Allahabad High Court Bans Vehicles, Parking and Fresh Construction Inside Prayagraj’s Chandrashekhar Azad Park

Prayagraj: In a significant interim order aimed at preserving one of Prayagraj’s most treasured green spaces, the Allahabad High Court has prohibited the entry and parking of all vehicles inside Chandrashekhar Azad Park, popularly known as Company Bagh.
The court has also imposed a complete embargo on any fresh construction, whether temporary or permanent, within the park unless prior permission is obtained from the High Court.
A Division Bench comprising Justice Ajit Kumar and Justice Garima Prasad further directed the authorities managing the historic park to ensure that the joggers’ track remains properly maintained, obstruction-free and fully accessible to visitors at all times.
The directions were issued while hearing a public interest petition filed by Bhupendra Pandey, who challenged the proposed construction of a new entrance gate for the Central Museum situated within Chandrashekhar Azad Park.
The petitioner contended that additional construction inside the park would gradually destroy one of the city’s few remaining green belts and diminish its ecological and heritage value.
Describing the park as the “lungs of Prayagraj”, the petitioner argued that the heritage site serves as an essential environmental buffer amid the city’s expanding urban landscape.
He urged the court to protect the park from any activity that could alter its original character or reduce its green cover.
Appearing for the petitioner, counsel submitted that Chandrashekhar Azad Park is a protected heritage zone where no further construction should be permitted.
It was argued that both the Allahabad High Court and the Supreme Court had, in earlier proceedings, emphasised that no new structures should be raised inside the park.
The proposed museum gate, it was further contended, would interfere with and damage the existing jogging track used daily by hundreds of residents.
The petitioner also drew the court’s attention to alleged violations of earlier judicial directions by pointing out that vehicles were regularly being allowed inside the park.
Counsel referred to a Division Bench judgment delivered in 1987 in the Arun Kumar case, which had prohibited both vehicular movement and parking within the park premises.
Opposing the plea, Additional Solicitor General of India S.P. Singh informed the court that another Bench of the High Court had earlier granted permission for opening a gate leading to the National Museum.
He submitted that the proposed work was in accordance with that judicial order.
After considering the rival submissions, the Bench permitted the petitioner to implead the Central Museum, Prayagraj through its Director or In-charge Director as the fifth respondent, the Union of India as the sixth respondent, and Amar Shaheed Chandrashekhar Azad Smriti Udyan, Prayagraj, through its Director as the seventh respondent in the proceedings.
The matter has now been listed for further hearing on August 31.
Passing interim directions, the High Court ordered that, until further orders, no vehicle shall be allowed to enter Chandrashekhar Azad Park except those carrying the Governor or any other high constitutional dignitary visiting the museum.
The Bench also prohibited parking of all other vehicles within the park and directed that no authority, including the museum administration, shall undertake any construction activity without prior approval of the court.
Simultaneously, the authorities were instructed to ensure that the joggers’ track remains fully maintained, free from encroachments and without any obstruction.

इलाहाबाद हाईकोर्ट का बड़ा आदेश: चंद्रशेखर आजाद पार्क में वाहनों की एंट्री, पार्किंग और नए निर्माण पर रोक
प्रयागराज: शहर के ऐतिहासिक एवं पर्यावरणीय दृष्टि से अत्यंत महत्वपूर्ण चंद्रशेखर आजाद पार्क (कंपनी बाग) की सुरक्षा और संरक्षण को लेकर इलाहाबाद हाईकोर्ट ने अहम अंतरिम आदेश पारित किया है।
न्यायालय ने पार्क के भीतर सभी प्रकार के वाहनों के प्रवेश और पार्किंग पर रोक लगा दी है। साथ ही स्पष्ट निर्देश दिया है कि अदालत की पूर्व अनुमति के बिना पार्क परिसर में किसी भी प्रकार का अस्थायी या स्थायी निर्माण कार्य नहीं किया जाएगा।
न्यायमूर्ति अजीत कुमार और न्यायमूर्ति गरिमा प्रसाद की खंडपीठ ने पार्क प्रशासन को यह भी निर्देश दिया कि पार्क के भीतर स्थित जॉगर्स ट्रैक को पूरी तरह सुरक्षित, सुव्यवस्थित और अवरोधमुक्त रखा जाए, ताकि वहां आने वाले लोगों को किसी प्रकार की असुविधा का सामना न करना पड़े।
यह आदेश भूपेंद्र पांडेय द्वारा दायर याचिका पर सुनवाई करते हुए पारित किया गया। याचिका में चंद्रशेखर आजाद पार्क स्थित केंद्रीय संग्रहालय के लिए प्रस्तावित नए प्रवेश द्वार के निर्माण को चुनौती दी गई है।
याचिकाकर्ता का कहना है कि यदि इस प्रकार के निर्माण कार्यों की अनुमति दी गई तो शहर के बीच स्थित इस महत्वपूर्ण हरित क्षेत्र की प्राकृतिक पहचान और विरासत स्वरूप को गंभीर क्षति पहुंचेगी।
याचिका में पार्क को प्रयागराज शहर का फेफड़ा बताते हुए कहा गया कि तेजी से कंक्रीट के जंगल में बदल रहे शहर के बीच यह हरित क्षेत्र पर्यावरणीय संतुलन बनाए रखने में महत्वपूर्ण भूमिका निभाता है।
इसलिए इसके मूल स्वरूप से किसी भी प्रकार की छेड़छाड़ नहीं होनी चाहिए।
याचिकाकर्ता की ओर से अदालत को बताया गया कि पूरा चंद्रशेखर आजाद पार्क संरक्षित विरासत क्षेत्र है, जहां किसी भी नए निर्माण की अनुमति नहीं दी जानी चाहिए।
यह भी दलील दी गई कि पूर्व में इलाहाबाद हाईकोर्ट और सर्वोच्च न्यायालय दोनों ही इस पार्क के भीतर नए निर्माण पर रोक लगाने संबंधी निर्देश दे चुके हैं।
प्रस्तावित नया प्रवेश द्वार बनने से पार्क के भीतर बने जॉगिंग ट्रैक को भी नुकसान पहुंचने की आशंका व्यक्त की गई।
सुनवाई के दौरान यह मुद्दा भी उठाया गया कि पूर्व के न्यायिक आदेशों के बावजूद पार्क के भीतर वाहनों का प्रवेश और पार्किंग जारी है।
याचिकाकर्ता के अधिवक्ता ने वर्ष 1987 में अरुण कुमार मामले में पारित खंडपीठ के आदेश का उल्लेख करते हुए कहा कि उस निर्णय में पार्क परिसर के भीतर वाहनों की आवाजाही और पार्किंग दोनों पर स्पष्ट रोक लगाई गई थी।
दूसरी ओर भारत सरकार की ओर से अतिरिक्त सॉलिसिटर जनरल एस.पी. सिंह ने अदालत को बताया कि हाईकोर्ट की एक अन्य पीठ पहले ही राष्ट्रीय संग्रहालय के लिए प्रवेश द्वार खोले जाने की अनुमति दे चुकी है।
उनका कहना था कि प्रस्तावित कार्य उसी आदेश के अनुरूप है।
दोनों पक्षों की दलीलें सुनने के बाद अदालत ने याचिकाकर्ता को केंद्रीय संग्रहालय, प्रयागराज को उसके निदेशक अथवा प्रभारी निदेशक के माध्यम से पांचवें प्रतिवादी, भारत संघ को छठे प्रतिवादी तथा अमर शहीद चंद्रशेखर आजाद स्मृति उद्यान, प्रयागराज को उसके निदेशक के माध्यम से सातवें प्रतिवादी के रूप में पक्षकार बनाने की अनुमति प्रदान की।
मामले की अगली सुनवाई 31 अगस्त को निर्धारित की गई है।
अंतरिम आदेश में हाईकोर्ट ने स्पष्ट किया कि अगले आदेश तक राज्यपाल अथवा संग्रहालय का दौरा करने वाले अन्य उच्च संवैधानिक पदाधिकारियों के वाहनों को छोड़कर किसी भी वाहन को पार्क में प्रवेश की अनुमति नहीं होगी।
पार्क परिसर में अन्य किसी वाहन की पार्किंग भी पूरी तरह प्रतिबंधित रहेगी। इसके अतिरिक्त न्यायालय ने निर्देश दिया कि संग्रहालय प्रशासन या कोई अन्य एजेंसी अदालत की अनुमति के बिना पार्क में किसी प्रकार का निर्माण कार्य नहीं करेगी।
साथ ही पार्क प्रबंधन को जॉगर्स ट्रैक को पूरी तरह सुरक्षित, सुव्यवस्थित और बाधारहित बनाए रखने के निर्देश भी दिए गए।
