Allahabad High Court Orders Transfer of Criminal Cases Against Advocates, Voices Alarm Over Criminalisation of Legal Profession

Prayagraj: In a landmark order aimed at safeguarding the integrity of the justice delivery system, the Allahabad High Court has directed that all criminal cases registered against practising advocates in Uttar Pradesh be transferred from the districts where they practise to nearby districts where they are unlikely to wield professional influence.

The court said the measure is intended to ensure impartial investigation and fair judicial proceedings while preventing any undue pressure on witnesses or the justice system.

Laying down the framework for such transfers, the High Court directed that the transferee district should ordinarily be located within 100 kilometres of the advocate’s district of practice.

According to the court, this distance is sufficient to prevent professional influence from extending into the new jurisdiction, while at the same time ensuring that advocates, witnesses and other parties are not subjected to unnecessary hardship during the trial.

The directions were issued by Justice Vinod Diwakar while dismissing a petition filed by Etawah-based advocate Mahammad Kafeel.

The court directed that the matter be listed again on August 20, 2026, for review of compliance.

It also instructed the Registrar (Compliance) to place a consolidated report before the court detailing the implementation of its directions across the state.

Making strong observations on the declining standards within sections of the legal fraternity, Justice Diwakar remarked that the rule of law suffers its gravest setback when those entrusted with protecting it themselves become accused of criminal conduct, or when judicial institutions fail to respond firmly to such developments.

The court emphasised that silence in the face of institutional decay weakens public confidence in the justice delivery system.

Expressing deep concern over the growing criminalisation of the legal profession, the court observed that office-bearers with criminal antecedents were reportedly holding influential positions in certain Bar Associations, including those in Gorakhpur and Kanpur.

It further noted that organised groups of law graduates enrolled with Bar Councils had allegedly established themselves in several district courts, where they were accused of intimidating litigants, coercively settling disputes, executing court decrees through unlawful means and forcibly evicting tenants and property occupants.

The High Court also expressed concern that many district judges had been reluctant to take effective action against such elements.

According to the order, this hesitation appeared to stem from the perception that these groups enjoyed political patronage and protection from influential pressure groups, thereby creating an atmosphere that discouraged firm judicial intervention.

Highlighting the wider institutional impact, the court observed that the prevailing environment had become increasingly challenging for young advocates and newly appointed judicial officers.

It noted that the presence of small but influential groups allegedly involved in unlawful activities was adversely affecting the independence, fairness, and professional growth of honest members of the legal community.

The judgment also criticised the report submitted by the Bar Council of Uttar Pradesh regarding verification of advocates’ educational qualifications.

The report identified only 105 advocates, out of nearly five lakh enrolled lawyers, as having obtained enrolment through allegedly forged academic degrees.

The court described the findings as appearing superficial and disproportionate to the scale of the issue.

Questioning the credibility of the verification exercise, the High Court observed that considering the widespread prevalence of forged educational documents, enrolments spanning more than three decades between 1991 and 2023, and the repeated misuse of the names of reputed institutions, including Allahabad University, the actual number of advocates practising based on fake qualifications was likely to be substantially higher than the figure reported.

Although the order was passed on June 3, 2026, it attracted widespread public attention only after it was uploaded on the official website of the Allahabad High Court on July 17, 2026.

The ruling is expected to have far-reaching implications for judicial administration, transparency in the legal profession, and efforts to restore public confidence in the justice system across Uttar Pradesh.

प्रयागराज। न्याय व्यवस्था की निष्पक्षता और विश्वसनीयता बनाए रखने की दिशा में महत्वपूर्ण कदम उठाते हुए इलाहाबाद हाईकोर्ट ने उत्तर प्रदेश में अधिवक्ताओं के खिलाफ दर्ज सभी आपराधिक मामलों को उनके कार्यस्थल वाले जिले से हटाकर निकटवर्ती ऐसे जिले में स्थानांतरित करने का निर्देश दिया है, जहां उनका पेशेवर प्रभाव न्यूनतम हो।

अदालत ने कहा कि इस व्यवस्था का उद्देश्य निष्पक्ष जांच, स्वतंत्र सुनवाई और न्यायिक प्रक्रिया पर किसी भी प्रकार के प्रभाव को रोकना है।

स्थानांतरण की प्रक्रिया के लिए अदालत ने स्पष्ट किया कि नया जिला सामान्यतः संबंधित अधिवक्ता के कार्यस्थल से 100 किलोमीटर के भीतर होना चाहिए।

न्यायालय के अनुसार यह दूरी इतनी पर्याप्त है कि अधिवक्ता का स्थानीय प्रभाव नए जिले तक न पहुंचे, वहीं दूसरी ओर मुकदमे से जुड़े पक्षकारों, गवाहों और अधिवक्ताओं को अनावश्यक असुविधा का सामना भी न करना पड़े।

न्यायमूर्ति विनोद दिवाकर ने इटावा के अधिवक्ता मोहम्मद कफील द्वारा दायर याचिका खारिज करते हुए यह आदेश पारित किया।

अदालत ने मामले को अनुपालन रिपोर्ट के लिए 20 अगस्त 2026 को सूचीबद्ध करने का निर्देश दिया तथा रजिस्ट्रार (अनुपालन) को राज्यभर से समेकित अनुपालन रिपोर्ट प्रस्तुत करने के लिए कहा।

अपने विस्तृत आदेश में न्यायमूर्ति दिवाकर ने न्याय व्यवस्था की गिरती साख पर गंभीर चिंता व्यक्त करते हुए कहा कि कानून सबसे पहले तब कमजोर पड़ता है जब उसकी रक्षा करने वाले ही आपराधिक गतिविधियों में लिप्त पाए जाते हैं, और दूसरी बार तब जब न्यायपालिका ऐसे मामलों पर मौन धारण कर लेती है।

अदालत ने कहा कि ऐसी परिस्थितियां विधि के शासन को गंभीर क्षति पहुंचाती हैं।

न्यायालय ने यह भी टिप्पणी की कि गोरखपुर और कानपुर सहित कुछ बार एसोसिएशनों में कथित आपराधिक पृष्ठभूमि वाले लोग पदों पर आसीन हैं।

अदालत के अनुसार राज्य के अनेक जिला न्यायालयों में बार काउंसिल में पंजीकृत कुछ विधि स्नातकों के संगठित समूह सक्रिय हैं, जिन पर न्यायालय के आदेशों के नाम पर दबाव बनाकर विवाद सुलझाने, कमजोर पक्षकारों को धमकाने तथा संपत्तियों और किरायेदारों को जबरन बेदखल कराने जैसे गंभीर आरोप हैं।

हाईकोर्ट ने इस बात पर भी चिंता व्यक्त की कि जिला न्यायालयों के अनेक न्यायाधीश ऐसे मामलों में प्रभावी कार्रवाई करने से बचते रहे हैं।

आदेश में कहा गया कि इसके पीछे यह धारणा दिखाई देती है कि ऐसे समूहों को सामाजिक और राजनीतिक संरक्षण प्राप्त है, जिसके कारण उनके विरुद्ध कठोर कदम उठाने में संकोच किया जाता है।

अदालत ने कहा कि इस प्रकार का वातावरण युवा अधिवक्ताओं और नव नियुक्त न्यायिक अधिकारियों के लिए अत्यंत प्रतिकूल है।

न्यायालय के अनुसार सीमित संख्या में प्रभावशाली समूहों की सक्रियता के कारण ईमानदार और निष्पक्ष तरीके से कार्य करना तथा स्वतंत्र न्यायिक सोच विकसित करना कठिन होता जा रहा है।

बार काउंसिल ऑफ उत्तर प्रदेश द्वारा प्रस्तुत सत्यापन रिपोर्ट पर भी हाईकोर्ट ने असंतोष व्यक्त किया। रिपोर्ट में लगभग पांच लाख पंजीकृत अधिवक्ताओं में से केवल 105 अधिवक्ताओं की पहचान फर्जी शैक्षणिक प्रमाणपत्रों के आधार पर नामांकन कराने वालों के रूप में की गई थी।

अदालत ने इस निष्कर्ष को वास्तविक स्थिति की तुलना में अत्यंत सीमित और सतही बताया।

न्यायालय ने कहा कि 1991 से 2023 के बीच लंबे समय तक फर्जी दस्तावेजों के कथित उपयोग, प्रतिष्ठित विश्वविद्यालयों—विशेषकर इलाहाबाद विश्वविद्यालय—के नाम के दुरुपयोग तथा राज्य में जालसाजी की व्यापक घटनाओं को देखते हुए यह मानना कठिन है कि केवल 105 अधिवक्ता ही फर्जी योग्यता के आधार पर नामांकित हुए होंगे।

अदालत ने संकेत दिया कि वास्तविक संख्या इससे कहीं अधिक हो सकती है।

हालांकि यह आदेश 3 जून 2026 को पारित किया गया था, लेकिन 17 जुलाई 2026 को इलाहाबाद हाईकोर्ट की आधिकारिक वेबसाइट पर अपलोड होने के बाद यह व्यापक चर्चा का विषय बना।

कानूनी विशेषज्ञों का मानना है कि यह फैसला उत्तर प्रदेश की न्यायिक व्यवस्था, अधिवक्ता समुदाय की जवाबदेही और न्याय प्रणाली में जनता के विश्वास को मजबूत करने की दिशा में एक महत्वपूर्ण मील का पत्थर साबित हो सकता है।
