Allahabad High Court Summons UP DGP Over Police Non-Compliance
Justice Sameer Jain has sought a personal explanation from the Uttar Pradesh police chief after the State failed to submit a court-ordered affidavit in a murder case, with the High Court observing that such disregard for its directions had become increasingly frequent.
The Allahabad High Court has called for a personal explanation from Uttar Pradesh Director General of Police after expressing serious concern over what it described as a growing tendency among police officials to disregard directions issued by the court.
Justice Sameer Jain ordered the DGP to appear before the High Court while hearing the bail plea of Pushpraj Singh, also known as Babloo, who is facing murder charges.
The court’s intervention followed the State government’s failure to place a detailed counter-affidavit on record despite an earlier judicial direction.
On July 16, 2026, the High Court had asked the State to file a comprehensive response addressing a discrepancy related to the alleged timing of the incident and CCTV footage recorded on June 21, 2025.
However, when the matter returned for hearing, the required affidavit had still not been filed.
Additional Government Advocate Dr S.B. Maurya told the court that he had twice written to the concerned authorities seeking the necessary information and compliance.
Despite those communications, the affidavit had not reached the court.
Justice Jain reacted sharply to the continued failure to comply with the judicial order, describing it as a serious instance of disrespect towards the court.
The judge also observed that such situations were no longer isolated and that the court had recently encountered similar difficulties repeatedly, with police officials appearing unwilling or slow to act on directions passed by the High Court.
The court has now required the Uttar Pradesh DGP to personally clarify why police officers have allegedly been showing reluctance in carrying out orders issued by the High Court.
The Advocate General of Uttar Pradesh has also been directed to remain present during the next hearing.
The Registry has been asked to communicate the order to the DGP within 24 hours to ensure compliance.
The case was listed for August 24, 2026, at 2 pm in the daily cause list.
The order highlights the High Court’s concern not merely over the missing affidavit in the murder case but over a broader issue of administrative and police compliance with judicial directions.
The next hearing is expected to focus on the reasons behind the failure to submit the court-mandated response and the wider concerns raised by Justice Jain regarding the implementation of High Court orders by police officials in Uttar Pradesh.

हत्या के एक मामले में राज्य सरकार द्वारा तय समय पर जवाबी हलफनामा दाखिल नहीं किए जाने पर इलाहाबाद हाईकोर्ट ने कड़ी नाराजगी जताई। न्यायमूर्ति समीर जैन ने कहा कि अदालत को ऐसे मामलों का सामना बार-बार करना पड़ रहा है।

इलाहाबाद हाईकोर्ट ने उत्तर प्रदेश पुलिस के वरिष्ठ अधिकारियों द्वारा न्यायालय के आदेशों के अनुपालन में कथित ढिलाई पर गंभीर चिंता व्यक्त करते हुए प्रदेश के पुलिस महानिदेशक को व्यक्तिगत रूप से अदालत के समक्ष उपस्थित होने का निर्देश दिया है।
हाईकोर्ट ने DGP से यह स्पष्ट करने को कहा है कि हाल के दिनों में उनके अधीनस्थ पुलिस अधिकारी न्यायालय के आदेशों का पालन करने में कथित रूप से अनिच्छा क्यों दिखा रहे हैं।
यह निर्देश न्यायमूर्ति समीर जैन की पीठ ने हत्या के आरोप से जुड़े एक मामले में पुष्पराज सिंह उर्फ बबलू की जमानत याचिका पर सुनवाई के दौरान दिया।
मामले में एक महत्वपूर्ण तथ्य को लेकर अदालत ने पहले राज्य सरकार से विस्तृत जवाब मांगा था।
16 जुलाई 2026 को हाईकोर्ट ने राज्य को निर्देश दिया था कि वह एक विस्तृत प्रति-शपथपत्र दाखिल करे।
अदालत ने घटना के कथित समय और 21 जून 2025 की CCTV रिकॉर्डिंग में दिखाई देने वाले समय के बीच अंतर को लेकर स्पष्टीकरण मांगा था।
लेकिन अगली सुनवाई तक राज्य सरकार की ओर से अपेक्षित जवाब अदालत में दाखिल नहीं किया गया।
सुनवाई के दौरान अपर सरकारी अधिवक्ता डॉ. एस.बी. मौर्य ने अदालत को बताया कि उन्होंने संबंधित अधिकारियों को दो बार पत्र भेजकर आवश्यक जानकारी और जवाब उपलब्ध कराने को कहा था।
इसके बावजूद न्यायालय के समक्ष जवाबी हलफनामा दाखिल नहीं हो सका।
इस स्थिति पर न्यायमूर्ति जैन ने कड़ी टिप्पणी की।
अदालत ने राज्य की ओर से आदेश का पालन न किए जाने को गंभीरता से लेते हुए कहा कि न्यायालय के निर्देश की ऐसी अनदेखी को स्वीकार नहीं किया जा सकता।
पीठ ने यह भी टिप्पणी की कि हाल के दिनों में इस प्रकार की समस्या बार-बार सामने आ रही है।
अदालत के अनुसार, पुलिस अधिकारियों द्वारा हाईकोर्ट के आदेशों का पालन करने में कथित अनिच्छा या उदासीनता एक लगातार उभरती हुई चिंता बन गई है।
इसी पृष्ठभूमि में न्यायालय ने उत्तर प्रदेश के DGP को व्यक्तिगत रूप से उपस्थित होकर स्थिति स्पष्ट करने का आदेश दिया।
अदालत ने उनसे यह बताने को कहा है कि उनके अधीनस्थ अधिकारी न्यायालय द्वारा पारित आदेशों का पालन करने में कथित रूप से पीछे क्यों हट रहे हैं।
हाईकोर्ट ने मामले की अगली सुनवाई के दौरान प्रदेश के महाधिवक्ता को भी उपस्थित रहने का निर्देश दिया है।
न्यायालय की रजिस्ट्री को आदेश की प्रति 24 घंटे के भीतर DGP तक पहुंचाने का निर्देश दिया गया है, ताकि आदेश का अनुपालन सुनिश्चित किया जा सके।
मामले को 24 अगस्त 2026 को दोपहर 2 बजे दैनिक वाद सूची में सुनवाई के लिए रखा गया था।
यह मामला केवल एक हत्या के प्रकरण में जवाबी हलफनामा दाखिल न करने तक सीमित नहीं है।
हाईकोर्ट की टिप्पणियों से संकेत मिलता है कि अदालत पुलिस प्रशासन द्वारा न्यायिक आदेशों के पालन को लेकर व्यापक स्तर पर चिंता जता रही है।
अगली सुनवाई में DGP से इस मुद्दे पर व्यक्तिगत स्पष्टीकरण मांगा जाएगा। साथ ही यह भी देखा जाएगा कि संबंधित मामले में अदालत के पहले के निर्देश का पालन आखिर क्यों नहीं किया गया।
