Allahabad High Court Orders Immediate Release of Noida Man, Rebukes Police Over ‘Illegal’ Detention

Court questions sequence of detention, arrest and notice under BNSS; police officials face sharp criticism over procedural lapses

PRAYAGRAJ: The Allahabad High Court has ordered the immediate release of a man who challenged his detention by the Noida Police, holding that the manner in which he was taken into custody and subsequently shown as arrested raised serious questions about the legality of the police action.

A division bench comprising Justice Atul Sridharan and Justice Achal Sachdeva expressed strong displeasure with the conduct of the police officials during the hearing of a habeas corpus petition filed by Deepak, a resident of Gautam Buddh Nagar.

The bench orally criticised the police for the manner in which the proceedings had been handled and remarked that the condition of policing in the state was “very bad”.

The judges also questioned whether police officers believed they could act without following the prescribed legal procedure.

The case arose from an incident of violence involving two groups on August 23. According to the police records placed before the court, police initially took Deepak and four others into custody under Sections 126, 135 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

An FIR was subsequently registered on the basis of a written complaint submitted by Shivram Sharma. A key issue before the court was the sequence in which the detention and arrest took place.

According to the petition, Deepak was already in police custody before the FIR was registered. The FIR later listed him as formally arrested in the same case, even as he remained in police custody.

The petition also contended that although several individuals were named in the FIR, Deepak’s name did not figure in it and no specific role had been attributed to him.

Court questions timing of BNSS notice

The bench also examined the circumstances surrounding a notice issued under Section 130 of the BNSS. The petitioner alleged that the Executive Magistrate issued the notice to him on August 24, even though he had already been taken into custody on August 23.

The timing of the notice had previously come under scrutiny during the hearing on October 5. The court had questioned how a notice that was allegedly required before the detention could have been issued after the person had already been taken into custody.

The bench observed that the Assistant Commissioner of Police-I, Gautam Buddh Nagar, would have to explain the sequence of events.

The officer was consequently directed to appear before the court personally and produce all records connected with proceedings under Sections 126, 135 and 170 of the BNSS.

Police questioned over lawyer access and bail documentation

The court also took note of an alleged failure to inform the arrested persons that they could meet a lawyer of their choice during interrogation.

DSP Kamlesh Kant, ACP-II, Central Noida, appeared before the bench in connection with the proceedings.

The judges questioned the police about the manner in which the bail bond procedure had been recorded.

According to the court’s observations, the police records did not show that Deepak had been asked whether he was willing to furnish bail or what amount he was prepared to provide as bail security.

The arrest documents also allegedly did not specify any particular bail amount. The bench expressed dissatisfaction over what it considered inadequate documentation of the procedure and sharply rebuked the officials.

Petition alleges continuous custody despite release order

Deepak’s petition stated that he had remained in police custody from August 23 and that, despite an order for his release on August 24, he was never actually set free.

Instead, the petition alleged, he continued to remain under the physical control of the police and was subsequently shown as arrested in Case Crime No. 370.

The petitioner challenged the legality of the entire sequence, including his initial detention, subsequent arrest and remand. He also pointed to discrepancies in the arrest documentation.

One of the alleged discrepancies concerned the arrest memo. The petition claimed that although the arrest was recorded as having taken place on August 24, the document carried a signature or date corresponding to August 23.

The petitioner argued that an arrest which was unlawful at the outset could not automatically become legal merely because a subsequent remand order had been obtained.

After considering the circumstances surrounding the detention and the procedural irregularities highlighted before it, the High Court allowed the habeas corpus petition and directed that Deepak be released immediately.

इलाहाबाद हाईकोर्ट ने नोएडा पुलिस को फटकारा, अवैध हिरासत में रखे दीपक की तत्काल रिहाई का आदेश

हिरासत, गिरफ्तारी और BNSS नोटिस के क्रम पर उठे गंभीर सवाल; पुलिस की कार्रवाई और दस्तावेजीकरण पर अदालत ने जताई नाराजगी

प्रयागराज: इलाहाबाद हाईकोर्ट ने नोएडा पुलिस की हिरासत को चुनौती देने वाली बंदी प्रत्यक्षीकरण याचिका स्वीकार करते हुए दीपक को तत्काल रिहा करने का आदेश दिया है। अदालत ने पुलिस की ओर से हिरासत में लेने और बाद में गिरफ्तारी दिखाए जाने की प्रक्रिया पर गंभीर सवाल उठाए।

न्यायमूर्ति अतुल श्रीधरन और न्यायमूर्ति अचल सचदेव की खंडपीठ ने गौतम बुद्ध नगर निवासी दीपक की याचिका पर सुनवाई की। सुनवाई के दौरान पुलिस की कार्रवाई को लेकर अदालत ने कड़ी नाराजगी जताई और अधिकारियों के काम करने के तरीके पर तीखी मौखिक टिप्पणी की।

मामला 23 अगस्त को दो गुटों के बीच हुई हिंसा की घटना से जुड़ा है। पुलिस रिकॉर्ड के अनुसार दीपक और चार अन्य लोगों को भारतीय नागरिक सुरक्षा संहिता (BNSS) की धारा 126, 135 और 170 के तहत हिरासत में लिया गया था।

इसके बाद शिवराम शर्मा की लिखित शिकायत के आधार पर एफआईआर दर्ज की गई। याचिका में पुलिस की कार्रवाई के घटनाक्रम को चुनौती देते हुए कहा गया कि एफआईआर दर्ज होने से पहले ही दीपक पुलिस की हिरासत में था।

याचिका के अनुसार बाद में उसी हिरासत के दौरान दीपक को संबंधित मुकदमे में औपचारिक रूप से गिरफ्तार दिखा दिया गया। याचिकाकर्ता का यह भी दावा था कि एफआईआर में कई लोगों के नाम दर्ज थे, लेकिन उसमें उसका नाम नहीं था और उसके खिलाफ किसी विशेष भूमिका का उल्लेख भी नहीं किया गया था।

नोटिस जारी करने के समय पर अदालत का सवाल

मामले में BNSS की धारा 130 के तहत जारी नोटिस भी अदालत के सामने महत्वपूर्ण मुद्दा रहा। याचिका के मुताबिक कार्यकारी मजिस्ट्रेट ने दीपक को 24 अगस्त को यह नोटिस जारी किया, जबकि पुलिस उसे एक दिन पहले ही हिरासत में ले चुकी थी।

पांच अक्टूबर की सुनवाई में भी हाईकोर्ट ने इस घटनाक्रम पर सवाल उठाया था। अदालत ने पूछा था कि यदि हिरासत से पहले संबंधित नोटिस जारी किया जाना आवश्यक था, तो व्यक्ति को पहले ही हिरासत में लेने के बाद ऐसा नोटिस कैसे जारी किया गया।

इस मामले में स्थिति स्पष्ट करने के लिए अदालत ने गौतम बुद्ध नगर के एसीपी-1 को व्यक्तिगत रूप से उपस्थित होने और धारा 126, 135 तथा 170 के तहत हुई पूरी कार्रवाई से जुड़े दस्तावेज पेश करने का निर्देश दिया।

वकील से मिलने के अधिकार और जमानत प्रक्रिया पर भी सवाल

सुनवाई के दौरान अदालत ने इस बात पर भी आपत्ति जताई कि गिरफ्तार किए गए लोगों को पूछताछ के दौरान अपनी पसंद के वकील से मिलने के अधिकार की जानकारी दिए जाने का कोई स्पष्ट रिकॉर्ड सामने नहीं आया।

डीएसपी कमलेश कांत, एसीपी-2, सेंट्रल नोएडा, अदालत के समक्ष पेश हुए। खंडपीठ ने पुलिस से जमानत बांड की प्रक्रिया के दस्तावेजीकरण के बारे में भी सवाल किए।

अदालत के अनुसार पुलिस रिकॉर्ड में यह स्पष्ट नहीं था कि दीपक से जमानत देने की उसकी इच्छा के बारे में पूछा गया था या नहीं। गिरफ्तारी संबंधी रिकॉर्ड में जमानत के लिए किसी निश्चित राशि का उल्लेख भी नहीं पाया गया।

पुलिस द्वारा अपनाई गई प्रक्रिया के रिकॉर्ड और दस्तावेजीकरण से अदालत संतुष्ट नहीं थी। इसी दौरान खंडपीठ ने पुलिस अधिकारियों को कड़ी फटकार लगाई।

याचिका में लगातार हिरासत में रखने का आरोप

दीपक की याचिका में दावा किया गया कि वह 23 अगस्त से पुलिस के कब्जे में था। याचिका के मुताबिक 24 अगस्त को उसकी रिहाई का आदेश होने के बावजूद उसे वास्तविक रूप से पुलिस हिरासत से बाहर नहीं किया गया।

आरोप है कि इसके बाद भी वह पुलिस के प्रत्यक्ष नियंत्रण में रहा और बाद में केस क्राइम नंबर 370 में उसकी गिरफ्तारी दर्शाई गई।

याचिका में गिरफ्तारी, लगातार हिरासत और उसके बाद किए गए रिमांड की वैधता पर भी सवाल उठाए गए। इसमें पुलिस की गिरफ्तारी संबंधी दस्तावेजों में कथित विसंगतियों का उल्लेख किया गया।

याचिका में विशेष रूप से दावा किया गया कि 24 अगस्त की गिरफ्तारी दर्ज करने वाले गिरफ्तारी मेमो पर 23 अगस्त की तारीख या हस्ताक्षर दर्ज थे। याचिकाकर्ता ने तर्क दिया कि यदि किसी व्यक्ति को शुरू में गैरकानूनी तरीके से गिरफ्तार या हिरासत में लिया गया हो, तो बाद में जारी किया गया रिमांड आदेश उस शुरुआती कार्रवाई को अपने आप वैध नहीं बना देता।

मामले में पुलिस की कार्रवाई, हिरासत के क्रम और रिकॉर्ड में सामने आई प्रक्रियागत खामियों पर विचार करने के बाद हाईकोर्ट ने बंदी प्रत्यक्षीकरण याचिका मंजूर कर ली और दीपक को तत्काल रिहा करने का आदेश दिया।
