Allahabad High Court Protects Candidate From Disqualification Over One-Day Postal Delay

The court directed UPPSC to accept a woman’s application documents by October 16 and consider her candidature, holding that timely dispatch through an authorised postal service cannot be defeated by a delivery delay beyond the applicant’s control.

PRAYAGRAJ: The Allahabad High Court has ruled that a recruitment applicant cannot be denied consideration merely because documents sent through a postal service expressly permitted in the recruitment advertisement arrive after the deadline, provided the candidate submitted the online application and dispatched the hard copy within the prescribed time.

In a judgment dated October 8, Justice Manju Rani Chauhan directed the Uttar Pradesh Public Service Commission (UPPSC) to accept the hard copy of a woman candidate’s application by October 16 and consider her for recruitment to posts in the state’s Medical Education Department.

The court observed that a recruiting body cannot authorise registered post or speed post as valid methods of submission and then penalise an applicant for a delivery delay arising from the same service, particularly when the candidate has complied with the requirements within the stipulated period.

The recruitment process originated from an advertisement issued on August 18, 2026, inviting applications for posts in the Medical Education Department that were to be filled through interviews.

Candidates had to submit their online applications and pay the prescribed fee by September 1.

The printed application, accompanied by the required documents, was required to reach the Commission by 5 pm on September 15.

The advertisement permitted delivery by registered post, speed post or submission by hand.

The petitioner completed her online application and paid the fee on August 31. She then sent the hard copy through registered post on September 8, giving it a week to reach the Commission before the deadline.

However, the documents arrived at the Commission’s Allahabad office on September 16, one day after the cut-off date.

The Commission refused to accept the application and recorded the reason on the envelope, which was returned to the candidate on September 21.

The woman subsequently approached the postal authorities, who informed her that offices in Delhi and New Delhi had remained closed from September 11 to 13 because of the 18th BRICS Leaders’ Summit.

Her representation to the Commission on September 30 did not receive a response.

During the court proceedings, the Commission’s counsel argued that the hard copy could not be accepted because it had arrived after the deadline specified in the advertisement.

The High Court, however, found that the postal tracking record demonstrated that the candidate had dispatched the documents within the prescribed period.

It held that she had fulfilled her responsibility and found no material indicating negligence or a lack of diligence on her part.

To support its conclusion, the court referred to the Supreme Court’s decision in Ashutosh Agnihotri v. High Court of Madhya Pradesh and Another.

In that case, an application sent by speed post before the deadline reached the High Court a day late. The rejection was set aside because the candidate could not be blamed for the postal delay.

Applying the same principle, Justice Chauhan held that a delay in delivery occurring after timely dispatch, where no negligence by the applicant is established, cannot by itself justify exclusion from a recruitment process.

The court consequently found that the Commission had acted incorrectly in returning the woman’s application because of the one-day delay.

It directed UPPSC to accept the hard copy by October 16 and proceed to consider her candidature in accordance with the recruitment process.

The ruling reinforces the principle that candidates who comply with application requirements should not automatically suffer adverse consequences because of postal delays beyond their control, particularly when the recruiting authority itself has permitted postal submission.
