Allahabad High Court Acquits Four Women, Upholds Conviction of Two Men in 1984 Land Clash

The Allahabad High Court has ruled that when evidence does not clearly establish which side initiated a violent clash, the incident should be treated as a “free fight”, making every individual accountable only for his or her own actions.
Applying this principle, the court acquitted four women accused while affirming the conviction of two men in a 1984 land dispute case from Lalitpur district.
The judgment was delivered by Justice Sanjiv Kumar while hearing an appeal against the June 1988 verdict of the Additional Sessions Judge/Special Judge (EC Act), Lalitpur.
The appeal had challenged the conviction of several accused persons who were found guilty in connection with a violent confrontation over disputed agricultural land.
The case originated from a First Information Report lodged by Mannu Lal on September 20, 1984.
According to the complaint, members of the opposite group allegedly began harvesting crops from a disputed 6.45-acre plot at Nazarbagh Kunwa in Basatguwa village, leading to a confrontation between the rival parties.
The prosecution alleged that the argument soon escalated into a violent clash in which both sides attacked each other with lathis and sickles.
Several people sustained injuries during the incident as the dispute turned into a full-scale fight.
The violence also claimed the lives of two persons from the accused side, Zalim and Bhagirath.
Following their deaths, a cross-case under Section 302 of the Indian Penal Code, relating to murder, was registered against 15 members of the complainant’s side.
In 1988, the trial court convicted twelve accused persons in the present case and released them on probation for one year on the condition of maintaining good conduct.
The convicted persons approached the High Court the same year, challenging the trial court’s judgment.
During the long pendency of the appeal, six appellants died, resulting in the proceedings being abated against them.
The appeal ultimately survived only for six accused, including four women and two men.
After examining the evidence, the High Court observed that litigation over the ownership of the disputed land had already been pending between the two sides.
It noted that the prosecution had failed to conclusively establish either who had cultivated the maize crop or which group had initiated the confrontation.
The Bench observed that since the prosecution could not prove that the disputed land or the standing crop belonged to the complainant’s side, the plea of exercising the right of private defence of property could not be accepted.
The court held that in the absence of clear evidence identifying the aggressor, the incident had to be treated as a free fight, where every participant is liable only for his or her individual conduct.
While evaluating the role of the four women appellants, the court found significant inconsistencies in the testimonies of the prosecution witnesses.
It noted that although the women were present at the spot, even the prosecution’s injured witnesses admitted during cross-examination that none of them had picked up weapons or physically attacked anyone.
The High Court observed that there was no convincing evidence to show that Badi Bahu alias Kanchan Devi, Sanjhali Bahu, wife of Bhajan Lal, Manjhli Bahu, wife of Baijnath, and Manjhali Bahu, wife of Zalim, had participated in the assault or shared a common intention with the other accused.
Giving them the benefit of doubt, the court set aside their conviction and acquitted all four women of every charge.
However, the Bench reached a different conclusion regarding the two surviving male appellants, Bhajan Lal and Ramanand.
The court found reliable eyewitness testimony establishing their active involvement in the clash and, therefore, upheld their conviction.
Maintaining the trial court’s order against the two men, the High Court directed Bhajan Lal and Ramanand to appear before the trial court within one month and execute the required bonds for maintaining good behaviour during the one-year probation period.

प्रयागराज: इलाहाबाद हाईकोर्ट ने महत्वपूर्ण टिप्पणी करते हुए कहा है कि यदि उपलब्ध साक्ष्यों से यह स्पष्ट न हो कि किसी हिंसक संघर्ष की शुरुआत किस पक्ष ने की, तो उसे “फ्री फाइट” माना जाएगा और ऐसी स्थिति में प्रत्येक व्यक्ति केवल अपने व्यक्तिगत कृत्य के लिए उत्तरदायी होगा।
इसी सिद्धांत को लागू करते हुए अदालत ने वर्ष 1984 के एक भूमि विवाद से जुड़े मामले में चार महिला आरोपियों को बरी कर दिया, जबकि दो पुरुष आरोपियों की दोषसिद्धि को बरकरार रखा।
न्यायमूर्ति संजीव कुमार ने यह फैसला जून 1988 में ललितपुर के अपर सत्र न्यायाधीश/विशेष न्यायाधीश (ईसी एक्ट) द्वारा सुनाए गए निर्णय के विरुद्ध दायर अपील पर सुनवाई करते हुए दिया।
अपील में उस फैसले को चुनौती दी गई थी, जिसमें कई आरोपियों को भूमि विवाद के दौरान हुई हिंसक झड़प के मामले में दोषी ठहराया गया था।
मामले की शुरुआत 20 सितंबर 1984 को मन्नू लाल द्वारा दर्ज कराई गई प्राथमिकी से हुई थी। शिकायत के अनुसार, विरोधी पक्ष ने बसतगुवा गांव स्थित नज़रबाग कुआं क्षेत्र की 6.45 एकड़ विवादित भूमि पर खड़ी फसल की जबरन कटाई शुरू कर दी, जिसके बाद दोनों पक्ष आमने-सामने आ गए।
अभियोजन पक्ष के अनुसार, पहले कहासुनी हुई और फिर विवाद हिंसक झड़प में बदल गया। दोनों पक्षों के लोगों ने एक-दूसरे पर लाठियों और हंसियों से हमला किया, जिससे कई लोग घायल हो गए।
इस संघर्ष में आरोपी पक्ष के दो लोगों—जालिम और भागीरथ—की भी मृत्यु हो गई। इसके बाद शिकायतकर्ता पक्ष के 15 लोगों के खिलाफ भारतीय दंड संहिता की धारा 302 के तहत हत्या का एक प्रतिमामला भी दर्ज किया गया।
वर्ष 1988 में ट्रायल कोर्ट ने वर्तमान मामले में 12 आरोपियों को दोषी ठहराते हुए उन्हें एक वर्ष के लिए सदाचार बनाए रखने की शर्त पर परिवीक्षा का लाभ दिया था।
दोषसिद्धि के खिलाफ आरोपियों ने उसी वर्ष हाईकोर्ट का दरवाजा खटखटाया। अपील लंबित रहने के दौरान छह आरोपियों की मृत्यु हो गई, जिसके कारण उनके संबंध में कार्यवाही समाप्त हो गई।
इसके बाद अपील केवल छह जीवित अपीलकर्ताओं—चार महिलाओं और दो पुरुषों—तक सीमित रह गई।
रिकॉर्ड पर उपलब्ध साक्ष्यों का परीक्षण करने के बाद हाईकोर्ट ने पाया कि विवादित भूमि को लेकर दोनों पक्षों के बीच पहले से मुकदमा लंबित था।
अदालत ने कहा कि अभियोजन यह साबित करने में असफल रहा कि विवादित खेत में मक्का की फसल किसने बोई थी या झड़प की शुरुआत किस पक्ष ने की थी।
अदालत ने कहा कि जब अभियोजन यह सिद्ध नहीं कर पाया कि भूमि अथवा फसल शिकायतकर्ता पक्ष की थी, तब संपत्ति की निजी रक्षा का अधिकार इस मामले में लागू नहीं होता।
न्यायालय ने स्पष्ट किया कि जब आक्रमणकारी पक्ष की पहचान ही स्थापित नहीं हो पाती, तब पूरे घटनाक्रम को “फ्री फाइट” माना जाएगा और प्रत्येक व्यक्ति केवल अपने स्वयं के कार्यों के लिए जिम्मेदार होगा।
चार महिला अपीलकर्ताओं की भूमिका पर विचार करते हुए हाईकोर्ट ने अभियोजन गवाहों के बयानों में महत्वपूर्ण विरोधाभास पाया।
अदालत ने कहा कि यद्यपि महिलाएं घटनास्थल पर मौजूद थीं, लेकिन स्वयं अभियोजन पक्ष के घायल गवाहों ने जिरह के दौरान स्वीकार किया कि उन्होंने न तो कोई हथियार उठाया और न ही किसी पर हमला किया।
न्यायालय ने कहा कि यह साबित करने के लिए कोई ठोस और विश्वसनीय साक्ष्य उपलब्ध नहीं है कि बड़ी बहू उर्फ कंचन देवी, सांझली बहू पत्नी भजन लाल, मंझली बहू पत्नी बैजनाथ तथा मंझली बहू पत्नी जालिम ने हमले में भाग लिया था या अन्य आरोपियों के साथ उनका कोई समान उद्देश्य था।
संदेह का लाभ देते हुए अदालत ने चारों महिलाओं की दोषसिद्धि निरस्त कर उन्हें सभी आरोपों से बरी कर दिया।
हालांकि, दो जीवित पुरुष अपीलकर्ताओं—भजन लाल और रामानंद—के मामले में अदालत का निष्कर्ष अलग रहा। हाईकोर्ट ने कहा कि उनके खिलाफ प्रत्यक्षदर्शियों के विश्वसनीय और स्पष्ट बयान उपलब्ध हैं, जो झड़प में उनकी सक्रिय भागीदारी सिद्ध करते हैं। इसलिए उनकी दोषसिद्धि को बरकरार रखा गया।
अपने अंतिम आदेश में अदालत ने भजन लाल और रामानंद को निर्देश दिया कि वे एक महीने के भीतर ट्रायल कोर्ट के समक्ष उपस्थित होकर एक वर्ष की परिवीक्षा अवधि के दौरान अच्छे आचरण का पालन करने के लिए आवश्यक बंधपत्र निष्पादित करें।
