposal.
Those documents provided a different explanation for why the project had not immediately progressed.
The proposal had come before the Evaluation Committee on March 12, 2025. At that stage, land required for the project was still in the process of being acquired.
A communication from the CEO of YEIDA indicated that about 200 acres were to be acquired from farmers and subsequently made available to the company, with April 30 set as the expected timeline.
There was another unresolved component involving a proposed concession on electricity charges. Invest UP had sought a report from UPPCL on the issue.
The High Court consequently found that the project’s deferment was linked to pending requirements rather than being shown in the records as an unexplained administrative hold.
State disputed Prakash’s challenge.
The Uttar Pradesh government opposed the petition and maintained that the company’s complaint could not simply be treated as fictitious.
The state also relied upon the 1995 government order governing Vigilance inquiries, arguing that the prescribed framework permitted such investigations after consideration by the State Vigilance Committee and approval by the competent minister.
The High Court, however, found that the procedural requirements had not been properly followed in the circumstances before it.
What the ruling changes
The judgment removes the Vigilance inquiry and departmental proceedings that had continued against Prakash after the original allegations emerged.
The court has also set aside the government orders relating to his suspension and the disciplinary action initiated in March 2025.
The ruling follows the earlier termination of the criminal proceedings against Nikant Jain and rests substantially on the original complainant’s subsequent affidavit, along with the court’s findings regarding the procedure followed by the state authorities.
Prakash had sought cancellation of the proceedings through his writ petition. The Thursday order grants that relief and brings the challenged proceedings to an end.

शिकायतकर्ता के बाद के हलफनामे और सरकारी प्रक्रिया में खामियों को अहम मानते हुए लखनऊ पीठ ने निलंबन व विभागीय कार्यवाही के आदेश भी निरस्त किए
लखनऊ: इलाहाबाद हाईकोर्ट की लखनऊ पीठ ने IAS अधिकारी अभिषेक प्रकाश के खिलाफ चल रही विजिलेंस जांच और विभागीय कार्यवाही को समाप्त कर दिया है।
अदालत के इस फैसले के साथ उस मामले की कार्रवाई भी खत्म हो गई है, जिसकी शुरुआत एक सौर ऊर्जा परियोजना की मंजूरी से जुड़े आरोपों से हुई थी।
न्यायमूर्ति राजीव सिंह ने गुरुवार को उत्तर प्रदेश सरकार द्वारा 2025 में जारी उन आदेशों को भी रद्द कर दिया, जिनके तहत अभिषेक प्रकाश को निलंबित किया गया था और उनके खिलाफ विभागीय कार्रवाई शुरू की गई थी।
अदालत के फैसले में दो पहलू विशेष रूप से महत्वपूर्ण रहे। पहला, मूल शिकायतकर्ता ने बाद में अदालत के समक्ष अपनी शिकायत को गलतफहमी का परिणाम बताया था।
दूसरा, हाईकोर्ट ने पाया कि प्रकाश के खिलाफ कार्रवाई शुरू करने में निर्धारित प्रशासनिक प्रक्रियाओं का पालन नहीं किया गया।
2006 बैच के IAS अधिकारी प्रकाश ने इन कार्यवाहियों को चुनौती देते हुए हाईकोर्ट में याचिका दायर की थी।
विवाद के समय वह उद्योग एवं अवसंरचना विकास विभाग के सचिव तथा Invest UP के CEO थे। उनका निलंबन मार्च 2026 में वापस लिया जा चुका था और अब वह सामान्य प्रशासन विभाग के सचिव हैं।
सोलर परियोजना की मंजूरी से उठा विवाद
पूरे मामले की शुरुआत SAEL Solar P6 Private Limited की एक प्रस्तावित परियोजना से हुई थी। कंपनी सोलर सेल और सौर ऊर्जा क्षेत्र में इस्तेमाल होने वाले उपकरणों के निर्माण के लिए इकाई स्थापित करना चाहती थी।
कंपनी के अधिकारी बिस्वजीत दत्ता ने 20 मार्च 2025 को उत्तर प्रदेश के मुख्य सचिव के समक्ष शिकायत दर्ज कराई थी।
शिकायत में आरोप लगाया गया था कि निकांत जैन नामक व्यक्ति ने परियोजना को आगे बढ़ाने और मंजूरी दिलाने के लिए परियोजना की कुल कीमत का पांच प्रतिशत मांगा था।
कथित तौर पर जैन का परिचय कंपनी के प्रतिनिधि से Invest UP से जुड़े एक अधिकारी के माध्यम से हुआ था। शिकायत के अनुसार, कंपनी को बताया गया था कि Empowered Committee और कैबिनेट स्तर पर मंजूरी की प्रक्रिया आगे बढ़ाने में जैन की भूमिका जरूरी होगी।
कंपनी ने कथित तौर पर रकम देने से इनकार कर दिया। इसके बाद यह शिकायत आगे की प्रशासनिक और आपराधिक कार्रवाई का आधार बनी।
जैन के मामले में आए फैसले ने बदली तस्वीर
शिकायत के आधार पर लखनऊ के गोमती नगर थाने में निकांत जैन के खिलाफ FIR दर्ज की गई और उन्हें गिरफ्तार कर जेल भेज दिया गया।
लेकिन जैन के खिलाफ मामला बाद में एक महत्वपूर्ण मोड़ पर पहुंचा। फरवरी 2026 में हाईकोर्ट ने उनके खिलाफ दर्ज आपराधिक मुकदमे और चार्जशीट को रद्द कर दिया।
उस सुनवाई के दौरान मूल शिकायतकर्ता ने हलफनामा देकर कहा था कि उसने शिकायत गलतफहमी के कारण दर्ज कराई थी।
अभिषेक प्रकाश की याचिका पर फैसला देते समय न्यायमूर्ति राजीव सिंह ने इसी बाद के बयान को महत्वपूर्ण माना।
पीठ ने Sublato Fundamento Cadit Opus के कानूनी सिद्धांत का उल्लेख करते हुए कहा कि यदि किसी कार्रवाई की बुनियाद ही समाप्त हो जाए तो उस पर आधारित आगे की कार्यवाही भी कायम नहीं रह सकती।
सरकार की कार्रवाई की प्रक्रिया भी सवालों में
हाईकोर्ट ने यह भी जांचा कि शिकायत मिलने के बाद प्रकाश के खिलाफ सरकारी स्तर पर कार्रवाई किस प्रक्रिया के तहत की गई।
अदालत ने पाया कि 20 मार्च 2025 को शिकायत मिलने के साथ ही प्रकाश के खिलाफ निलंबन, विभागीय कार्रवाई और विजिलेंस जांच की प्रक्रिया शुरू कर दी गई।
पीठ ने यह भी ध्यान दिया कि मूल शिकायत के साथ हलफनामा मौजूद नहीं था।
अदालत ने 1991 से 2018 के बीच जारी सरकारी निर्देशों का उल्लेख करते हुए कहा कि शिकायत के साथ हलफनामा लेने की व्यवस्था का उद्देश्य सरकारी अधिकारियों को झूठी या मनगढ़ंत शिकायतों के आधार पर परेशान किए जाने से बचाना था।
विजिलेंस जांच से जुड़े एक अन्य पहलू पर भी अदालत ने आपत्ति दर्ज की। पीठ के अनुसार, मामले को राज्य विजिलेंस समिति के समक्ष आवश्यक मंजूरी के लिए रखने की प्रक्रिया पूरी नहीं की गई थी।
इसके अलावा, प्रकाश के खिलाफ विभागीय कार्यवाही पहले से चल रही थी, लेकिन उसका परिणाम आने से पहले ही विजिलेंस जांच को आगे बढ़ा दिया गया।
Invest UP के रिकॉर्ड ने परियोजना टलने की वजह बताई
अदालत ने शिकायत में लगाए गए आरोपों के अलावा Invest UP की मूल्यांकन समिति के मूल रिकॉर्ड भी देखे।
इन दस्तावेजों से परियोजना के आगे न बढ़ने की एक अलग तस्वीर सामने आई।
12 मार्च 2025 को परियोजना का प्रस्ताव मूल्यांकन समिति के सामने था। उस समय परियोजना के लिए आवश्यक जमीन की उपलब्धता का मुद्दा लंबित था।
YEIDA के CEO की ओर से Invest UP के अतिरिक्त CEO को भेजे गए पत्र में बताया गया था कि किसानों से लगभग 200 एकड़ जमीन खरीदी जानी थी और उसके बाद वह कंपनी को उपलब्ध कराई जानी थी। इसे 30 अप्रैल तक उपलब्ध कराने का अनुमान था।
परियोजना से संबंधित बिजली शुल्क में रियायत का मुद्दा भी लंबित था। इस बारे में UPPCL से रिपोर्ट मांगी गई थी।
इन रिकॉर्ड के आधार पर हाईकोर्ट ने पाया कि कंपनी के प्रस्ताव को बिना किसी कारण के नहीं रोका गया था। उसके लंबित रहने के पीछे जमीन और बिजली से जुड़े प्रशासनिक मुद्दे मौजूद थे।
राज्य सरकार ने याचिका का विरोध किया
उत्तर प्रदेश सरकार ने अभिषेक प्रकाश की याचिका का विरोध करते हुए कहा कि कंपनी के अधिकारी की शिकायत को काल्पनिक या फर्जी नहीं माना जा सकता।
सरकार ने 1995 के शासनादेश का भी हवाला दिया और कहा कि राज्य विजिलेंस समिति के विचार तथा सक्षम मंत्री की मंजूरी के बाद विजिलेंस जांच की जा सकती है।
हालांकि, हाईकोर्ट ने मामले के रिकॉर्ड और संबंधित सरकारी निर्देशों की समीक्षा के बाद पाया कि निर्धारित प्रक्रियाओं का पालन उचित तरीके से नहीं हुआ था।
हाईकोर्ट के फैसले से क्या बदला
गुरुवार के आदेश के बाद अभिषेक प्रकाश के खिलाफ इस मामले में चल रही विजिलेंस जांच और विभागीय कार्यवाही समाप्त हो गई है।
अदालत ने 2025 में जारी उनके निलंबन और संबंधित सरकारी कार्रवाई के आदेश भी निरस्त कर दिए हैं।
यह फैसला निकांत जैन के खिलाफ आपराधिक कार्यवाही समाप्त किए जाने के बाद आया है। प्रकाश के मामले में अदालत ने मूल शिकायतकर्ता के बाद के हलफनामे के साथ-साथ शिकायतों और विजिलेंस जांच से जुड़े प्रशासनिक नियमों के पालन की भी समीक्षा की।
अभिषेक प्रकाश ने अपने खिलाफ चल रही कार्यवाही को रद्द करने की मांग करते हुए हाईकोर्ट का रुख किया था। अदालत के ताजा आदेश से उनकी याचिका पर राहत मिल गई है।
