No Two-Year Gap Needed Between Pregnancies for Maternity Leave, Rules Allahabad High Court

Prayagraj: In a significant ruling for working women, the Allahabad High Court has held that a woman employee cannot be denied maternity leave merely because there is no two-year gap between two pregnancies.
The court observed that maternity benefits are governed by the provisions of the Social Security Code, 2020, which does not prescribe any mandatory interval between successive pregnancies.
Delivering the judgment, Justice Siddharth Nandan ruled that executive instructions imposing such a restriction cannot override the statutory provisions of the Social Security Code.
The court, therefore, set aside the January 9, 2026 order of the Medical Education Department, which had rejected the maternity leave application of staff nurse Shikha Yadav.
The department had refused her request on the ground that she had conceived her second child before completing two years from the date of her previous maternity leave.
The rejection was based on a government order issued on December 8, 2008, along with Rule 153(1) of the Uttar Pradesh Financial Handbook applicable to the Medical Education Department.
After examining the legal provisions, the High Court directed Shikha Yadav to submit a fresh application seeking maternity leave under the Social Security Code, 2020.
The court further instructed the competent authority of the Health Department to reconsider her request in accordance with the observations made in the judgment and the applicable law.
Shikha Yadav is serving as a regular Staff Nurse/Nursing Officer in the Medical Education Department of the Uttar Pradesh Government.
She had earlier been granted 180 days of maternity leave from January 29, 2024, to July 27, 2024, through an office order issued on February 12, 2024.
Subsequently, she conceived again and was expecting the birth of her second child on January 12, 2026.
Anticipating her delivery, she applied on January 5, 2026, for another spell of 180 days’ maternity leave, covering the period from January 19, 2026, to July 17, 2026.
However, her application was rejected just four days later through an order dated January 9, 2026.
The department maintained that she was ineligible because two years had not elapsed since her earlier maternity leave, relying on existing departmental instructions and provisions of the UP Financial Handbook.
In its judgment dated July 15, the High Court clarified that the Social Security Code, 2020, has overriding legal force and prevails over any executive instructions or departmental rules that are inconsistent with it.
The Bench observed that Rule 153(1) of the Financial Handbook had already been interpreted by a Coordinate Bench of the High Court in the Anupam Yadav case while dealing with maternity benefits for a second pregnancy.
The court concluded that maternity leave for a second pregnancy must be regulated solely by the Social Security Code, 2020, which does not impose any restriction requiring a fixed time gap between two pregnancies.
It held that a woman employee’s entitlement to maternity benefits cannot be curtailed based on executive instructions that are contrary to the law enacted by Parliament.
दो गर्भधारण के बीच दो साल का अंतर जरूरी नहीं, मातृत्व अवकाश पर इलाहाबाद हाईकोर्ट का अहम फैसला
प्रयागराज: कामकाजी महिलाओं के अधिकारों को मजबूती देने वाले एक महत्वपूर्ण फैसले में इलाहाबाद हाईकोर्ट ने कहा है कि केवल इस आधार पर मातृत्व अवकाश से वंचित नहीं किया जा सकता कि दो गर्भधारण के बीच दो वर्ष का अंतर नहीं है।
अदालत ने स्पष्ट किया कि मातृत्व लाभ सामाजिक सुरक्षा संहिता, 2020 के प्रावधानों के अनुसार दिए जाएंगे, जिसमें दो गर्भधारण के बीच किसी न्यूनतम समय अंतराल की कोई अनिवार्यता नहीं है।
न्यायमूर्ति सिद्धार्थ नंदन ने अपने निर्णय में कहा कि किसी भी प्रकार के कार्यपालिका के निर्देश या विभागीय आदेश संसद द्वारा बनाए गए कानून से ऊपर नहीं हो सकते।
इसी आधार पर अदालत ने चिकित्सा शिक्षा विभाग द्वारा 9 जनवरी 2026 को जारी उस आदेश को निरस्त कर दिया, जिसके माध्यम से स्टाफ नर्स शिखा यादव के मातृत्व अवकाश के आवेदन को अस्वीकार कर दिया गया था।
विभाग ने उनका आवेदन यह कहते हुए खारिज किया था कि उनकी दूसरी गर्भावस्था, पहले मातृत्व अवकाश के दो वर्ष पूरे होने से पहले हुई है।
इस निर्णय के समर्थन में विभाग ने 8 दिसंबर 2008 के शासनादेश तथा चिकित्सा शिक्षा विभाग पर लागू उत्तर प्रदेश वित्तीय हैंडबुक के नियम 153(1) का हवाला दिया था।
मामले की सुनवाई के बाद हाईकोर्ट ने शिखा यादव को सामाजिक सुरक्षा संहिता, 2020 के तहत नया आवेदन प्रस्तुत करने की अनुमति दी।
अदालत ने संबंधित स्वास्थ्य विभाग के सक्षम अधिकारी को निर्देश दिया कि वह न्यायालय की टिप्पणियों और लागू कानून के अनुरूप उनके आवेदन पर पुनः निर्णय ले।
शिखा यादव उत्तर प्रदेश सरकार के चिकित्सा शिक्षा विभाग में नियमित स्टाफ नर्स/नर्सिंग अधिकारी के पद पर कार्यरत हैं।
उन्हें पहले 29 जनवरी 2024 से 27 जुलाई 2024 तक 180 दिनों का मातृत्व अवकाश कार्यालय आदेश दिनांक 12 फरवरी 2024 के माध्यम से स्वीकृत किया गया था।
बाद में वह दूसरी बार गर्भवती हुईं और उनके दूसरे बच्चे के जन्म की संभावित तिथि 12 जनवरी 2026 निर्धारित थी। इसे देखते हुए उन्होंने 5 जनवरी 2026 को 19 जनवरी 2026 से 17 जुलाई 2026 तक 180 दिनों के मातृत्व अवकाश के लिए आवेदन प्रस्तुत किया।
लेकिन विभाग ने 9 जनवरी 2026 को ही उनका आवेदन यह कहते हुए अस्वीकार कर दिया कि पिछला मातृत्व अवकाश स्वीकृत हुए अभी दो वर्ष पूरे नहीं हुए हैं। विभाग ने इस निर्णय के लिए शासनादेश और उत्तर प्रदेश वित्तीय हैंडबुक के प्रावधानों का आधार लिया।
15 जुलाई को दिए गए अपने फैसले में हाईकोर्ट ने स्पष्ट किया कि सामाजिक सुरक्षा संहिता, 2020 की विधिक शक्ति किसी भी विभागीय निर्देश या कार्यपालिका के आदेश से अधिक है।
अदालत ने यह भी कहा कि वित्तीय हैंडबुक के नियम 153(1) की व्याख्या पहले ही हाईकोर्ट की समन्वय पीठ ने स्म्ति अनुपम यादव मामले में दूसरी गर्भावस्था से जुड़े मातृत्व लाभ के संदर्भ में कर दी थी।
अदालत ने अपने अंतिम निष्कर्ष में कहा कि दूसरी गर्भावस्था के लिए मातृत्व लाभ पूरी तरह सामाजिक सुरक्षा संहिता, 2020 के प्रावधानों के अनुसार दिए जाएंगे।
चूंकि इस कानून में दो गर्भधारण के बीच किसी निश्चित समय अंतराल की शर्त नहीं है, इसलिए केवल दो वर्ष का अंतर न होने के आधार पर किसी महिला कर्मचारी को मातृत्व अवकाश से वंचित नहीं किया जा सकता।
