Bombay High Court Slams Probe into Doctors’ Assault, Transfers Investigation to Senior Officer; Questions Shiv Sena Corporator’s Conduct

Expressing strong dissatisfaction over the manner in which the investigation has been handled, the Bombay High Court on Monday ordered that the probe into the alleged assault on doctors at a Thane hospital be taken away from the local police and entrusted to an officer of the rank of Deputy Commissioner of Police (DCP).

The court observed that the investigation had not inspired confidence and remarked that the case had been “botched up”.

Hearing a suo motu public interest petition, a division bench comprising Acting Chief Justice Ravindra V. Ghuge and Justice Gautam A.

Ankhad delivered a sharp rebuke to Shiv Sena corporator Ramesh Mhatre, who has been accused of attacking doctors on July 6.

The judges questioned how a public representative, elected to serve citizens, could allegedly resort to violence against the very people who had placed their faith in him.

During the proceedings, the bench observed that political leaders seek votes by promising public service during elections but, after assuming office, some forget those responsibilities.

The court said it was deeply disturbing that an elected representative could allegedly assault members of the public instead of protecting their interests, calling such conduct wholly inconsistent with public office.

Referring to Mhatre’s surrender before police on July 19—after the High Court suspended the bail earlier granted by a lower court—the judges also took note of allegations surrounding his medical condition.

They remarked that it had been argued before the court that the corporator walked out of the hospital immediately after securing the release order and even received a grand public reception, raising doubts over whether his health concerns had genuinely warranted hospitalisation.

The bench questioned whether public office was meant to be used for intimidation rather than public welfare.

It remarked that an elected representative, chosen through the votes of ordinary citizens, was expected to uphold the dignity of the office instead of allegedly attacking people with chairs and files, describing the alleged conduct as shocking and entirely contrary to democratic values.

The High Court also expressed serious reservations about the role played by the local police during the investigation.

Pointing to what it described as significant lapses, the judges questioned why the investigating officer should continue when the inquiry itself appeared compromised.

The bench noted that local police had attempted to produce the accused before the magistrate through video conferencing, a request that was ultimately rejected by the magistrate.

The court appreciated the magistrate’s decision, observing that the investigation had not been carried out in a satisfactory manner.

Appearing for Mhatre, senior advocate Aabad Ponda submitted that his client had realised the gravity of the incident and had learnt a painful lesson.

Responding to the submission, the bench said it hoped that was indeed the case, while reminding counsel that the allegations involved serious criminal offences which could not be viewed lightly.

Senior advocate Ashok Mundargi, who has been appointed amicus curiae to assist the court, argued that although bail remains the general rule in criminal jurisprudence and imprisonment before conviction is an exception, an accused may legitimately remain in judicial custody until the investigation is completed and the charge sheet is filed.

Representing the Maharashtra government, Advocate General Milind Sathe and Chief Public Prosecutor Shishir Hiray assured the court that the investigation could be transferred to the Deputy Commissioner of Police, Zone-3, Kalyan, within two days.

They submitted that such a step would help ensure an impartial probe and restore confidence in the investigation.

Accepting the state’s assurance, the High Court directed that the case be investigated by a DCP-rank officer.

The matter has now been scheduled for further hearing on July 31, when the court is expected to review the progress made in the investigation.

डॉक्टरों से मारपीट मामले में बॉम्बे हाईकोर्ट सख्त, जांच डीसीपी को सौंपी; शिवसेना पार्षद के आचरण पर उठाए गंभीर सवा

ठाणे में डॉक्टरों के साथ कथित मारपीट के मामले की जांच से असंतोष जताते हुए बॉम्बे हाईकोर्ट ने सोमवार को महत्वपूर्ण आदेश पारित किया।

अदालत ने स्थानीय पुलिस से जांच वापस लेकर इसे पुलिस उपायुक्त (डीसीपी) स्तर के अधिकारी को सौंपने का निर्देश दिया।

न्यायालय ने स्पष्ट टिप्पणी की कि अब तक की जांच संतोषजनक नहीं रही और ऐसा प्रतीत होता है कि पूरे मामले की जांच सही ढंग से नहीं की गई।

स्वप्रेरणा से दर्ज जनहित याचिका पर सुनवाई करते हुए कार्यवाहक मुख्य न्यायाधीश रवींद्र वी. घुगे और न्यायमूर्ति गौतम ए. अंखाड़ की खंडपीठ ने शिवसेना पार्षद रमेश म्हात्रे के कथित आचरण पर भी तीखी नाराजगी व्यक्त की।

अदालत ने कहा कि जनप्रतिनिधि बनने का उद्देश्य जनता की सेवा करना होता है, न कि उन्हीं लोगों के साथ हिंसक व्यवहार करना जिन्होंने उन्हें अपना प्रतिनिधि चुना है।

सुनवाई के दौरान न्यायालय ने कहा कि चुनाव के समय नेता जनता से समर्थन और वोट मांगते हैं, लेकिन सत्ता मिलने के बाद यदि वही लोग नागरिकों के साथ मारपीट करने लगें तो यह लोकतांत्रिक व्यवस्था की मूल भावना के विपरीत है।

अदालत ने कहा कि इस तरह का व्यवहार किसी भी निर्वाचित प्रतिनिधि के लिए अत्यंत दुर्भाग्यपूर्ण और अस्वीकार्य है।

खंडपीठ ने 19 जुलाई को रमेश म्हात्रे के आत्मसमर्पण का भी उल्लेख किया। यह वही दिन था जब निचली अदालत से मिली जमानत पर हाईकोर्ट ने रोक लगा दी थी।

न्यायाधीशों ने सुनवाई के दौरान यह भी कहा कि अदालत के समक्ष यह तर्क रखा गया था कि रिहाई का आदेश मिलते ही म्हात्रे बिना किसी परेशानी के अस्पताल से बाहर निकल आए और उनका भव्य स्वागत भी किया गया।

अदालत ने इस पर टिप्पणी करते हुए संकेत दिया कि उनकी चिकित्सकीय स्थिति को लेकर उठे सवालों की भी जांच आवश्यक है।

न्यायालय ने कहा कि जनता के मतों से निर्वाचित व्यक्ति से अपेक्षा की जाती है कि वह समाज का नेतृत्व करे और लोगों का विश्वास बनाए रखे।

यदि वही प्रतिनिधि कुर्सियों और फाइलों से लोगों पर हमला करने के आरोपों में घिर जाए तो यह लोकतंत्र और सार्वजनिक जीवन दोनों के लिए बेहद चिंताजनक स्थिति है।

जांच एजेंसी की कार्यप्रणाली पर भी अदालत ने कड़ी टिप्पणी की। न्यायाधीशों ने पूछा कि जब जांच में गंभीर कमियां दिखाई दे रही हैं तो वर्तमान जांच अधिकारी को क्यों बनाए रखा जाए।

अदालत ने यह भी कहा कि स्थानीय पुलिस ने आरोपी को वीडियो कॉन्फ्रेंसिंग के माध्यम से मजिस्ट्रेट के समक्ष पेश करने की कोशिश की थी, लेकिन मजिस्ट्रेट ने विवेकपूर्ण निर्णय लेते हुए इसकी अनुमति नहीं दी।

हाईकोर्ट ने इस फैसले की सराहना करते हुए कहा कि उपलब्ध रिकॉर्ड से जांच की दिशा संतोषजनक प्रतीत नहीं होती।

रमेश म्हात्रे की ओर से वरिष्ठ अधिवक्ता आबाद पोंडा ने अदालत को बताया कि उनके मुवक्किल इस घटना से सबक सीख चुके हैं।

इस पर पीठ ने कहा कि उसे उम्मीद है कि ऐसा ही होगा, लेकिन यह भी स्पष्ट किया कि आरोपी के विरुद्ध लगाए गए आरोप अत्यंत गंभीर प्रकृति के हैं और उन्हें हल्के में नहीं लिया जा सकता।

अदालत की सहायता के लिए नियुक्त एमिकस क्यूरी वरिष्ठ अधिवक्ता अशोक मुंदरगी ने दलील दी कि आपराधिक न्याय व्यवस्था में जमानत सामान्य नियम है और जेल अपवाद, लेकिन जांच पूरी होने और आरोपपत्र दाखिल होने तक आरोपी को न्यायिक हिरासत में रखा जाना कानून के अनुरूप है।

महाराष्ट्र सरकार की ओर से पेश महाधिवक्ता मिलिंद साठे और मुख्य लोक अभियोजक शिशिर हिराय ने न्यायालय को आश्वस्त किया कि दो दिनों के भीतर कल्याण ज़ोन-3 के पुलिस उपायुक्त को जांच का दायित्व सौंप दिया जाएगा, जिससे निष्पक्ष और प्रभावी जांच सुनिश्चित की जा सके।

राज्य सरकार के इस आश्वासन को स्वीकार करते हुए हाईकोर्ट ने मामले की जांच डीसीपी रैंक के अधिकारी को सौंपने का आदेश दिया। अब इस प्रकरण की अगली सुनवाई 31 जुलाई को होगी, जब अदालत नई जांच की प्रगति की समीक्षा करेगी।
