Allahabad High Court Warns Police Against Misbehaviour With Government Advocates, Calls It Contempt
PRAYAGRAJ: The Allahabad High Court has instructed the Uttar Pradesh Director General of Police (DGP) to issue a statewide circular cautioning police officers against misbehaving with government advocates who convey judicial orders for implementation.
The court warned that such conduct could amount to contempt of court and attract action under the law.
The direction followed an incident involving Rajesh Kumar Singh, public relations officer (PRO) to the Senior Superintendent of Police (SSP) in Azamgarh.
Singh was accused of behaving improperly with an additional government advocate who was communicating a court order requiring compliance.
Taking serious note of the incident, Justice Arun Kumar Singh Deshwal ordered that Singh be kept in court custody until 5 pm. He was subsequently released.
The court emphasised that additional government advocates perform duties as officers of the court and play an important role in ensuring that judicial directions are implemented.
It observed that when they inform government officials or police personnel about the need to comply with an order, they are acting in furtherance of the court’s authority.
Any officer who responds by mistreating or intimidating them, regardless of rank, could face contempt proceedings, the court said.
During the hearing, the Azamgarh SSP informed the bench that a show-cause notice had been issued to Singh and that he had been removed from the post of PRO. The court appreciated the prompt action taken by the senior police officer.
The bench also took note of the SSP’s record of service and his humanitarian gesture of adopting the two minor daughters of a deceased suspect.
In view of these circumstances, the court closed the proceedings against the SSP, while advising him to exercise greater caution in the future.
To ensure that the court’s directions reach the police establishment across the state, the Registrar (Compliance) was asked to forward a copy of the order to the Uttar Pradesh DGP.
The order was passed on October 13 while the High Court was hearing a bail application filed by Sachin Yadav in connection with a case registered in Azamgarh district in 2024.
The case involves allegations that an obscene video of a rape victim was uploaded online. The FIR invokes Section 64(1) of the Bharatiya Nyaya Sanhita (BNS) and Sections 66E and 67A of the Information Technology Act.
The court’s directive underscores the importance of professional conduct in communications between government advocates and police officials, particularly when judicial orders require timely compliance.
