Allahabad High Court Orders Independent Probe Into Caste Discrimination Allegations at NLU Prayagraj
Court bars Law HOD-Warden from administrative, evaluation and hostel-related roles involving petitioners; independent committee ordered to reassess students’ answer sheets.

PRAYAGRAJ: The Allahabad High Court has ordered an independent inquiry into allegations of caste-based humiliation and discrimination raised by two students of Dr. Rajendra Prasad National Law University (RPNLU), Prayagraj, bringing the university’s handling of complaints and academic evaluation under judicial scrutiny.
Justice Vinod Diwakar, while hearing the petition, directed two judicial officers from Prayagraj to conduct an independent inquiry into the allegations.
The court has also ordered a fresh evaluation of the answer sheets of one of the students by a separate committee.
The court, however, made it clear that its order should not be understood as a finding that the allegations are established.
The claims are to be examined through an independent process in which the persons against whom allegations have been made will have an opportunity to respond.
The case was brought before the court by Shubhendu Anand, a PhD research scholar, and another student pursuing the fifth semester of the BA LLB (Hons.) programme.
The latter also resides in the university’s boys’ hostel.
Allegations against Law department head
The students have alleged that the Head of the Department of Law and Warden of the Boys’ Hostel, who has been made respondent number six in the case, misused academic and administrative authority in a manner that they described as caste-based humiliation and retaliation.
The fifth-semester student had approached the university’s Vice-Chancellor on August 20, 2026, alleging that his complaints had not received an effective response despite repeated representations and reminders.
One of the issues raised by the student concerns the evaluation of his answer sheets. He claimed that he had obtained the highest marks in Constitutional Law-I and that Constitutional Law-II was considered a gold-medal subject.
According to his complaint, the concerned faculty member allegedly made a remark at the beginning of the fourth semester suggesting that the student who had topped Constitutional Law should now try to secure the highest marks in his subject as well.
The student has alleged that his answer scripts were subsequently evaluated more harshly because of his caste. He has also accused the faculty member of making remarks in public relating to caste and reservation.
These allegations remain subject to investigation.
Two judicial officers to conduct inquiry
The High Court has entrusted the inquiry to Archana Singh-I, Judge of the Small Cause Court, District Court, Prayagraj, and Arun Kumar Yadava, Special Chief Judicial Magistrate, Prayagraj.
The inquiry will examine whether students belonging to Scheduled Caste or Scheduled Tribe communities were subjected to caste-based humiliation or discrimination by the concerned HOD-Warden or any other person employed by or working at the university.
The officers will also examine whether complaints relating to such alleged treatment were dealt with by the university in accordance with the applicable rules and regulations.
The inquiry officers have been directed to hear the concerned parties before reaching any adverse conclusion. The proceedings are also to maintain the confidentiality of students who provide evidence.
Independent re-evaluation of answer sheets
Apart from the broader inquiry, the court has directed the Vice-Chancellor to establish a separate independent committee to reassess the answer sheets of the fifth-semester student.
The review will cover subjects taught and evaluated by the concerned HOD-Warden during the fifth semester, along with any other subjects specifically identified by the student.
The faculty member against whom the allegations have been made will have no role in the constitution or functioning of the re-evaluation committee. The committee will independently examine the student’s answer scripts.
The court has also directed that the student’s academic interests be protected during the proceedings.
HOD-Warden relieved of administrative responsibilities
In a significant interim direction, the High Court ordered that the concerned HOD-Warden be relieved of all administrative responsibilities until completion of the inquiries.
The court has additionally prohibited the faculty member from taking part in the evaluation of the petitioner’s answer scripts or handling disciplinary or hostel-related matters involving either of the two petitioners.
The court also directed that neither student should face adverse academic or administrative consequences merely because they approached the High Court or participated in the inquiry.
University asked about the grievance mechanism.
The Vice-Chancellor has further been directed to inform the High Court whether the university has constituted an Equal Opportunity Cell and a committee for addressing grievances of SC/ST students under the applicable University Grants Commission regulations.
The university has been asked to provide details about the composition of these bodies and explain what action was taken on the student’s complaint.
The directions are aimed at determining not only the facts behind the individual allegations but also whether the university’s institutional mechanisms for addressing complaints from SC/ST students were functioning in accordance with the applicable rules.
Court to hear matter again on September 24
The High Court’s order was passed on September 16, 2026, and the case has been listed for further hearing on September 24.
The proceedings will now depend on the findings of the independent inquiry and the fresh academic evaluation ordered by the court.
For the moment, the allegations remain allegations, with the High Court expressly leaving their truthfulness to be determined through the inquiry process.

प्रयागराज: डॉ. राजेंद्र प्रसाद राष्ट्रीय विधि विश्वविद्यालय (RPNLU), प्रयागराज में दो छात्रों द्वारा लगाए गए कथित जातिगत अपमान और भेदभाव के आरोपों पर इलाहाबाद हाईकोर्ट ने स्वतंत्र जांच के आदेश दिए हैं।
अदालत के निर्देश के बाद विश्वविद्यालय में शिकायतों के निस्तारण और छात्र के शैक्षणिक मूल्यांकन को लेकर भी जांच की जाएगी।
न्यायमूर्ति विनोद दीवाकर ने मामले की सुनवाई करते हुए प्रयागराज के दो न्यायिक अधिकारियों को आरोपों की स्वतंत्र जांच करने की जिम्मेदारी सौंपी है।
इसके साथ ही अदालत ने एक छात्र की उत्तर पुस्तिकाओं का नए सिरे से स्वतंत्र मूल्यांकन कराने का भी निर्देश दिया है।
हालांकि, हाईकोर्ट ने स्पष्ट किया है कि उसके आदेश को आरोपों की सत्यता पर किसी निष्कर्ष के रूप में नहीं देखा जाना चाहिए।
अदालत ने कहा है कि आरोपों की निष्पक्ष जांच आवश्यक है और जिन लोगों के खिलाफ शिकायत की गई है, उन्हें अपना पक्ष रखने का अवसर दिया जाना चाहिए।
दो छात्रों ने लगाए गंभीर आरोप
मामला शुभेंदु आनंद और एक अन्य छात्र की याचिका से जुड़ा है। शुभेंदु आनंद पीएचडी शोधार्थी हैं, जबकि दूसरे याचिकाकर्ता पांचवें सेमेस्टर के बीए एलएलबी (ऑनर्स) के छात्र हैं और विश्वविद्यालय के बॉयज हॉस्टल में रहते हैं।
याचिकाकर्ताओं का आरोप है कि विधि विभाग के प्रमुख और बॉयज हॉस्टल के वार्डन ने अपने शैक्षणिक और प्रशासनिक अधिकारों का इस्तेमाल कथित तौर पर जातिगत अपमान और प्रतिशोध के लिए किया।
पांचवें सेमेस्टर के छात्र ने 20 अगस्त 2026 को विश्वविद्यालय के कुलपति को शिकायत दी थी। उसका आरोप था कि बार-बार शिकायत और अनुस्मारक देने के बावजूद उसकी शिकायत पर प्रभावी कार्रवाई नहीं की गई।
उत्तर पुस्तिकाओं के मूल्यांकन पर भी सवाल
छात्र ने अपनी शिकायत में कहा था कि उसने संवैधानिक कानून-I में सबसे अधिक अंक हासिल किए थे और संवैधानिक कानून-II को गोल्ड मेडल से जुड़ा विषय बताया था।
छात्र के अनुसार चौथे सेमेस्टर की शुरुआत में संबंधित शिक्षक ने कथित तौर पर ऐसी टिप्पणी की थी जिसका आशय था कि संवैधानिक कानून में सबसे अधिक अंक हासिल करने वाला छात्र अब उनके विषय में भी सबसे अधिक अंक हासिल करके दिखाए।
छात्र ने आरोप लगाया कि इसके बाद उसकी उत्तर पुस्तिकाओं का मूल्यांकन उसकी जाति के कारण कथित रूप से अधिक कठोर तरीके से किया गया। उसने संबंधित शिक्षक पर सार्वजनिक रूप से जाति और आरक्षण को लेकर अपमानजनक टिप्पणियां करने का भी आरोप लगाया है।
इन आरोपों की सत्यता का निर्धारण अभी जांच के बाद होना है।
दो न्यायिक अधिकारी करेंगे जांच
हाईकोर्ट ने मामले की जांच के लिए अर्चना सिंह-I, न्यायाधीश, लघु वाद न्यायालय, जिला न्यायालय प्रयागराज और अरुण कुमार यादव, विशेष मुख्य न्यायिक मजिस्ट्रेट, प्रयागराज को जिम्मेदारी दी है।
जांच में यह पता लगाया जाएगा कि क्या अनुसूचित जाति या अनुसूचित जनजाति से संबंधित छात्रों को संबंधित HOD-वार्डन या विश्वविद्यालय में कार्यरत किसी अन्य व्यक्ति द्वारा कथित तौर पर जातिगत अपमान या भेदभाव का सामना करना पड़ा।
इसके साथ ही यह भी जांच का विषय होगा कि ऐसी शिकायतें मिलने के बाद विश्वविद्यालय ने लागू नियमों और विनियमों के अनुसार उनका निस्तारण किया या नहीं।
जांच अधिकारियों को किसी व्यक्ति के खिलाफ प्रतिकूल निष्कर्ष निकालने से पहले उसका पक्ष सुनने का निर्देश दिया गया है। जांच के दौरान बयान देने वाले छात्रों की पहचान की गोपनीयता बनाए रखने के लिए भी निर्देश दिए गए हैं।
छात्र की उत्तर पुस्तिकाओं का होगा स्वतंत्र पुनर्मूल्यांकन
जातिगत भेदभाव के आरोपों की जांच के अलावा हाईकोर्ट ने पांचवें सेमेस्टर के छात्र की उत्तर पुस्तिकाओं के स्वतंत्र पुनर्मूल्यांकन का भी आदेश दिया है।
इसके लिए कुलपति को एक अलग स्वतंत्र समिति गठित करनी होगी। यह समिति उन विषयों की उत्तर पुस्तिकाओं की दोबारा जांच करेगी जिन्हें संबंधित HOD-वार्डन ने पांचवें सेमेस्टर में पढ़ाया और मूल्यांकन किया था।
छात्र द्वारा बताए गए अन्य संबंधित विषयों को भी इस प्रक्रिया में शामिल किया जा सकता है।
जिस शिक्षक के खिलाफ आरोप लगाए गए हैं, उन्हें इस पुनर्मूल्यांकन समिति के गठन या उसकी कार्यवाही में कोई भूमिका नहीं दी जाएगी।
अदालत ने यह भी सुनिश्चित करने को कहा है कि मामले की वजह से छात्र को किसी प्रकार के प्रतिकूल शैक्षणिक या प्रशासनिक परिणाम का सामना न करना पड़े।
HOD-वार्डन की प्रशासनिक जिम्मेदारियां हटाईं
हाईकोर्ट ने अंतरिम तौर पर एक महत्वपूर्ण निर्देश देते हुए संबंधित HOD-वार्डन को जांच पूरी होने तक सभी प्रशासनिक जिम्मेदारियों से मुक्त करने का आदेश दिया है।
इसके अलावा उन्हें याचिकाकर्ता छात्र की उत्तर पुस्तिकाओं के मूल्यांकन से दूर रखने का निर्देश दिया गया है।
दोनों याचिकाकर्ताओं से जुड़े किसी भी अनुशासनात्मक या हॉस्टल संबंधी मामले में भी उनकी भूमिका नहीं होगी।
अदालत ने विश्वविद्यालय को यह भी सुनिश्चित करने को कहा है कि हाईकोर्ट का दरवाजा खटखटाने या जांच के दौरान बयान देने के कारण दोनों छात्रों के खिलाफ कोई प्रतिकूल शैक्षणिक या प्रशासनिक कार्रवाई न हो।
विश्वविद्यालय से Equal Opportunity Cell पर मांगी जानकारी
हाईकोर्ट ने कुलपति से यह भी जानकारी मांगी है कि क्या विश्वविद्यालय में लागू UGC नियमों के तहत Equal Opportunity Cell और SC/ST छात्रों की शिकायतों के निवारण के लिए समिति गठित की गई है।
विश्वविद्यालय को इन संस्थाओं की संरचना, सदस्यों की जानकारी और छात्र की शिकायत पर अब तक की गई कार्रवाई का विवरण भी अदालत के समक्ष रखने को कहा गया है।
इससे अदालत न केवल व्यक्तिगत शिकायतों की स्थिति की जांच करेगी, बल्कि यह भी देखेगी कि विश्वविद्यालय में SC/ST छात्रों की शिकायतों के समाधान के लिए निर्धारित संस्थागत व्यवस्था प्रभावी रूप से काम कर रही है या नहीं।
24 सितंबर को फिर होगी सुनवाई
इलाहाबाद हाईकोर्ट ने यह आदेश 16 सितंबर 2026 को पारित किया था। मामले की अगली सुनवाई 24 सितंबर 2026 को निर्धारित की गई है।
अब मामले में आगे की स्थिति स्वतंत्र जांच और छात्र की उत्तर पुस्तिकाओं के पुनर्मूल्यांकन की रिपोर्ट पर निर्भर करेगी।
फिलहाल हाईकोर्ट ने आरोपों की सत्यता पर कोई अंतिम राय नहीं दी है और उनके सही या गलत होने का निर्धारण जांच प्रक्रिया के माध्यम से किया जाना है।
