Allahabad High Court Quashes Proceedings Against Former Saharanpur DM, Says Trial Court Cannot Compel Sanction for Prosecution

Reinforcing the legal safeguards available to public servants, the Allahabad High Court has ruled that a trial court cannot compel an investigating agency such as the Central Bureau of Investigation (CBI) to secure prosecution sanction against a government officer.
The court observed that issuing such a direction would, in effect, amount to compelling the competent authority to grant sanction, a course of action that has no sanction in law.
The significant ruling came from Justice Raj Beer Singh while deciding a petition filed by former Saharanpur District Magistrate Pawan Kumar.
Kumar had challenged an order passed by the Special Judge (CBI), Ghaziabad, which had rejected the CBI’s closure report and instructed the agency to obtain prosecution sanction against him in connection with the alleged irregular renewal of sand mining leases in Saharanpur.
Granting relief to the senior IAS officer, the High Court set aside the Special Judge’s order insofar as it concerned Pawan Kumar, who is presently serving as Director in Delhi’s Rural Development Department.
The court accepted the CBI’s closure report in his favour and terminated all criminal proceedings against him.
The controversy traces its origin to an FIR registered after a preliminary inquiry into allegations that 13 sand mining leases in Saharanpur had been renewed illegally.
The CBI subsequently carried out a detailed investigation into the allegations.
After examining the available evidence, the investigating agency concluded that no material existed to support allegations against Pawan Kumar.
Its closure report stated that there was no evidence indicating criminal conspiracy, cheating, abuse of official position or any other criminal misconduct attributable to the former District Magistrate.
Despite these findings, the Special Judge declined to accept the closure report. While taking cognisance against several private individuals named in the case, the trial court also directed the CBI to obtain mandatory sanction for prosecuting Kumar under the Prevention of Corruption Act.
Questioning the legality of that direction, Kumar approached the High Court contending that every action taken by him was strictly in the discharge of his official responsibilities.
He argued that he had merely complied with instructions issued by the Uttar Pradesh government by obtaining factual reports from subordinate officers and forwarding them to the competent authority without making any independent recommendation or expressing any personal opinion regarding renewal of the mining leases.
The petitioner further submitted that the authority to approve or reject renewal of mining leases rested exclusively with the State Government.
He also pointed out that although approval for a second renewal had been granted by the government, no fresh lease deed was ever executed because the Allahabad High Court, in a separate public interest litigation, had stayed further second renewals.
Opposing the petition, the CBI raised a preliminary objection, arguing that the plea under Section 482 of the Code of Criminal Procedure was premature because Kumar had not yet been summoned as an accused.
According to the agency, the trial court had merely instructed it to obtain prosecution sanction and had not initiated criminal proceedings against him.
The High Court, however, rejected this objection. Justice Singh observed that once the trial court had expressed the view that a prima facie case existed and had directed the investigating agency to obtain prosecution sanction, the order directly affected the applicant’s legal rights.
The court further held that such a direction was contrary to established legal principles, making the petition maintainable under Section 482 CrPC.
Examining the case on merits, the High Court found that the material collected during the CBI investigation consistently showed that Kumar had simply collected reports from subordinate authorities as required by the State Government and forwarded them without altering their contents or adding any recommendation of his own.
The court noted that no evidence suggested he had furnished misleading information or influenced the decision regarding renewal of mining leases.
Justice Singh also recorded that after the State Government approved the second renewal, Kumar merely issued a consequential office communication informing subordinate officials about the government’s decision.
Before any lease deed could actually be executed, however, the High Court’s interim order in a separate PIL halted the process altogether. Consequently, no second renewal lease ever came into existence.
The judge observed that the Special Court’s finding to the contrary was factually unsustainable.
Finding no incriminating evidence against the former District Magistrate, the High Court concluded that the Special Judge had failed to identify any material demonstrating abuse of official position, criminal misconduct or involvement in any conspiracy.
In its judgment delivered on July 15, the court held that continuation of proceedings against Kumar was unwarranted and accordingly accepted the CBI’s closure report while quashing the proceedings against him.

लोक सेवकों के विरुद्ध अभियोजन स्वीकृति से जुड़े कानून की अहम व्याख्या करते हुए इलाहाबाद हाईकोर्ट ने स्पष्ट किया है कि कोई भी ट्रायल कोर्ट सीबीआई जैसी जांच एजेंसी को किसी सरकारी अधिकारी के खिलाफ अभियोजन स्वीकृति प्राप्त करने का निर्देश नहीं दे सकती।
अदालत ने कहा कि ऐसा आदेश वस्तुतः उस सक्षम प्राधिकारी को स्वीकृति देने के लिए बाध्य करने जैसा होगा, जिसे कानून किसी भी परिस्थिति में स्वीकार नहीं करता।
न्यायमूर्ति राज बीर सिंह ने यह महत्वपूर्ण टिप्पणी सहारनपुर के पूर्व जिलाधिकारी पवन कुमार द्वारा दायर याचिका पर सुनवाई करते हुए की।
याचिकाकर्ता ने सीबीआई के विशेष न्यायाधीश, गाजियाबाद के उस आदेश को चुनौती दी थी, जिसमें सीबीआई की क्लोजर रिपोर्ट अस्वीकार करते हुए एजेंसी को उनके खिलाफ भ्रष्टाचार निवारण अधिनियम के तहत अभियोजन स्वीकृति प्राप्त करने के निर्देश दिए गए थे।
मामला सहारनपुर में बालू खनन पट्टों के कथित अवैध नवीनीकरण से जुड़ा है।
याचिका स्वीकार करते हुए हाईकोर्ट ने विशेष न्यायाधीश का आदेश पवन कुमार के संबंध में निरस्त कर दिया।
वर्तमान में दिल्ली के ग्रामीण विकास विभाग में निदेशक के पद पर कार्यरत कुमार के खिलाफ सीबीआई द्वारा दाखिल क्लोजर रिपोर्ट को अदालत ने स्वीकार कर लिया तथा उनके विरुद्ध चल रही पूरी कार्यवाही समाप्त कर दी।
यह मामला सहारनपुर जिले में 13 बालू खनन पट्टों के कथित अवैध नवीनीकरण की शिकायत पर प्रारंभिक जांच के बाद दर्ज एफआईआर से शुरू हुआ था। इसके बाद सीबीआई ने पूरे मामले की विस्तृत जांच की।
जांच पूरी होने के बाद सीबीआई इस निष्कर्ष पर पहुंची कि पवन कुमार के विरुद्ध किसी भी प्रकार की आपराधिक साजिश, धोखाधड़ी, पद के दुरुपयोग अथवा अन्य आपराधिक कृत्य का कोई विश्वसनीय साक्ष्य उपलब्ध नहीं है। इसी आधार पर एजेंसी ने उनके पक्ष में क्लोजर रिपोर्ट दाखिल की थी।
हालांकि विशेष न्यायाधीश ने इस रिपोर्ट को स्वीकार करने से इनकार कर दिया। निजी आरोपियों के विरुद्ध संज्ञान लेते हुए अदालत ने सीबीआई को यह भी निर्देश दिया कि पवन कुमार के खिलाफ भ्रष्टाचार निवारण अधिनियम के तहत अभियोजन स्वीकृति प्राप्त की जाए।
इस आदेश को चुनौती देते हुए पवन कुमार ने हाईकोर्ट में कहा कि उन्होंने अपने पूरे कार्यकाल में केवल सरकारी निर्देशों का पालन किया।
उनके अनुसार राज्य सरकार के आदेश पर उन्होंने अधीनस्थ अधिकारियों से तथ्यात्मक रिपोर्ट मंगवाई और बिना किसी परिवर्तन, टिप्पणी या व्यक्तिगत अनुशंसा के उसे सरकार को अग्रेषित कर दिया था। उन्होंने किसी भी स्तर पर खनन पट्टों के नवीनीकरण की सिफारिश या अनुमोदन नहीं किया।
पूर्व जिलाधिकारी ने यह भी दलील दी कि खनन पट्टों के नवीनीकरण का अंतिम निर्णय केवल राज्य सरकार के अधिकार क्षेत्र में था।
उन्होंने अदालत को बताया कि सरकार द्वारा दूसरी बार नवीनीकरण की स्वीकृति दिए जाने के बावजूद कोई नया लीज डीड कभी निष्पादित नहीं हुआ, क्योंकि इसी बीच इलाहाबाद हाईकोर्ट ने एक अलग जनहित याचिका में दूसरे नवीनीकरण की प्रक्रिया पर अंतरिम रोक लगा दी थी।
दूसरी ओर, सीबीआई ने प्रारंभिक आपत्ति उठाते हुए कहा कि दंड प्रक्रिया संहिता की धारा 482 के तहत दायर याचिका सुनवाई योग्य नहीं है क्योंकि पवन कुमार को अभी तक आरोपी के रूप में समन जारी नहीं किया गया था।
एजेंसी का कहना था कि ट्रायल कोर्ट ने केवल अभियोजन स्वीकृति प्राप्त करने का निर्देश दिया था।
हाईकोर्ट ने इस आपत्ति को स्वीकार नहीं किया। न्यायालय ने कहा कि जब ट्रायल कोर्ट यह राय बना चुका था कि प्रथम दृष्टया मामला बनता है और अभियोजन स्वीकृति प्राप्त करने का निर्देश भी दे चुका था, तब वह आदेश याचिकाकर्ता के अधिकारों को प्रतिकूल रूप से प्रभावित करता है।
अदालत ने यह भी कहा कि ऐसा निर्देश कानून की स्थापित व्यवस्था के विपरीत है, इसलिए धारा 482 के तहत दायर याचिका पूरी तरह सुनवाई योग्य है।
मामले के गुण-दोष पर विचार करते हुए हाईकोर्ट ने पाया कि सीबीआई द्वारा एकत्र किए गए सभी अभिलेख यही दर्शाते हैं कि पवन कुमार ने केवल अधीनस्थ अधिकारियों से रिपोर्ट प्राप्त कर उन्हें यथावत राज्य सरकार को भेजा था।
रिकॉर्ड में ऐसा कोई प्रमाण नहीं है जिससे यह साबित हो कि उन्होंने कोई भ्रामक रिपोर्ट दी, तथ्यों में फेरबदल किया या खनन पट्टों के नवीनीकरण की व्यक्तिगत अनुशंसा की।
अदालत ने यह भी दर्ज किया कि राज्य सरकार द्वारा दूसरी बार नवीनीकरण की मंजूरी दिए जाने के बाद पवन कुमार ने केवल सरकारी निर्णय की सूचना अधीनस्थ अधिकारियों तक पहुंचाने के लिए कार्यालयीय आदेश जारी किया था।
इससे पहले कि कोई नया लीज डीड निष्पादित होता, इलाहाबाद हाईकोर्ट ने एक अन्य जनहित याचिका में पूरी प्रक्रिया पर रोक लगा दी। परिणामस्वरूप दूसरा नवीनीकरण कभी प्रभावी ही नहीं हुआ। न्यायालय ने कहा कि ट्रायल कोर्ट का इसके विपरीत निष्कर्ष तथ्यात्मक रूप से गलत था।
15 जुलाई को दिए गए अपने निर्णय में न्यायमूर्ति राज बीर सिंह ने कहा कि जांच के दौरान ऐसा कोई भी आपत्तिजनक साक्ष्य सामने नहीं आया जिससे यह सिद्ध हो सके कि पवन कुमार ने अपने पद का दुरुपयोग किया, किसी आपराधिक षड्यंत्र का हिस्सा बने या किसी प्रकार का दुराचार किया।
इन्हीं कारणों से हाईकोर्ट ने सीबीआई की क्लोजर रिपोर्ट स्वीकार करते हुए उनके विरुद्ध चल रही समस्त कार्यवाही को निरस्त कर दिया।
