Allahabad High Court Judge Links Ram Temple Donation Theft to Corruption Crisis, Calls for Tougher Anti-Graft Measures

Prayagraj: In a strongly worded opinion delivered as part of a split verdict on the issue of “bulldozer justice”, Allahabad High Court Judge Justice Atul Sreedharan made sweeping observations on corruption, public morality and governance, remarking that the alleged theft of donations at the Ram Temple in Ayodhya reflected what he described as the lowest point of integrity in Indian society.
While examining the broader issue of unlawful demolitions, Justice Sreedharan observed that a society which remains unmoved by allegations relating to the theft of donations at one of the country’s most revered religious sites cannot easily be shamed.
Referring to the reported controversy surrounding the alleged Ram Temple donation theft, he described it as the proverbial “last straw on the camel’s back” and said it symbolised a disturbing decline in ethical values.
Explaining the reasoning behind his remarks, the judge said corruption had become so deeply embedded in public life that many people no longer considered it morally unacceptable unless those involved were caught.
He also referred to Transparency International’s 2025 Corruption Perceptions Index, noting that India’s reported ranking of 91st among 182 countries had failed to generate the level of public concern such findings deserved.
Expressing grave concern over the normalisation of corruption, Justice Sreedharan suggested that if the government was genuinely determined to eradicate graft, it should consider introducing far stricter legal provisions.
He opined that the Prevention of Corruption Act, 1988, could be amended to provide the death penalty for those convicted of corruption, describing it as an extreme but serious legislative option.
These observations formed part of Justice Sreedharan’s 51-page opinion in a split verdict dealing with the controversial practice commonly referred to as “bulldozer justice”, where houses belonging to accused persons are demolished, often citing alleged violations of municipal laws.
Discussing the circumstances surrounding such demolitions, the judge observed that razing residential properties immediately after the registration of a criminal case often appeared intended to satisfy what he described as the “perceived blood lust” of a society increasingly accustomed to bulldozer-driven punitive action rather than due legal process.
Justice Sreedharan further noted that despite repeated interventions by the Supreme Court, demolition drives have continued in several instances without apparent concern for judicial directions.
He remarked that such actions created the impression that the judgments of the country’s highest court either did not exist or could be ignored without any adverse consequences.
Turning to the issue of illegal constructions, the judge pointed out that unauthorised buildings do not appear overnight.
According to him, officials entrusted with preventing such developments frequently fail to act because of political influence, bureaucratic protection or dishonest conduct, allowing violations to continue unchecked.
The court also observed that corrupt practices among officials enable unauthorised housing projects to flourish.
Justice Sreedharan remarked that builders allegedly obtain illegal approvals by paying bribes, while ordinary homebuyers ultimately bear the consequences when enforcement agencies initiate demolition proceedings years later.
Making a broader institutional observation, the judge stated that the State itself becomes particeps criminis—a legal expression referring to an accomplice—when it knowingly allows such illegal constructions to survive by providing essential public services such as electricity and water despite apparent violations.
He added that this collective erosion of integrity had affected numerous public institutions, including development authorities.
Justice Sreedharan warned that widespread corruption would eventually result in the unlawful concentration of wealth in the hands of a limited section of society, widening economic inequality and creating conditions that could trigger social unrest in the future.
Reiterating his concern over the long-term consequences of systemic corruption, the judge said that if the government was genuinely committed to restoring honesty and accountability in public life, it should seriously consider adopting stronger legislative measures, including amendments to anti-corruption laws, to create a far more effective deterrent.
Addressing the specific issue before the Bench, Justice Sreedharan proposed that authorities should not be permitted to demolish the house of an accused person for two years from the date of registration of an FIR, so that due legal process is not undermined.
However, the other member of the Division Bench, Justice Siddharth Nandan, disagreed with this particular direction, resulting in a split verdict on the issue.

प्रयागराज: इलाहाबाद हाईकोर्ट के न्यायमूर्ति अतुल श्रीधरन ने ‘बुलडोजर न्याय’ से जुड़े मामले में दिए गए अपने विभाजित फैसले में भ्रष्टाचार, प्रशासनिक व्यवस्था और सामाजिक नैतिकता पर तीखी टिप्पणी करते हुए कहा कि अयोध्या स्थित राम मंदिर में दान चोरी का कथित मामला भारतीय समाज की ईमानदारी के सबसे निचले स्तर का प्रतीक बनकर सामने आया है।
मामले की सुनवाई के दौरान न्यायमूर्ति श्रीधरन ने कहा कि यदि किसी समाज पर देश के सबसे प्रतिष्ठित धार्मिक स्थलों में से एक में दान चोरी के आरोपों का भी कोई नैतिक प्रभाव नहीं पड़ता, तो उसे शर्मिंदा करना लगभग असंभव है।
उन्होंने राम मंदिर दान चोरी विवाद का उल्लेख करते हुए इसे “ऊंट की कमर तोड़ने वाली अंतिम तिनके” जैसी स्थिति बताया और कहा कि यह समाज में नैतिक मूल्यों के गंभीर पतन को दर्शाता है।
अपने विचारों को विस्तार देते हुए न्यायाधीश ने कहा कि भ्रष्टाचार अब समाज में इस हद तक सामान्य हो चुका है कि अधिकांश लोग इसे तब तक गलत नहीं मानते जब तक दोषी पकड़ा न जाए।
उन्होंने ट्रांसपेरेंसी इंटरनेशनल की वर्ष 2025 की भ्रष्टाचार धारणा सूचकांक रिपोर्ट का हवाला देते हुए कहा कि 182 देशों में भारत का 91वां स्थान भी समाज को आत्ममंथन के लिए पर्याप्त रूप से प्रेरित नहीं कर सका।
भ्रष्टाचार की बढ़ती स्वीकार्यता पर गहरी चिंता व्यक्त करते हुए न्यायमूर्ति श्रीधरन ने सुझाव दिया कि यदि सरकार वास्तव में इस समस्या का स्थायी समाधान चाहती है तो उसे अधिक कठोर कानूनी प्रावधानों पर विचार करना चाहिए।
उन्होंने मत व्यक्त किया कि भ्रष्टाचार निवारण अधिनियम, 1988 में संशोधन कर भ्रष्टाचार के मामलों में दोषसिद्ध व्यक्तियों के लिए मृत्युदंड का प्रावधान करने पर भी विचार किया जा सकता है।
ये टिप्पणियां न्यायमूर्ति श्रीधरन द्वारा लिखे गए 51 पृष्ठों के विस्तृत निर्णय का हिस्सा हैं, जिसमें उन मामलों की समीक्षा की गई है जहां कथित तौर पर आपराधिक मामलों में आरोपित व्यक्तियों के मकानों को नगर निकाय नियमों के उल्लंघन का हवाला देकर ध्वस्त किया गया।
बुलडोजर कार्रवाई के संदर्भ में न्यायाधीश ने कहा कि किसी अपराध का मामला दर्ज होते ही मकान गिरा देना कई बार न्यायिक प्रक्रिया से अधिक समाज की उस मानसिकता को संतुष्ट करने का प्रयास प्रतीत होता है, जिसे उन्होंने ‘बुलडोजर न्याय’ की संस्कृति से जोड़कर देखा।
उन्होंने यह भी कहा कि सुप्रीम कोर्ट द्वारा समय-समय पर दिए गए स्पष्ट निर्देशों के बावजूद कई मामलों में ध्वस्तीकरण की कार्रवाई जारी रही।
न्यायमूर्ति श्रीधरन के अनुसार इससे यह संदेश जाता है मानो सर्वोच्च न्यायालय के आदेशों की कोई अहमियत नहीं है या फिर उन्हें नजरअंदाज करने पर संबंधित अधिकारियों को किसी प्रकार का दुष्परिणाम नहीं भुगतना पड़ेगा।
अवैध निर्माणों की समस्या पर टिप्पणी करते हुए न्यायाधीश ने कहा कि कोई भी अनधिकृत भवन एक ही रात में खड़ा नहीं हो जाता।
उनके अनुसार ऐसे निर्माण इसलिए संभव हो पाते हैं क्योंकि उन्हें रोकने की जिम्मेदारी निभाने वाले अधिकारी राजनीतिक संरक्षण, प्रशासनिक दबाव या व्यक्तिगत बेईमानी के कारण जानबूझकर आंखें मूंद लेते हैं।
अदालत ने यह भी कहा कि भ्रष्ट अधिकारी कथित रूप से रिश्वत लेकर अवैध निर्माणों को बढ़ावा देते हैं, जबकि वर्षों बाद जब कार्रवाई होती है तो सबसे अधिक नुकसान उन आम लोगों को उठाना पड़ता है जिन्होंने वैध संपत्ति समझकर मकान खरीदा होता है।
व्यापक संस्थागत जिम्मेदारी का उल्लेख करते हुए न्यायमूर्ति श्रीधरन ने कहा कि जब राज्य स्वयं ऐसे निर्माणों को बिजली, पानी और अन्य बुनियादी सुविधाएं उपलब्ध कराता है, तब वह भी पार्टिसेप्स क्रिमिनिस अर्थात अपराध में सहभागी की स्थिति में आ जाता है।
उन्होंने कहा कि ईमानदारी का यह सामूहिक क्षरण विकास प्राधिकरणों सहित अनेक सार्वजनिक संस्थानों को प्रभावित कर चुका है।
न्यायमूर्ति श्रीधरन ने चेतावनी दी कि यदि भ्रष्टाचार इसी तरह बढ़ता रहा तो अवैध तरीके से संपत्ति कुछ चुनिंदा लोगों के हाथों में सिमटती जाएगी। इससे आर्थिक असमानता और गहरी होगी तथा भविष्य में सामाजिक अशांति की परिस्थितियां उत्पन्न हो सकती हैं।
अपने निष्कर्ष में उन्होंने कहा कि यदि सरकार वास्तव में सार्वजनिक जीवन में पारदर्शिता और ईमानदारी स्थापित करना चाहती है तो उसे भ्रष्टाचार के विरुद्ध कठोर और प्रभावी विधायी उपायों पर गंभीरता से विचार करना चाहिए, ताकि व्यवस्था में वास्तविक सुधार लाया जा सके।
मूल विवाद पर अपना मत व्यक्त करते हुए न्यायमूर्ति श्रीधरन ने सुझाव दिया कि किसी भी आरोपी के खिलाफ एफआईआर दर्ज होने की तारीख से दो वर्ष तक उसके मकान के विरुद्ध ध्वस्तीकरण जैसी कार्रवाई नहीं की जानी चाहिए, जिससे विधिक प्रक्रिया निष्पक्ष रूप से आगे बढ़ सके।
हालांकि, उनके साथ पीठ में शामिल न्यायमूर्ति सिद्धार्थ नंदन ने इस विशेष प्रस्ताव से असहमति जताई, जिसके कारण इस मुद्दे पर विभाजित निर्णय सामने आया।
