Allahabad High Court Pushes for Fast Forest Clearance to Build Hamirpur School Road
After taking suo motu notice of the hardships faced by more than 200 children in Chandupur village, the Allahabad High Court has asked the Forest Department to expedite the NOC required for a 1.6-km road link to their school.

A protest by schoolchildren over the absence of a proper road has drawn judicial intervention in Uttar Pradesh, with the Allahabad High Court pressing the Forest Department to move swiftly on the clearance required for construction of a key road in Hamirpur district.
The case concerns children from Chandupur village who have been struggling to reach their school because of poor road connectivity.
More than 200 students and their parents had earlier walked nearly five kilometres to the office of the Hamirpur District Magistrate to draw attention to the problem.
Taking suo motu notice of the children’s difficulties, the High Court converted the matter into a public interest litigation titled In Re: Road To School, Hamirpur Vs. State of U.P. and others.
The proceedings are being heard by a division bench comprising Chief Justice Arun Bhansali and Justice Kshitij Shailendra.
During the latest hearing, the Uttar Pradesh government informed the court that Rs 1.81 crore had been sanctioned for the proposed road project.
However, a 1.6-kilometre section of the route passes through forest land, making prior approval from the Forest Department necessary before construction can begin.
The State submitted that it had repeatedly tried to obtain the required no-objection certificate but had not yet succeeded.
The government also told the court that the nature of the terrain made the construction of a cement road necessary.
It sought additional time to complete the process of securing the required forest clearance.
The High Court, however, made it clear that the clearance should not be delayed through routine administrative procedures.
In its order dated August 24, the bench said the Forest Department was expected to issue the necessary NOC with urgency rather than process the matter at its usual pace.
The court’s intervention follows its earlier observation that the five-kilometre march undertaken by young children during the protest demonstrated the seriousness of the problem they were facing.
The High Court has also expanded the list of parties in the case.
The Union Ministry of Environment, Forest and Climate Change, represented through its Secretary, and the Divisional Forest Officer of the Hamirpur Forest Division have been directed to be added as respondents.
A copy of the court’s order has been directed to be served on the Additional Solicitor General of India.
The Additional Solicitor General will communicate the direction to the Divisional Forest Officer in Hamirpur so that the NOC process can be completed without further delay.
The court has fixed September 28, 2026, as the next date of hearing.
The case has brought attention to the impact of infrastructure gaps on access to education in rural areas, where a relatively short stretch of unfinished road can create major difficulties for children travelling to school.
With funds now sanctioned, the immediate focus is on securing forest clearance for the 1.6-kilometre stretch that has become the final major hurdle before the proposed road can move towards construction.

चंदूपुर गांव के 200 से अधिक बच्चों की स्कूल तक सड़क न होने की समस्या पर स्वतः संज्ञान लेने के बाद इलाहाबाद हाईकोर्ट ने 1.6 किलोमीटर लंबे वन क्षेत्र वाले हिस्से के लिए जरूरी अनापत्ति प्रमाणपत्र तेजी से जारी करने की अपेक्षा जताई है।

हमीरपुर जिले के चंदूपुर गांव में स्कूल तक पहुंचने के लिए बच्चों की लंबे समय से चली आ रही परेशानी अब इलाहाबाद हाईकोर्ट के हस्तक्षेप के बाद समाधान की दिशा में बढ़ सकती है।
अदालत ने उत्तर प्रदेश वन विभाग से कहा है कि स्कूल तक सड़क बनाने के लिए आवश्यक अनापत्ति प्रमाणपत्र, यानी NOC, सामान्य प्रशासनिक गति के बजाय प्राथमिकता के साथ जारी किया जाए।
मामला उस सड़क से जुड़ा है जिसका एक महत्वपूर्ण हिस्सा वन भूमि से होकर गुजरता है।
राज्य सरकार ने सड़क निर्माण के लिए धनराशि मंजूर कर दी है, लेकिन 1.6 किलोमीटर के हिस्से पर वन विभाग की मंजूरी न मिलने के कारण काम आगे नहीं बढ़ पा रहा है।
हाईकोर्ट को राज्य सरकार की ओर से बताया गया कि परियोजना के लिए 1.81 करोड़ रुपये स्वीकृत किए जा चुके हैं।
सरकार ने यह भी कहा कि क्षेत्र की भौगोलिक स्थिति को देखते हुए वहां सीमेंट की सड़क बनाना आवश्यक है।
हालांकि, निर्माण शुरू करने से पहले वन विभाग से अनापत्ति प्रमाणपत्र लेना अनिवार्य है।
राज्य सरकार के अनुसार, संबंधित विभाग से अनुमति हासिल करने के लिए समय-समय पर प्रयास किए गए, लेकिन NOC अभी तक जारी नहीं हो सकी।
इसके बाद सरकार ने अदालत से अनुमति प्रक्रिया पूरी करने के लिए कुछ और समय मांगा।
इस पर मुख्य न्यायाधीश अरुण भंसाली और न्यायमूर्ति क्षितिज शैलेंद्र की खंडपीठ ने वन विभाग को प्रक्रिया में तेजी लाने की स्पष्ट अपेक्षा जताई।
24 अगस्त को पारित आदेश में अदालत ने कहा कि आवश्यक NOC को विभाग की सामान्य कार्यप्रणाली के अनुरूप लंबी प्रक्रिया में न रखा जाए, बल्कि उसे तेजी से जारी करने की दिशा में कार्रवाई हो।
हाईकोर्ट ने इस मामले पर स्वतः संज्ञान उस समाचार के बाद लिया था, जिसमें चंदूपुर गांव के 200 से अधिक स्कूली बच्चों की परेशानी उजागर की गई थी।
रिपोर्ट के अनुसार, स्कूल तक सड़क नहीं होने से परेशान बच्चे अपने अभिभावकों के साथ करीब पांच किलोमीटर पैदल चलकर हमीरपुर के जिलाधिकारी कार्यालय पहुंचे थे और सड़क निर्माण की मांग को लेकर विरोध दर्ज कराया था।
अदालत ने पहले ही टिप्पणी की थी कि इतनी बड़ी संख्या में बच्चों का पांच किलोमीटर पैदल चलकर अपनी समस्या को सामने लाना उस कठिनाई की गंभीरता को दर्शाता है, जिसका वे रोजाना सामना कर रहे हैं।
इसके बाद मामले को जनहित याचिका के रूप में दर्ज किया गया। इसका शीर्षक ‘In Re: Road To School, Hamirpur Vs. State of U.P. and others’ रखा गया है।
हाईकोर्ट ने अब मामले में केंद्र सरकार को भी पक्षकार बनाने का निर्देश दिया है।
केंद्रीय पर्यावरण, वन एवं जलवायु परिवर्तन मंत्रालय के सचिव तथा हमीरपुर वन प्रभाग के मंडलीय वन अधिकारी को मामले में प्रतिवादी बनाया जाएगा।
अदालत ने अपने आदेश की प्रति भारत के अतिरिक्त सॉलिसिटर जनरल को उपलब्ध कराने का भी निर्देश दिया है।
अतिरिक्त सॉलिसिटर जनरल संबंधित आदेश की जानकारी हमीरपुर के मंडलीय वन अधिकारी को देंगे, ताकि आवश्यक NOC जारी करने की प्रक्रिया में और देरी न हो।
मामले की अगली सुनवाई 28 सितंबर 2026 को होगी।
इस मामले में धनराशि स्वीकृत हो जाने के बावजूद सड़क निर्माण शुरू नहीं हो सका है। अब सबसे बड़ी बाधा वन भूमि से गुजरने वाले 1.6 किलोमीटर के हिस्से के लिए आवश्यक मंजूरी है।
हाईकोर्ट के निर्देश के बाद अब नजर इस बात पर रहेगी कि क्या वन विभाग तेजी से NOC जारी करता है और चंदूपुर के बच्चों को जल्द ही स्कूल तक बेहतर सड़क सुविधा मिल पाती है।
