Allahabad High Court Calls for Scientific Crowd Management in Mathura-Vrindavan, Seeks Accountability from Top UP Officials

Mathura: Expressing deep concern over recurring crowd-related mishaps in the temple towns of Mathura and Vrindavan, the Allahabad High Court has remarked that the existing system for handling large gatherings lacks a scientific foundation.
Stressing the urgent need for a modern crowd-management framework, the court has issued a series of recommendations to the Uttar Pradesh government and sought detailed responses from key administrative authorities.
Judicial scrutiny intensified after the court took note of stampede-like situations reported during Holi celebrations and other major religious occasions.
Justice Vinod Diwakar directed the Vice-Chairman of the Mathura-Vrindavan Development Authority (MVDA), the District Magistrate, the Municipal Commissioner and the Senior Superintendent of Police to file comprehensive affidavits explaining the measures currently in place and the shortcomings that require correction.
During the proceedings, the court observed that the authorities have largely equated crowd management with regulating vehicular movement, overlooking the specialised nature of managing large religious congregations.
It pointed out that devotees attending spiritual events often remain emotionally immersed, making them less conscious of risks and requiring a completely different administrative strategy from that adopted for political gatherings or sporting events.
Drawing support from established research on crowd behaviour, the Bench explained that a gathering becomes increasingly dangerous once the density reaches four to five persons within a square metre, as individuals gradually lose the ability to move independently.
The danger becomes critical when the density rises to six or seven persons per square metre, often resulting in compressive asphyxia, a phenomenon that has figured in several tragic incidents at pilgrimage centres across the country.
These observations were made while the court was hearing a petition concerning an allegedly unauthorised structure in Vrindavan.
Considering the larger public interest involved, the Bench decided to broaden the scope of the case so that the wider issue of crowd safety and administrative preparedness in Mathura-Vrindavan could also be examined.
The court underlined that tragedies caused by overcrowding at religious gatherings cannot simply be attributed to weak infrastructure or isolated administrative failures.
Instead, it observed that the absence of a scientific understanding of how crowds behave under pressure is one of the principal reasons behind such disasters.
Originally, the litigation had been initiated by Swami Shiv Swaroopanand Ji Maharaj, who challenged a demolition order relating to an ashram constructed on his land in Vrindavan.
During the hearing, he alleged that enforcement agencies had selectively proceeded against only a handful of the 23 unauthorised constructions in the area, describing the exercise as discriminatory and arbitrary.
Official figures placed before the court by the MVDA revealed that between 2021-22 and 2025-26, notices were served in 2,453 cases involving alleged illegal constructions.
Although demolition orders were passed in 700 matters, authorities carried out action in only 323 cases.
Besides this, 104 properties were sealed, and 212 cases were regularised through compounding.
Describing the statistics as merely “the tip of the iceberg”, the court observed that the actual scale of unauthorised development was significantly larger than what had been disclosed.
The Bench also expressed dissatisfaction with the absence of a long-term urban planning vision for Mathura.
It observed that ancient pilgrimage centres such as Mathura, Ayodhya, Varanasi and Chitrakoot possess exceptional religious and cultural importance and therefore cannot be administered in the same manner as ordinary urban centres.
Another concern flagged by the court was the alleged nexus behind illegal constructions in religious towns.
It observed that such activities are frequently sustained through organised networks involving land mafias, builders and political patronage.
According to the Bench, addressing this challenge requires determined institutional commitment rather than merely introducing tougher legal provisions.
Providing interim relief to the petitioner, the High Court permitted him to submit a fresh representation before the competent authority.
The authority has been directed to reconsider the matter in the light of the Supreme Court’s directions issued on November 13, 2024, along with subsequent government circulars.
Until a fresh decision is taken, the Agra Divisional Commissioner’s order dated September 4, 2025, will remain stayed.
मथुरा-वृंदावन में वैज्ञानिक भीड़ प्रबंधन की जरूरत, इलाहाबाद हाईकोर्ट ने यूपी सरकार से मांगा विस्तृत जवाब
मथुरा: मथुरा-वृंदावन में धार्मिक आयोजनों के दौरान बार-बार सामने आ रही भगदड़ जैसी घटनाओं पर गंभीर चिंता व्यक्त करते हुए इलाहाबाद हाईकोर्ट ने कहा है कि यहां की वर्तमान भीड़ प्रबंधन व्यवस्था वैज्ञानिक आधार पर विकसित नहीं की गई है।
न्यायालय ने उत्तर प्रदेश सरकार को व्यवस्था में व्यापक सुधार के लिए कई सुझाव दिए हैं और जिम्मेदार अधिकारियों से विस्तृत जवाब तलब किया है।
हाल के वर्षों में होली सहित विभिन्न धार्मिक अवसरों पर उत्पन्न अव्यवस्था का संज्ञान लेते हुए न्यायमूर्ति विनोद दिवाकर की पीठ ने मथुरा-वृंदावन विकास प्राधिकरण (एमवीडीए) के उपाध्यक्ष, जिलाधिकारी, नगर आयुक्त तथा वरिष्ठ पुलिस अधीक्षक को विस्तृत शपथपत्र दाखिल करने का निर्देश दिया है।
अदालत ने उनसे मौजूदा व्यवस्था, उसकी कमियों और सुधारात्मक उपायों की जानकारी मांगी है।
सुनवाई के दौरान न्यायालय ने कहा कि प्रशासन ने भीड़ प्रबंधन को केवल यातायात नियंत्रण तक सीमित कर दिया है, जबकि धार्मिक आयोजनों में उमड़ने वाली भीड़ की प्रकृति पूरी तरह अलग होती है।
अदालत के अनुसार, श्रद्धालु आस्था और भावनाओं में इतने अधिक तल्लीन रहते हैं कि वे संभावित खतरे का समय रहते आकलन नहीं कर पाते।
इसलिए ऐसे आयोजनों के लिए राजनीतिक रैलियों या खेल प्रतियोगिताओं से अलग रणनीति अपनाई जानी चाहिए।
भीड़ विज्ञान से जुड़े अध्ययनों का उल्लेख करते हुए पीठ ने कहा कि जब एक वर्ग मीटर क्षेत्र में चार से पांच लोग मौजूद होते हैं तो व्यक्ति की स्वतंत्र रूप से चलने-फिरने की क्षमता प्रभावित होने लगती है।
यदि यह घनत्व छह से सात व्यक्तियों प्रति वर्ग मीटर तक पहुंच जाए तो दबाव के कारण दम घुटने की स्थिति उत्पन्न हो सकती है।
अदालत ने कहा कि देश के अनेक तीर्थस्थलों पर हुई दुखद घटनाओं में ऐसी परिस्थितियां सामने आ चुकी हैं।
ये टिप्पणियां उस याचिका की सुनवाई के दौरान की गईं, जिसमें वृंदावन में एक कथित अवैध निर्माण को चुनौती दी गई थी।
मामले के व्यापक सार्वजनिक महत्व को देखते हुए अदालत ने इसकी सीमाओं का विस्तार करते हुए मथुरा-वृंदावन में भीड़ प्रबंधन की समग्र व्यवस्था की भी समीक्षा करने का निर्णय लिया।
पीठ ने स्पष्ट कहा कि धार्मिक आयोजनों में होने वाली भगदड़ की घटनाओं को केवल प्रशासनिक लापरवाही या आधारभूत ढांचे की कमी का परिणाम मानना पर्याप्त नहीं होगा।
न्यायालय के अनुसार, भीड़ के व्यवहार और उसके वैज्ञानिक अध्ययन की उपेक्षा ऐसी दुर्घटनाओं की प्रमुख वजहों में शामिल है।
मूल याचिका स्वामी शिव स्वरूपानंद जी महाराज ने दायर की थी। उन्होंने वृंदावन स्थित अपनी भूमि पर बने आश्रम को लेकर जारी ध्वस्तीकरण आदेश को चुनौती दी थी।
सुनवाई के दौरान उनका आरोप था कि क्षेत्र में मौजूद 23 कथित अवैध निर्माणों में से केवल कुछ चुनिंदा मामलों में कार्रवाई की गई, जिससे चयनात्मक कार्रवाई का आभास होता है।
एमवीडीए द्वारा प्रस्तुत आंकड़ों के अनुसार वर्ष 2021-22 से 2025-26 के बीच अवैध निर्माणों के विरुद्ध 2,453 नोटिस जारी किए गए।
इनमें 700 मामलों में ध्वस्तीकरण के आदेश दिए गए, लेकिन केवल 323 मामलों में ही उन्हें लागू किया गया।
इसके अतिरिक्त 104 संपत्तियों को सील किया गया, जबकि 212 मामलों का निस्तारण कंपाउंडिंग के माध्यम से किया गया।
इन आंकड़ों पर टिप्पणी करते हुए अदालत ने कहा कि यह वास्तविक स्थिति का केवल “हिमखंड का ऊपरी हिस्सा” है और समस्या इससे कहीं अधिक व्यापक है।
न्यायालय ने यह भी कहा कि मथुरा जैसे प्राचीन धार्मिक नगरों के विकास के लिए अल्पकालिक दृष्टिकोण पर्याप्त नहीं है।
पीठ के अनुसार, मथुरा, अयोध्या, वाराणसी और चित्रकूट जैसे सांस्कृतिक एवं आध्यात्मिक महत्व वाले शहरों के लिए दीर्घकालिक शहरी नियोजन आवश्यक है और इन्हें सामान्य नगरों की तरह नहीं देखा जा सकता।
अवैध निर्माणों के बढ़ते मामलों पर चिंता व्यक्त करते हुए अदालत ने कहा कि तीर्थस्थलों में इस प्रकार की गतिविधियों के पीछे अक्सर भूमि माफिया, बिल्डर और राजनीतिक संरक्षण का संगठित गठजोड़ सक्रिय रहता है।
न्यायालय ने माना कि ऐसी प्रवृत्तियों पर अंकुश लगाने के लिए केवल कड़े कानून पर्याप्त नहीं होंगे, बल्कि मजबूत संस्थागत इच्छाशक्ति भी आवश्यक है।
याचिकाकर्ता को अंतरिम राहत देते हुए हाईकोर्ट ने उन्हें सक्षम प्राधिकारी के समक्ष नया प्रत्यावेदन प्रस्तुत करने की अनुमति दी।
संबंधित प्राधिकारी को निर्देश दिया गया है कि वह 13 नवंबर 2024 को सुप्रीम कोर्ट द्वारा जारी निर्देशों तथा उसके बाद जारी सरकारी परिपत्रों के आलोक में मामले पर पुनर्विचार करे।
तब तक आगरा मंडलायुक्त द्वारा 4 सितंबर 2025 को पारित आदेश पर रोक जारी रहेगी।
